  1. Not necessarily. You'll have to file a US tax return, but that's the case for green card holders too anyway. And you may not have any taxes due depending on your circumstances.

But the person you're asking about is still within the quoted processing times anyway, it's not been 14 months yet (and as said above, that's only for 80% of cases anyway - they may be one of the 20%).   3. Can you give me an example of an I-130 taking 10 years to be approved? Never heard of that, and if you look at the timelines on here you'll see most have their I-130's processing within the quoted processing times. Here's a recent thread re: a LPR petitioning for a family member, I-130 took only 4 months to be approved - https://www.visajourney.com/forums/topic/815880-approved-i-130-need-help/ What does take a long time when petitioning for a sibling is the wait for a visa to become available, that'll be 15+ years. If you look at the OP's timeline, you'll see it was approved in September 2023, so took 10 months. But there will be various factors that will have an influence on the amount of time the I-130 takes, and the main one is the service centre. USCIS used to give processing times for each service centre, but now lumps them all in together for 10-14 months for some reason, which isn't hugely helpful really. Worth noting too that the 10-14 months quoted is only for 80% of applicants, so 20% of applicants will have their applications take longer or less time than that, not everybody will definitely have their answer by month 14.
  4. Just scroll up and you'll find lots of people, but they haven't got to Nov 2022 yet. Last IL's were for those DQ'ed in Sept 2022 - see the few posts above yours. So hopefully you'll have yours in March/April time, good luck.
  5. Assume it's just your brother applying for the visa? If he gets it he'd travel on his own and leave his wife and kids in Cameroon? That will be helpful as it gives him a reason to return, but do just be mindful of the fact that Cameroon has a super high refusal rate (something like 55% of B visa applicants were refused in FY 2022 IIRC), so his chances are low. He should definitely apply, but just don't get your hopes up and be prepared to travel to him instead. Good luck.
  6. Thanks for filling in your timeline, but it doesn't make a lot of sense - says your I-140 was approved 7 months before it was submitted! And says your file was at NVC before that too. Can you rejig it a bit so it's accurate? It's just that the more people fill their timelines in the more it helps other EB applicants (and there aren't a lot of us to begin with!). Thanks.

I would personally only use official sources and VJ for processing time info, rather than a Google search which could bring up any website (and there are at least a few that are notoriously unreliable). The quoted processing times are for all applications, regardless of the status of the petitioner. When the status of the petitioner does make a difference is the wait time for a visa after the I-130 has been approved, and of course it can also make a difference which service centre the I-130 is sent to.

  11. So you're asking about the interview? If so, that's normally scheduled for you, you have to wait until you're Documentary Qualified and then will be added to the queue for an interview. Is the sponsor a citizen or LPR?

  13. As you've got a long time to wait until she'll be able to get a visa, personally I'd also wait to submit the AOS and DS-260 - you might as well hang on until you've got the 2023 docs, as it won't impact anything if you do wait.

Refusal rate is very high in Nigeria though, so a lot more will have been applied for than issued.

  17. You have to contact your GP, but don't have to go in person. I applied for my SCR online and got it sent via email about an hour later. So just give them a call or see if they have a way of requesting it on their website.
  18. Yes. Only my opinion but I’ve only heard of EB applicants getting IL’s so far this month, so I’d guess that spousal are still to come (note definitely just a guess!). Normally the end of the month anyway so still could be a couple of weeks away.
  19. They'll allow you to send it in afterwards, it will just delay things but you won't need a second interview just for that.
  20. Yep, I do. We're very lucky that London is one of the quickest consulates out there, even our passport return was super quick (interview on the Monday afternoon, visa received on the Thursday morning!). I can't imagine how tough it is for people who have a current PD and have been DQ'ed to have to wait 2 years for an interview as at other consulates. You may not get an IL this month, but hopefully should be Feb for an interview in April (ish) as a rough guide. Best of luck.
  21. They don't send them out as a bulk email, each is individual and they seem to come at different times of the day. It's actually pretty transparent I think, London informs NVC of what slots they have for IV interviews, NVC then fill them in Tier order and DQ order. London generally has enough slots that anybody whose PD is current and has been DQ'ed at least 3 weeks before will get an interview, but the cut off date for DQ's can change each month depending on demand. Immediate relatives are given priority over other family categories, so those waiting for spousal/fiance/parent visas will get the first interview slots, and then any left over will be given to the other categories which means that sometimes those in your category or EB categories won't get lucky, but in London that's pretty rare (other consulates i.e. Montreal or Lagos, have people waiting for years who are in Tier 2 or Tier 3 as they have such huge backlogs of Immediate Relative visas to clear first).

PD is currently 1st Jan 2015 for your category, so 1.5 years behind your PD - https://travel.state.gov/content/travel/en/legal/visa-law0/visa-bulletin/2024/visa-bulletin-for-january-2024.html But remember that it's not linear, if you look at previous VB's you can see it's only moved 1 month since Sept 2021, so very slow progress in the past 2.5 years. If it carries on at that rate you're still more than a decade away, but nobody can tell you for sure. Just keep an eye on the VB when it's released each month. Good luck.
