    If you don't earn enough money to incur a tax liability then you don't need to file a return.

    I think you need to go back and read the statement right after question 45 of the i130 form. It clearly says that if the beneficiary is currently in the USA then fill in 46a - 46d. Clearly she is not currently in the USA therefore the questions surrounding the I94 do not apply.

    You can ask for an extension when the petition gets to the Consulate and your first 4 months is about to expire. The Consulate can extend in 4 mo increments up to one year but they are not obligated to.
