  1. You said last year that your Mom 'recently' became a citizen - when did you get married, before or after that happened? As everybody has said above, you're not eligible for F1 anymore. The question is are you now F3, or did you get married before she became a citizen (as there's no category for married children of LPR's)?
  2. Yes, but only those over 21. If you petitioned for her before she turned 21, then she's an immediate relative so there's no visa quota (and that's locked in, she can't age out). Maybe have another read of this thread from the start as it's all explained there, that's why it was suggested that you petition for her instead - so she's not got to wait for a visa to become available unlike your other stepdaughter.

  6. Oh apologies, I totally misread your PD! Where were you born? And definitely EB-3 SW, not EB-3 OW? Might be worth starting your own thread as this is an EB-2 one.
  7. Then that's why you didn't get an IL in the April batch, your PD wasn't current! Seems very odd that your lawyers haven't told you why you haven't had an interview, and why they reached out to NVC and the consulate when surely they knew that there was no visa available to you? Your PD only became current last month.

  10. Daft question I know, but I'm assuming you've done as the consulate requests on their website and tried the following? "Please use the web form at https://china.usembassy-china.org.cn/visas/immigrant-visas/immigrant-visa-unit-question/ to request for rescheduling." Also, they say to use US Travel Docs website, not US Visa Scheduling? Not all consulates have transferred to US Visa Scheduling yet.
  11. Good spot. For an expedite doesn't that need to be for the USC as well though? So if it's the beneficiaries job, would that count as a reason?
  12. OK. There was a case at the court of appeals that addressed this that I was thinking of, but it's not relevant to GA residents. Have you submitted your DS-260 etc?
  13. I agree with the above, you're really risking your status and I don't understand why you've been out of the US for another 6 months when you've already been told you're cutting it fine. What evidence do you have that the US is your permanent home?

  16. Which consulate? DCF would have been the way to go, but if you've already filed the I-130 that ship has sailed now.

  18. You both have F2-A on your profiles, is that right? If so your PD’s aren’t current yet and so there’s no visa available anyway. Or is yours an IR5 case @wheondo?

  21. Do you not have lawyers via your employer helping you with all of this? You say you submitted the L1 extension but presumably you mean your employer did? It's not something you can apply for yourself, they must submit the I-129. You can file for your EB2 now, you don't need a job or to even be working in the US to do so. Probably no point in applying for premium processing for the EB2 as there's quite a wait for it under the Visa Bulletin so it could be wasted money. Definitely send it via courier next time!   23. Those that applied in 2008 still aren't eligible for visas though, the date on Table A is August 2007, so maybe 4 or 5 years before your mother gets her visa? If you have aged out (or will age out), then another option is for your mother to petition for you once she's got her GC and is living in the US. That'll be another decade or so from when she applies, but is at least a solid Plan B. Good luck.
