Hi everyone
I have a question regarding the 2 years 9 months period to submit N400
do we have to stay in the US without visiting home the whole period of 2 years 9 months? Or is it ok if we visit?
also if I choose to travel abroad to visit family for like a month, will this make the period 3 years till I submit N400? I mean the difference is only 3 months, I’m not sure if that’s worth not visiting my familY for 2 years 9 months.
Please someone explain because I keep hearing different information. Someone said if I ever visit my family abroad, even for a week, I won’t be able to apply in 2 years 9 months.

In all of my cases, USCIS took 14-16 months to schedule an interview in NYC.
No I meant after the approval, how long does it take to produce and mail the green card to me after approval

Hello everyone,
anyone got their GC in NYC? How long does it take to receive the actual green card in NYC?
the wait is different from a state to another, someone in Cali said 30 days, but we wanna know how long it takes to receive the GC in hand in New York.
thanks in advance 🤍

Does our N400, those based on VAWA GC, go to Vermont SC or does it go to the service centers closer to us?
-
Hello all,
I just paid the immigrant fee, I understand my green card will be mailed to me soon, but when submitting the N400, do I count 2 years 9 months from the day I received the visa, or from the day I enter the US or the day the actual green card gets issued and mailed?
Thank you 🙏

Hello family,
I just received my passport today and when I checked the visa it says “Upon endorsement serves as temporary I-551 evidencing permanent residence for 1 year”
I thought VAWA get a 10 year GC! is this just the validity of the visa itself, or is this gonna be the validity of my green card ?

Divorce good, annulment bad…pretty much sums it up.
Got it haha thank you Family for clarifying

Honestly, to play it safe I'd just file for divorce. Annulment based on bigamy should be fine, annulment based on any other factors likely would not.
Same link: https://www.uscis.gov/policy-manual/volume-12-part-g-chapter-3
Makes sense. Thank you for clarifying @Demise

That info on annulment was specific to other posters circumstances..who already has LPR and bigamy was unknown at both stages.
If you are contemplating annulment for bigamy before green card, then ask how to handle that,
Nothing holding you back from filing divorce anytime , including now. ..if you can navigate service and remote appearances
No bigamy isn’t the issue, I was confused about the info regarding divorce and the eligibility to naturalize in a normal divorce or annulment situation not related to bigamy

Dear demise can you please share a link that if the VAWA recipient is still eligible for us citizenship even if they are divorce and there is no need to be I. The marriage and 3 years rules doesn’t apply to the VAWA recipient.
I thought everyone is eligible to naturalize if the vawa is approved regardless of their marital status with their abuser! Am I wrong?

Well, only Sandra can answer what she meant however the 3 year VAWA naturalization remains open to divorced and widowed spouses.
It is a bit more complicated regarding annulment since we can definitely debate if someone with a legally void marriage due to bigamy of the USC spouse who adjusted via VAWA got their status as a "spouse of a US Citizen". However in the policy manual (see above) USCIS has extended the eligibility upon intended spouses as well.
Yes because 90% of the vawa beneficiaries I know were divorced before their vawa was approved anyway and they are now US citizens. So I was confused by that information. I just wanna know this for sure because I’m still waiting for my green card and also filing for divorce since I don’t know how the annulment works in my situation.

Do not file for annulment.
Divorce or Annulment
A person’s marital status may be terminated by a judicial divorce or by an annulment. A divorce or annulment breaks the marital relationship. The applicant is no longer the spouse of a U.S. citizen if the marriage is terminated by a divorce or annulment. Accordingly, such an applicant is ineligible to naturalize as the spouse of a U.S. citizen if the divorce or annulment occurs before or after the naturalization application is filed.[24]
The result of annulment is to declare a marriage null and void from its inception. An annulment is usually retroactive, meaning that the marriage is considered to be invalid from the beginning. A court's jurisdiction to grant an annulment is set forth in the various divorce statutes and generally requires residence or domicile of the parties in that jurisdiction. When a marriage has been annulled, it is documented by a court order or decree.
There is one decision about this matter, link below. The doctrine applies to all annulments irrespective of the ground.

Are you saying if I file the divorce before I submit N-400, I’ll be ineligible for naturalization?

Hello guys,
I have not been able to log in using my old account therefore, had to open a new one with a similar name. I had to find a way to come back here and give my testimony. I promised a few years ago that I will come back here to write about the outcome of my vawa application whether negative or positive.
I am a vawa applicant who started a vawa processing while abroad in 2019 and have been able to follow it through till completion. It was a long journey and a very hard one, but God finally did it for me. I received my Ib1 visa through consular process end of last year and entered the USA without any problems in january. No questions asked. I carried my own yellow file and handed it to an officer who took me to a secondary room. He took my picture and finger prints. Took my passport and returned it within 2 minutes. And told me welcome to USA. I couldn't believe it. Those who are applying from abroad. Keep pushing. Don't give up. God is going to make away for you. My journey started in 2019 and ended successfully in 2023. God bless you all.
Hi fam, how long did it take for your visa to be issued after the interview?

For those filing N400 after VAWA based green card, can we waive the N400 filing fees like the vawa 360 petition? Or the N400 fees cannot be waived?

@J2020 Be sure to go through your whole case..some officers try to re-adjudicate (which is not supposed to be) but hey be prepared. Be confident, articulate and polite. Don’t forget your important documents and copies. You got this!👍
Thank you fam! Yes for us that did the interview through consular processing was asked about the whole case, the abuse, and all the details. It’s gonna be tough to go through the abuse again but I’m gonna do my best to stay calm. Appreciate you @Stillwinning!!!😊

Hi everyone,

Hi everyone
for those doing VAWA abroad through consular processing, IB1/F2A visas, we created a telegram group to help each other because it’s a different process than doing AOS in the US.
If anyone wanna join, feel free to message me for the group link because I don’t know if it’s allowed to be shared here

Several posts and replies have been removed for needling and provoking the OP. There are more diplomatic ways of asking for clarification and additional information, especially when someone is under stress already.

Thank you for saying that. I personally went through a traumatic experience on here when I first joined. Some people here have issues and they’re emotionally abusive and cyber bullies. I don’t know why they are on this website claiming to help others when they go on attack when someone doesn’t know what kind of information to provide posting for the first time, instead of asking properly to guide the OP. Reading through this post made me remember when I was attacked here and I know how this OP feels. Most of us with vawa cases are living in fear and trauma we can’t even think and come on here for help because we don’t know anything about immigration or what information we have to provide here. Then they quickly accuse the OP of “gaming the system” or lying about the abuse. Seriously these members should be restricted or removed.

Hi fam,
I’ve been preparing for my Ib1 interview abroad, and the pain I have been experiencing seeing my file and the injuries I endured. I know I’m still trying to heal from the trauma I lived. but I’ve been avoiding going back to that trauma.
so since the interview done through consular processing at the US embassy abroad mostly have the officer ask about the abuse, I know it’s still a traumatizing sensitive topic and experience for me to think about or remember or talk about. I’m worried about crying during my interview reliving these memories. I’m worried that getting emotional and crying during the interview will have a negative outcome. How do we go about this? Anyone had any experience getting emotional during their interview?
I was just going through my case file to print out the important documents, and I cried going through these memories especially the physical injuries.
im gonna do my best to stay positive and strong, but it has been a lot of stress for years.
any advice, thoughts, or words of encouragement?
thank you ~
