    It’s never a guaranteed approval ..therefore definitely not worth considering.

    Glad you survived…many in IR or K-1 categories waiting alongside you. 

    Believe me, going through this experience I’ve chatted with many people that chose to do it abroad or thinking about doing it. We have a group for those doing it abroad and IR-k1 wait is nothing. They definitely get their papers moving within weeks and few months while vawa and work visa take years. Most vawa applicants who filed 824 to move their cases to the NVC waited 2 years for an approval transfer, while IR CR got their approvals transferred within weeks or 4 months max in the same processing center. The welcome letter for vawa applicants takes 60+ days to months to receive and sometimes more, while IR Cr k1 in the same situation get it on the same day or within 4 days max. and it goes on and on till the end of the process. 
     

    I’ve waited 16 months for 824 to transfer my approved petition and now 17 months to receive the welcome letter and still counting. Other people I know who are also vawa are waiting over 25 months for 824 to get their approved petition transferred to the NVC. Being in an extremely abusive situation even when you’re away (especially for those still fighting or waiting for divorce) then the pain of being reminded everyday that you can’t move on till this process is over so you can start a decent life and leave the past behind makes this process abroad even harder because you are “stuck” you either choose to abandon the life you have built in the States for years that is being left on pause for the slight chance to come back one day, or just continue to wait in this miserable process, that’s a tough choice. 
     

    there’s definitely no comparison between the process for IR CR k1 and vawa abroad, IR CR k1 processing wait is a piece of cake. 
     

    I’m just letting the people who think of doing this either by escaping abuse or for any other circumstance know that it isn’t worth it. And we definitely don’t expect anyone to know or understand the pain except those who are going through it.

    His VAWA is approved and recently received an RFE from FO. asking for I-601. All they mentioned is he misrepresented material facts concerning maintenance of his F1 status. something while he was on F1. He is inadmissible to the US under 212 (a)(6)(c)(i).

     

    It is asking affidavit of hardship we will face if we will not qualify.

     

    RFE is not stating what info he misrepresented. What shall he do now? any good lawyer recommendation? what is success rate for 601? 

    Wait what? If you applied for vawa while you’re on an F1 visa that makes you inadmissible for misrepresentation? I was an F1 too and now seeking the immigrant visa abroad through vawa. 
     

     Can you please explain more?

    im trying to access more detailed info on my uscis online account because it only shows me basic info on the status of my case. I tried to proof my identity but it asked me for a DOS number which I don’t seem to have. It also asked me for this representative passcode so I can access my documents but my new attorney says she doesn’t have this passcode, she said my old attorney maybe has it. I thought uscis would give new access info to the new attorney. 
     

    How can the attorney access our info online? How can I access more detailed info on my cases online or is it not allowed since we are vawa beneficiaries? I see people being able to access all their info online, but it doesn’t seem to work on my account

  5. Hey everyone 

     

    I have a q about the police clearance 

     

    I got the electronic police clearance from the official ministry of interior’s website and it has an authentication barcode and serial number, but it has no stamp on it except this authentication barcode and serial number. The validity of it is only one month. I can get a new one at any time. But I’m wondering if this authentication barcode is enough to submit to the NVC or will it be rejected if it doesn’t have a stamp. 
     

    Does anyone have an idea of how this works? Like does it have to have a stamp or this authentication barcode and serial number is enough?

    I should receive an RFE because I sent very little evidence of abuse in the beginning. I wanted to send all the evidence I have but my attorney says we should wait for the RFE so we can respond according to the RFE

    "I want to go travel and see my parents but I feel like I'd be taking a risk even with the AP." And I also got a simple dui earlier this year (I wrote about it in detail in an earlier post as to how it happened, something I'm not proud of and my ongoing depression and PTSD contributed to it). I had to pay $500 in fine and the case was disposed of without any probation etc. I don't know if that would affect the travel on AP. 

     

    Appreciate your advise. 

    I honestly sent all the evidence I didn’t wanna wait for RFE because I didn’t want any further delays. But in your case, it will depends on the reviewing officer if he finds the evidence you submitted enough or not. 
     

    i don’t know about the dui and traveling, I don’t know if it will affect your travel at this point but hopefully other members can help with this info. You should also consult your attorney

    They only RFE if they need missing documents or a further explanation on a certain info. There’s no set time to when they send an RFE, sometimes even after the listed processing time has passed. And sometimes they don’t send any RFE. I never got an RFE from them

    hi fam, for anyone who did follow to join or consular processing through vawa, 

     

    do we have to pay the $120 affidavit of support fee on ceac ? 
     

    I thought vawa petitioners are exempt from the affidavit of support fee, but someone who’s also doing vawa through consular processing just told me that we still have to pay the $120 affidavit of support fee on ceac not just the $205 application fee.

    how long after the approval of 824 did you receive the welcome letter? How long did it take to receive the welcome letter after they approved your 824?

    hey fam, my 824 got approved so now I’m on the NVC process. I have some questions regarding the documents I will mail to the NVC 

     

    1-so after paying the fees on ceac, do I submit the ds-260 online? Then print out copies and mail them? Will I need to upload the passport size photo on the online ds-260 or just mail the photos to them?

     2- for the passport size photos, do I also mail few photos in the envelope package mailed to the NVC or will I just submit the photo digitally when filling out the ds-260?

    How many copies of these photos do I need to mail them?

    (When I did the student visa back then I remember uploading the digital photo on the visa application then taking few of them to the interview with me, so I wanna make sure if I have to mail the photos to the NVC in the envelope package or take them to the interview with me)
     

    3- and for the i864w, do I fill out and sign it with a pen and mail them the original or just copies?

    I’m also doing my immigrant visa through consular processing. You can definitely expedite the NVC process but the reason for expedite has to be a severe emergency. From what I’ve seen with other people, depression is not considered an emergency so, unfortunately, it will most likely be denied. 
     

    btw we have a telegram chat group for the NVC and consular processing, let me know if you want to join and I’ll send you the link. Many people in the group have expedited and it was a success but mostly for military reasons or severe medical emergencies like surgeries or a serious Illness.

    so, I'm asking myself a question:
    Was it the proper form to begin with when asking for your approved vawa to be transferred to NVC?
    so experimented members like @sandranj or @Pinkrlion might be able to throw their light in it.
     

    You can also file 824 to request that your approved petition transferred to the NVC

     

    824 has many purposes not just to request a duplicate notice. Approval transfer, follow to join, a duplicate notice, request for re-entry etc etc 

     

    Just wondering what the new update on my I-360 would mean 

  14. Hello fam 

     

    I submitted form I-824 14 months ago to get my approved vawa transferred to the NVC and the embassy to process my immigrant visa abroad. 
     

    824 has not been updated since, but for expedite denial. 
     

    On May 20 2023, my i360 petition (which has already been approved) was updated from approved to “we received your request for a duplicate card” “request for a duplicate card was approved” then again updated to “name was updated” 


    I didn’t request a duplicate card or made any name changes, 

     

    The status has not changed since, does anyone know what this might mean? Or if this is a sign that I’ll get a decision to transfer my approval soon?

    I didn’t submit 864w when I mailed in the 824 to the vawa address. I was told that the 864w should be mailed with the DS-260 to the NVC after the 824 approval and upon receiving the NVC welcome letter. Are you saying I should’ve sent the 864w to the vawa address when I requested 824?
