    Hello all,

I'm a US Citizen filed for my spouse (he's outside of US)

Submitted the form on OCT 7, 2021

Case is being actively reviewed by USCIS since May 10, 2022

On my receipt notice, it says my case is with Texas Center

I sent Service Request (filed inquiry) on my case and called the USIC customer service center multiple times and I could not get pass the automated system to speak with a service representative.

Can anyone please help me on what I can do to speak with the USCIS rep? Every waking day is dreadful waiting for the case to move and it's causing a lot of issue with my marriage.

I am not sure if you've already tried this but I my PD date 10/8/2021 as well and I can offer the suggestions to you in hopes that it helps. These are something tips that around last year I'm not sure if it's still the same but for what it's worth here we go...

Ask Emma ? once you get to ask Emma say info pass,  then say you want to make an appointment it will Pass you through to an agent.(if things are still the same)

2nd go to the top right of USCIS website go to the chat with live agent.

3rd, and final something that seemed to work awhile back is send or update some information at a documents,  pictures , file K3, it's free , adding documents online maybe it'll prompt them to look into your account to see if something had changed . K3 has to be mailed in...it didn't help me but, I did receive all the RFE for something so minor back in July 2022,  9 days later ,I did get an approval in July of 2022, my journeys in my timeline but I'm still waiting for an husband to be interviewed in Morocco. Geez sorry can't be of more help .those are all tips that I have , if you don't understand something just ask.🙂 Inshallah, you hear something soon!  Keep me posted

Hi @Surulere, did you get that 2 months automatic notification about the case been in line for an interview? Got mine yesterday... When I saw that I had an e-mail from NVC, for a brief moment I thought that it would be the IL, but unfortunatelly it wasn't. 😥

Hello,  we have passed the 2-month mark and I never got a two-month automatic notification saying that my case is in line for interview should I be concerned with DQ day is 9/26?   Should I reach out to Embassy? Thanks

Me too... 😥 Really hoping that we hear from them this week, otherwise we probably won't get an appointment this year. I did some research on E1, E2 and E3 visas waiting times from DQ to IL here in VJ, and the average is 45 days, which is approximately what we've waited so far.

Hello everyone , I was DQ 9/26 still waiting for IL too. The perplexing thing is that up until the end of July , IL were taking 1-2 weeks max. Now , those DQ'd in August are still waiting. IL just went out again and it went to those DQ end of July thru 1st week August. They are basically advancing 7 to 10 days per month, I heard the only send letters once a month, anyone else hear that?  I thought we'd have an appointment this year.I hope we all hear something soon, ishl.

I saw you were at Vermont? I’m also at Vermont. NOA1 December 15, 2021. I haven’t had any notification of it being actively reviewed. If I may ask, when did you get a notification is was being actively reviewed?

Hello, I was AR (active reviewed) 2/20/2022 .  Approved 7/13/2022. Did you call Emma to be sure your case is still in Vermont?  To get past all the prompts and talk to an agent say , "info pass", They  love to transfer without notice. If you are still in  Vermont , Vermont is a more consistent center . I think  they take long BUT you find they generally stay in order of received for the most part . I think that they are like averaging 11 months . That's the 🙄 😶 positive thing I will say looking back about Vermont . It's not too common now, but it wasn't uncommon to see people go from no update/ active review, to approved.

Interesting... That said, you are still statistically "about right" per USCIS average i129F processing time for Vermont (5.5 mo, mid-March to end of August)... If you're k3 was denied, you should see the approval document online in your documents tab in the next couple days. Also, seems like Vermont might be ahead of the curve in processing times, since other SC's people are still waiting on September.

Awhhh, yes you are right about the k3 dates forsure . But the theories of USCIS denying the k3 and then getting an approval soon after it's kind of wrong, that is something of the past ,  as my i130 was approved in July, almost 2 months ago.i am currently 30+ days of waiting at the NVC phase... I'm actually shocked to see so many people still waiting from October 2021 as I thought I was one of the last ones to be approved for October, again going back to the inception of this post , you'll see so many approvals . That being said, it's clear the country where the beneficiary from play a part as well as the AR date.

Regardless, I am hoping that I've crossed all my t's and dotted  all my "i' s "and  that October 2022, I will have my DQ and be complete with this, process .. inshl.

Just out of curiosity, did anyone here who is still waiting file a K3 visa? If so, when?

I filed k3 back on March/ 2022...and 0.00 help. My service center was Vermont. I just received a denial of my k3 yesterday, August 30th. If you look back at the beginning pages of this post . You will see it seemed to have been effective if you filed it between October 2021 and January 2022 of this year , having the most effectiveness I seen was from Texas service center ,0 effect in Vermont.(from all those that I followed )Potomac was second with the effectiveness and rarely in California and again never did I see any positive outcomes from Vermont, but that's just my take on it . I did file  k3 in March 2022  and looking back  I didn't see any other positive outcomes at all for those who filed after January , 2022 so for me it was unaffective, just for what it's worth.

My PD 10/8/2021.i hope everyone still waiting gets the answers soon! inshl. If you are reading this and feel stressed , anxious, off, "not yourself", I promise you are not alone! It's this process! To end on a positive note anyone who's reading this please realize you are one step closer regardless, they can't keep you waiting, but for so long! Your time is coming💛 insl!

Hello , hang in there! I don't think it's going to be much longer for you. My husband is in Morroco as well . I had a different SC (Vermont) 🙄😶. I see alot of activity on the boards and from what I seen overall 345 days for CA i130 has been average. I hope all those still waiting get answers soon inshl. Good luck

Have you seen any other august cases get approved this month?

Hi, I have been seeing July cases ...I know it's frustrating 😖 I truly understand, it's the not knowing and you can see cases weeks or months after you get an approval... It's no way to know the process😑 One thing this journey teaches you is to expect the unexpected and to not let the "approval letters of others" bother you but I KNOW its hard. I made sure to check-in every one and a while to see if there were updates  🙏 for plenty of approvals this month inshl.

I’m an August filer and I have been waiting for 316 days as of today. Really trying to hang in there. I’m at the California service center

I KNOW its hard and I am starting to see July cases from the CSC . I think it's hard when different service centers have drastically different timeframes. Hang in there and 🙏 that you have answers this month. Inshl

    Hello everyone!! Any updates ?
186 days on AR, waiting and waiting!!!!!!!

Myself and a few others 192 days in Vermont  CS, still waiting too! From what I read, due to the recent events, it  might be a bit more of a delay than normal , maybe adding a month or two to the current wait time.

Which wouldn't be so atrocious if we only knew how long the "current wait time", was!  As I always end...one day closer to an approval, inshl!

What does waiting your turn mean when it all appears to be random?

I'm seeing people from the same service center still waiting after 10+ months whilst others have been approved in 4 months even though they filed a few months later.

I don't blame anyone for trying to get USCIS to look at their case because it appears as if filing a K3 or putting in a service requests does get a speedier approval (sometimes).

Thank you, well said ...it's Ramadan and I am fasting , I cant eat anyone at the moment.🤐 ...it's hard ,😒. So I  can just look and 😁.

Doesn't a K3 need to be work authorize just like a K1? I know it's been awhile since we have seen any of them so I can't remember that detail. If so then the reason for the expedite is kind of pointless as the OP's spouse will not be able to work until AOS is filed and an EAD received.

Hopefully it does just trigger the the I-130 to be pushed forward.

Yes, you are right . I understand that the k3 would be counter productive and you seem to understand the jist of it.

When I submitted my paperwork to Congress it was about the i130, but it was pretty much a retourical response back that that's what they were going to do because the i130 was in active review, so yeah, I really wasn't thinking to  expedite the k3. But I wasn't, "opposed", or going to turn down the ,"nudge" to USCIS (kwim) .

I know its rare , nearly impossible if at all to issue the k3 , but more or less if they call it's an opportunity to state my case and like you say perhaps trigger the i-130.  Thanks for your response.

Certain;y sounds an unusual and complicated basis for an expedite.

    Awhh , oh , wow ,okay🙄 .

I'll say  I thought it was articulated successfully , as the Congress responded to me in four hours, and  advised me that they already had made contact with the slow, never responsive  USCIS, not to mention the USCIS ,knee jerk reaction reaching out to me within  24 hours to the Congressional inquiry. 🤷‍♀️. But hey who knows !

  14. 38 minutes ago, ROK2USA said:

In my opinion most likely scenario: I assume you will get a response from USCIS saying action has been taken on your I-130 because it is under active review... and nothing else will happen. You'll be waiting for the K3 to be administratively closed and an approval of the I-130.

Be aware, some people have their K3 denied because they have an I-130 on file and the I-130 is not approved immediately but takes a month after the K3 closure.

If something else happens,  (K3 approved with the ability to schedule an interview after 1 or 2 months OR I-130 approved immediately) I will be pleasantly surprised.

I don't think a lot of people push for the K3 to be approved because they aren't interested in adjusting status and would prefer the K3 act as a catalyst for the I-130. So, no one can tell you what will happen when you get your phone call.. although some will tell you they won't be calling you in 1-2 days...

Hello , thank you for your response. Yes, I realize the k3 is a long shot ,  It wasn't my suggestion , or even something that I thought would happen, but rather like you stated  a catalyst to nudge the i130 .

It was the  Congress rep who stated what they were willing to do ,and stated because the i-130 was in active review, they wouldn't be willing to act on that, but would send an expedite message for the k3 ,of course I wasnt opposed.

I  have seen several of  your  post just prior to your approval and after, and I think we have a similar  mindset  /views about this process.

I really appreciate your articulated answer .

I'm starting to get a clearer picture of what to expect and maybe it's 0.00.  I am at 190 days of this side show .

I remember you noting your approval at day 260 and  mentioning  the average was  like 250 to 260 days , so perhaps I have another 2 months .🙄I have never experienced anything like this before .

I will update you on  the disposition. At this point I have no expectation especially when you see people getting approved for doing silly things like sending fake notes /service request, it's crazy the whole situation is crazy.

I was trying to wait my turn patiently but as they pick and choose who they want ,when they want,  it begins to distort the way you perceived things and kind of results to acts of desperation  .

Thank you again for your response.i appreciate it.

Fewer than 10 K-3s are approved per year.

Your I-130 might be approved faster.

What evidence did you give Congress?

Thanks for the response , I would have to strongly agree, but the Congress rep said since  the  i130 is actively reviewing under 60 days they would only ask to expedite k3.  I didn't argue and it did get grant à call  for Monday /Tuesday.😏

    As far as evidence,

Nine pages of evidence showing  Financial hardship on business ( 3 sources ) with include Govt . loan Records,  financial statements, written statements ,a bit of humantarian  hardship ,evidence.

The verbiage from the USCIS  email says they WILL call within one to two business days.

I was thinking the email was just a formality and maybe they had enough evidence and wouldn't call BUT after rereading and it saying,  Will, I'm just kind of curious to what they could be wanting , to try to prepare?

  16. Good day , I am a USC and  Congress sent a expedite request to USCIS for our 129f or k3 Visa while our 130 is processing.  USCIS officer is calling us on Monday or Tuesday. Does anyone know or have this experience to what questions they may ask or what OTHER evidence they may require, as I had to show evidence to  Congress to get them to send this request. Also what could be a possible outcome, could they approve the k3 ? Or just speed up the  130 Thank you in advance
