  1. right now, its about a week it seems. hubby ticked the box, but had to go in, so don't bother waiting for it. since i've read that they usually come before the greencard, then the greencard shows up, i realized it wasn't coming on its own, so made a trip down on a tuesday, had it monday.

  2. go see an attorney. or someone else can read this and see what it means, but as I read it, anytime before the age of 18 doesn't count towards the overstay. But I don't know if the rule of the no AOS if you enter illegally would still apply if the person was brought in by their parents.

    (B) ALIENS UNLAWFULLY PRESENT.-

    (i) In general.-Any alien (other than an alien lawfully admitted for permanent residence) who-

    (I) was unlawfully present in the United States for a period of more than 180 days but less than 1 year, voluntarily departed the United States (whether or not pursuant to section 244(e)) prior to the commencement of proceedings under section 235(B)(1) or section 240, and again seeks admission within 3 years of the date of such alien's departure or removal, or

    (II) has been unlawfully present in the United States for one year or more, and who again seeks admission within 10 years of the date of such alien's departure or removal from the United States,is inadmissible.

    (ii) Construction of unlawful presence.-For purposes of this paragraph, an alien is deemed to be unlawfully present in the United States if the alien is present in the United States after the expiration of the period of stay authorized by the Attorney General or is present in the United States without being admitted or paroled.

    (iii) Exceptions.-

    (I) Minors.-No period of time in which an alien is under 18 years of age shall be taken into account in determining the period of unlawful presence in the United States under clause (I).

  3. im sorry, but how does this happen? are you all the sudden some push over? i can understand people not understanding how expenses work for a bit, but you've explained it to her, she obviously has a problem. i guess i don't understand the "gold digger" mentality, but i mean even they have to be realistic at some point, i'd assume. there must be more going on, but we don't know of course. i saw gl, if she isn't being reasonable with you, you need to sit her down and find out why she is even with you. if she says she loves you, and you still think she does, then you will be ok, but she should be able to calm down with the cash and help to build a life with you. i hope you find the root of your problems though.

  4. He completed the application process at Sears... (on their computer) took their "morals" test and everything... he must have passed because they gave him an interview appointment on the spot...(from the computer)... That was on Saturday... his interview was for the next Thursday... Monday they phoned and cancelled the interview without a single word of explanation... Guess his MENA name must not have been "caught" by the computer... :rolleyes:

    Maybe I can't PROVE that it was his MENA name (and believe me they are really good at making sure you can't)... so does that mean it is IMPOSSIBLE that this was their reason.... NO.

    If I'm not fair... believe me, I bet I'm more fair than MANY a job applicant reviewer whether I can PROVE it or not.. And when I see the audacity some of these companies have when asking for information in their applications I KNOW that it isn't for "neutral" reasons!

    After living (travelling and working) with a MENA name for 25 years myself....... I KNOW that having a MENA name can make things more difficult... I often think I should travel in a see through rain coat with nothing underneath so I can quit worrying about missing my flights due to "random searches"... Even after repeatedly flying on SW Airlines and producing as ID my Federal Government Security Clearance ID Card (that will get me into Nuclear Plants) I'm blocked from printing my own boarding pass in their self-serve kiosk. I have to go stand in the line and march up to the counter and stand there for 15 minutes while numerous people ask to see my ID, and whisper to each other, and go in the back and make calls, etc. So I just don't fly with them any more... no matter what the price difference...

    It's like they say.. "Just because you ARE paranoid, doesn't meant they are NOT out to get you...."

    I was asked to produce my "GREEN CARD" when I filled out an "instant application" for a credit card at Montgomery Wards in 1987..... and they flat out TOLD ME it was because I had "ONE OF THOSE NAMES"... My social security #, driver's license, name of employer, and my Visa Card # weren't enough... they wanted to see my GREEN CARD!

    When I marched back to the Credit Dept. to see who the idiot was that was asking the clerk to check my GREEN CARD... I found that they had already TORN UP my application form! When she saw I was a WASP she started trying to piece it back together and mumbled something about "THOSE PEOPLE" get things on credit and then "GO BACK HOME and NEVER PAY".... and she wanted to make sure I was here to stay..

    I then left their store and went to another Wards about 10 miles away, used ID in my Maiden name (a Scottish Mc name) to apply and immediately was given a $750 line of credit, no questions asked...

    But you know, I've gotten over that now... First of all because Wards is out of business, but mostly because I fiiled a discrimination claim against them and was able to buy my house with the money they willingly gave me as a settlement. Justice was served and I always hope it spared someone more willing to "give them the benefit of the doubt" from being treated like dirt because of their last name... like they did me...

    After awhile, the rosy tinted glasses come off....

    well i guess they're racist against everyone because the exact thing happened to my husband (sears) except they didn't bother to cancel his interview, he went in and they said that either something is wrong with the computer to pull his application or that another store has pulled it and is interested in calling him. told him they would call him on tuesday when someone who can pull it was there. no call.

  5. im a USC and my husband is canadian and nothing for us. at least i get call backs, but husband gets nothing and has a better resume than mine (i also haven't worked in a while so that's my problem). we finally have expanded our search to anywhere basically and see what happens. so i guess i'm saying, its not you, its the the economy. tons of competition out there. try temp agencies, but husband went to one, they saw his resume and are now "holding out" for a better job (basically because the lady gets commission for landing him this job) when he just wanted to work some random job. gl in your search. it is rough right now.

    In my opinion is is.. when you have such a brain, talent, professional suck sitting right underneath your Country, and all the media flowing into the homes of your citizens is basically American, you DO need to point out that there are talented people in Canada, working and being very successful while choosing to stay here. It is about raising awareness and making people in Canada realize that we DO have a culture, a voice and our own take on the world around us. THAT is what most CDNS need to hear... not another commercial from some huge American corporation droning on about how their product rocks etc. etc.

    And as far as unashamed pro-America dribble.. dang.. 1/2 the movies that come out as blockbuster movies are CHOCK full of pro-American often unfounded in reality dribble. It's high time Canada fought back I figure. :thumbs:

    In other words, Canada's way of fighting back against "pro-American dribble" is by creating "pro-Canadian dribble." Somehow I fail to see how that's any better. :unsure:

    As for who's Canadian and who isn't... why does it matter? Really. I don't care what nationality an actor or musician is, where they grew up, or what they've done. That's completely irrelevant. How well they act or sing (or whatever) is what's important.

    Besides... most Canadians celebrities achieved fame in Hollywood. So it seems to me that promoting them as "all Canadian" is a bit of a lie. If they had stayed in Canada, then I could see it.

    I think they're just showing they're proud of the Canadian who made it in an American dominated field. I remember those random commercials on regular TV about either Canadian actors or writers, but I like them since I either didn't know, or it was interesting. Though it was usually about people who were already dead, but I like random history. I guess its different if its about some newer person, but I wouldn't rant about it. I guess I see it like if someone got famous from your town, everyone makes it a big deal, because it makes them feel proud about their town. Even though I probably wouldn't care or use it as bragging rights, I wouldn't care if someone else did.

  7. I started looking for employment just before I received my I-551 stamp. The state I live in has a plentiful amount of jobs so I got quite a few interviews right away. I needed a job ASAP so the newspaper was my best friend. I literally called every number for every job I thought I could do.

    I got a job in less than two weeks after I started looking. In fact, I didn't even have my green card in hand yet, just my 551 stamp for few weeks I worked. I also didn't have my social security number either yet but I was working for a small business that could get away with that sort of thing.

    Is it actually a stamp (I-551) only because in the hubbys visa it mentions upon endorsement (I was thinking this means the visa) serves as temporary I-551 for 1 year... and I was wondering if that was correct... I thought it was a "stamp"

    I wanted to scan his passport (visa portion) and post and see if they stamped it correctly... all it says is that he was admitted on such and such date and CR1 is written in the middle of the circle where it say class until??? Weird!!

    its the right one. they do it like that now. I was freaked out too since i thought we were going to get the actual I-551 stamp, but you don't lol. green card comes pretty fast though

  8. lolol we had to do all this too. funny, the people at the tax office didn't know ####### to do, but calling the main office helped. oh somehow we managed to not have to go to the airport, even though our import papers were wrong (i guess they didn't stamp it. i think they gave us the wrong copy at the border).

  10. I think I have vented about this before... but I am living in the USA now right? My name is a state: Nevada.

    Yet I have never encountered so many people who look at me weird and ask me how to spell it. I always ask them if they have a map and they go: "Ohh like the state!"

    I just want to look at them and say: "No like the planet."

    Well, it's not your run of the mill name. This is the U.S., and you never know how people are going to spell their names. I had a university course with a guy whose name was pronounced the same as mine..... however, his parents butchered the spelling. Rhobhert is NOT the same as Robert. kkthxbai

    Well I just find it funny that in Canada people got it... but down here most people don't.

    People also don't pronounce it right half of the time either, something else I find to quite funny.

    Oh well thats the cost of having an awesome name I guess. :P

    lol i think they say it wrong because people say it two different ways, its like the whole tomato/tomAto debate. same with Nevada lol

  11. I see why you would make this thread Trailmix. There has been a lot of odd discussion about marriage and immigration lately, and everyone sees the process in a very different light. For me it was engagement and marriage first, moving and immigration second. I'm so excited to marry the love of my life! Without sounding corny... I can't wait to be married, Its not a step I take lightly. So I answered option 2 for the first 2 questions and option 3 for the last. You need to respect your husband/wife space, and I think some of the American petitioners don't really realize the sacrifice that goes into moving half way around the world on a leap of faith.

    Agreed... I find myself in a lucky situation, since my fiance DID make that sacrifice and transition last year, so he does know exactly what I'm going through (well, not exactly... he didn't have to do the whole immigration thing because he was already a U.S. citizen... lol). It helps

    well, I went up to Canada to be with my SO for the whole process and I know how it is. It sucked more for me, I think he likes it down here better. I don't know what is wrong with us, but we've never spent more than 18 hours (happened twice though) apart since we met in real life, so we're attached at the hip now. I don't think we planned on being some dynamic duo, but we really have never had anything happen yet that would make one of us take off without the other for vacation or family reasons. I suppose if he wanted to go to Canada, he would make me go, even if I didn't want to lol. We married for the long haul, he doesn't mind having to move, except for his parents bugging him constantly, but they've calmed down a bit. lol i think he regrets showing them how to use messenger.

  12. Well i told the lawyer to NOT reschedule the fingerprints. It is this Thursday. She said then that they would cancel the remainder of the processing because that appt was not kept.

    lol no I don't drive for a living, but I've drove that a couple times, once when i moved to texas from california, then with my canadian hubby when we came from newfoundland to california with a stop in austin, and of course cali back to austin. We got a little bit of questioning coming into Texas, at it was late (almost 1am) but husband just said he was canadian, and i thew out the "he has a green card" and he said have a nice night

  13. I'm just curious about something, although this probably has no bearing on the situation at hand. In your OP you said she was picked up at the border on your way to California. Were you coming from Texas? Why did you go through Mexico?

    on I-10 there are two check points (both inside the USA of course). If you're east bound I-10, there is one about an hour outside of El Paso. If you're west bound leaving texas, there is one about 30 mins or so into New Mexico.

    I'm perfectly fine with that. I just don't think my immigration status is any Tom, John, and Harry's business. "It's OK with the Federal freaking Government, and you, being a lowly Walmart cashier half my age, are out of line!"

  15. Nick went to get his new license with the temporary visitor removed three weeks ago and still no license in the mail. His first one came quickly. He called and the guy said it could be awhile because they are migrating data or using a new system. He even said if you don't have it by the time the paper license expires, go ask for a new paper one. We read that the DPS computer system was compromised by a virus so they may have a mess in Austin. Anyway, if you license doesn't come for a long time you'll know why.

  16. So now that I am adjusting status I am wondering about my Canadian car that is in the US. How do I go about importing it and what does it cost I have tried insuring it with Geico and Allstate and they both refused saying they couldn't insure a Canadian registered car.

    Any ideas?

    you can insure a canadian car, but you have 30 days to switch it over. i'm doing it now with geico. as for importing, if you didn't do it at the border, if you live near an international airport, take it to their customs and they can do it. importing was free. but if you need a compliance letter, you have to get that which usually costs something (GM in Canada is 80 bucks, dunno about the rest).

  17. Actually, it seems odd to me that it's seen as a crime, but I guess it is considered a crime. Reason why I don't see it as a crime, is because we tried to become legal residents. When it didn't happen after trying 3 times, we left. Yes, we were forced to leave, but we cooperated.

    Not sure why Charles is rolling his eyes, but I suppose he thinks I'm a criminal too. Look, just because we tried to become legal residents and it didn't work out for us, does not make us criminals. We didn't go into hiding after receiving notice of our removal process. I don't care if the whole of USA thinks of all illegal immigrants like that, but as long as we have not tried to fool the system, we didn't produce false papers to become legal, we were not abusing your government, we were working and paying our taxes all the way till it was time to leave, etc., we don't think we are criminals, no matter what anyone else might think. Some people have no idea how lucky they are to have been born in a better country or to have been able to become legal residents. Not everybody has such favourable circumstances. I know how grateful I am to have been accepted by Canada as a legal resident.

    Thanks Jer11 for your kindness. I should call the Embassy here to find out what my options are. Maybe my daughter can go there in 2 years to get our stuff. The kids are US citizens.

    To answer La Souris' question, yes, it was going to cost us about that much. And no, I didn't even contact Air Canada Cargo. I called several shipping companies at the time, and they were all quoting such high prices. We do have a lot of stuff. We had to leave everything behind, but I'm sure a lot of the stuff we can get rid of. However, that's something we would have to sort out for ourselves, but without being able to go there, we can't. I'm going to try and find a cheaper shipping company. Otherwise I'm sure there will be some other solution (my daughter maybe).

    Anyway, I was just looking for some answers here, not for pity or contempt. Sorry, if some people feel I have not respected their country's immigration system or laws. I'm no longer in your country, right? I'm just trying to come back for my stuff and close that chapter in my life for good.

    ok you broke the law. people who break the law are considered criminals. no one is saying you're a violent criminal, but no matter what you are. so calm down. you are what you are. you can't change it.

    but, i read an article, which i believe was posted in the canadian forum, where some canadian overstayed for years, and got deported. he was able to go back and get his belongings though. so maybe do a search, or of someone else finds it, they might post. i have no idea what he did to g t permission to do that, but it must be possible. but as others have said, yes you will need a waiver, but someone stated the other day, the waiver lasts forever. but, I think you should find out how long you're banned for first. It is probably 10 years, but only you can find out. maybe start there.

    as far as shipping costs, that is ridiculous. if i paid someone to move my stuff from newfoundland to california, it was less 5k, so unless you lived in a mansion, you are getting bad quotes. I'm pretty sure if I threw in our two cars, it would've been less than 10k. easy.
