Level-With-Me got a reaction from OldUser in Medical Marijuana use and upcoming medical exam
    UPDATE 8/14/24:
I’m not sure if this is the best way to update as I’m not able to edit the original post, but for anyone who stumbles along this post in the future, here’s what’s happened:
My fiancé was advised by an immigration lawyer to check off “NO” on the questionnaire regarding drugs - the questioning was along the lines of “have you ever used any illegal drugs” and according to the lawyer - the answer was no because he was prescribed this by a doctor. He then handed in his medical records showing his prescribed marijuana usage along with a note from said doctor stating he is no longer using this medication and that he fully believes that my fiancé can move forward without using it and that he’s never gotten any indication  that my fiancé abused the medical marijuana.

My fiancé then went to his medical in early April and the doctor seemed pretty good about it, but she said she wants him to have 3-4 random drug tests in the next 3 months to prove he’s no longer using. This prolonged our already long process, and because medical was in London, and he lives in Jersey, he had to then fly back and forth every time they called over the next 3 months - he had to book a ticket and fly there on 72 hour notice each time 😵‍💫 what a journey this truly has been! (For those wondering, Visa Medicals in London did give him the option to get drug tested in Jersey by any GP,  but he called nearly every GP / Hospital on the island and nobody offered drug testing 🤦🏼‍♀️ in fact, they acted confused everywhere he inquired about it)

He had 3 clean drug tests by the early July, and his interview was yesterday and it was very anticlimactic - all she said was “everything looks good, you’ll get a letter in a week or two”… didn’t tell him if he was approved or not.. but they kept his passport. So we are still very much on edge.. praying after all this time that something doesn’t crumble at the very end and he gets denied. 😔

Hopefully, all will be fine. But what everyone needs to know: be upfront about any medical marijuana usage /
and STOP USING IT as soon as you start the k1 process! Get any supporting docs from your doctor and prove to them that you are not an addict.

Luckily, it sounds like the US will soon lower the drug classification on marijuana, so lots could change. But until then, stop using and be truthful!
  2. Thanks

Hi there, thanks so much for the helpful information. I saw that here on VJ there is actually an online chat available with immigration lawyers from JustAsk.com and I’m contemplating paying for the 1 week trial to get a few questions out there and then that way I can relay the transcript of our chat back to my fiancé to advise him on what NOT to do 🤦🏼‍♀️

I live in Michigan so I also reached out to a Detroit pro-bono immigration place and they gave me a ton of helpful resources. I definitely want to get over this hurdle, however it’s so scary knowing that he could walk into his medical and walk out with a denied visa.

    thank you again

Hi, thanks for all your input, I appreciate everything! Yes - I’ve spent hours searching this forum and haven’t been able to find anything regarding medicinal use. My concern is that the London medical exam people are using doctors who must comply with the laws of the US and in the US, they still don’t recognize marijuana for medicinal purposes.

Funnily enough, the thing you posted with the question to the lawyers was actually asked my me 😊 I did see their answers and they didn’t give me much hope.

Yes, a way better option (preferably not smoke it, but use the oil) than socially acceptable morphine or other horrible prescribed medications for example! I assume you are not aware that it can be used for that purpose?

OP: how did he manage the pain when he was visiting you in the US? The reason I am asking is because they can try to challenge him on that, they might wonder why he didn't 'need' it in the US. I hope this all works out for you!

Your journey is not over. If the doctors/ the embassy feel your partner’s use is an issue he will have to refrain from using marijuana for the next year.
I’m not sure when the medical is, but I suggest he speaks to his prescribing doctor and requests he 1. Asks the doctor to write a reason behind the past prescription 2. Prescribe something different 3. Start documenting that your partner has stopped using marijuana.
Another member based out of the UK starting documenting he stopped drinking several months before his medical and this shortened the period as his year look back was not from medical but when he stopped drinking.
I want to repeat YOUR JOURNEY IS NOT OVER. if you want, if your partner is refused you can consider getting married and going the spousal route. A refusal is not the end of the road.

Nobody has ever reported a hair test at Knightsbridge clinic. They use a urine sample to test for drugs if you admit to ever using drugs or even trying out one time.

Drug testing is not a routine part of the visa medical exam.

So to start with it is that number you need. Then once they have put it into the system you will get another number and then that’s the one you use from then on to book the interview.

I got the NOA2 notification and we just got onto it fast. The first enquiry it hadn’t been put into the system yet, but on the second it had been and got my case number. (This was like two days) my lawyer then submitted one, and had the case number through again and the next one I did was the case was transferred to London. Once it got transferred and I got the email to stay it was we was able to sort out the ds160 and the medical and interview.
