I think there is some confusion! Per my attorney, your status is automatically extended if you timely file your application. The motion of filing the i-751 before your expiration date is what extends your status. The receipt notice is proof that your status has been extended.

So as long as you filed on time, USCIS will consider you in valid status. Your rights and privileges as a conditional resident are still in effect.

The tricky part though is until you get the receipt notice you cannot prove your status. For continuing employment, per i-9 guidelines, a conditional resident does not have to be reverified. But if you accepted new employment, you would need to complete a new I-9 and here now you may not have proof of status. In your question, you didn’t specify continued employment vs new employment, and the officer probably thought you were referring new employment in which case you wouldn’t have proof of status to complete the I-9.

I understand that having a lawyer is expensive, but they are very helpful beyond just completing forms as you can go through legal scenarios such as this with them.

    Y'all are not alone
Am looking at our spreadsheet and it appears Lots of other filers with your dates are waiting.
I recall someone in the past say USCIS tends to "skip around" like an entire week of files (i.e. those that files 11/16 to 11/20 would hear at different times. 11/20 might hear before an 11/16 folk)  but gets to everybody eventually.
Don't despair. Hang tight- hopefully it's all coming soon!

Nothing for us and delivered on 11/16. I am hoping this week. If nothing by Wednesday of next week, we will give them a call since we're nearing 60 days.

    Hello everyone.

    UPDATE:
My package was delivered on November 16th, 2020 and the check was cashed on December 31st, 2020 or January 1st, 2021. I was provided with the information of my petition being processed and it is in the system. In addition, I received my receipt number which I can use to track the progress on the USCIS site. The agent also mentioned that the receipt was mailed out on the 31st of December.

I'm praying that everyone else who filed around the same time as me or few days after me to receive some updates soon. I'll come on here to update y'all once I have more information.

I found a presentation on the uscis website about lock boxes. It says their job is to accept the correct fee, scan the application, data entry, and check the applications are signed and dated correctly. The reasons for rejection can be-
    incorrect fee
missing signature or dated incorrectly (sooner than 90 days for example)

It also gave guidance on things of lower importance like - only single side printing, no staples, avoid originals and odd size pages. I made all of these mistakes. I called USCIS level 2 officer and he told me that it is to make life easier at the lockbox and is not something that will cause the application to be rejected.

I didn't write n/a. I wouldn't worry about it too much. I checked my AOS and I didn't do it then either. Mine was received in 11/23 so hopefully we both hear something soon next week maybe 🤞🏼

Why did you send another application? I think that could really mess up things. 🥴

Omg you are brilliant. I had the same question, can I still work while waiting on NOA1. Because I have a feeling my GC will expire before I get the notice. I've been calling and asking people, and no one could give me a clear answer lol If you dont mind me asking, How do you schedule an info pass appointment?

A” number is short for Alien Registration Number, The 9-digit USCIS number listed on permanent resident green cards.

Don't think your current employer can ask for reverification of employment authorization. It should not be a problem for your current job. But you will need the I-797 NOA and your expired Green Card if you apply for a new job to verify that you are authorized to work. It is better to talk to your HR and have them confirm.

legally they cannot fire you for this immigration delay. they would have to consult the HR department on that or call USCIS themselves. they can ask you about your status, but just explain you have filed for ROC and that is all you can do till NOA shows up. My is a WFH employee and her GC expires on Feb 14 2021. All that have filed in november here are in the same boat

@darymak if the employer gives you problems for immigration paperwork that is out of your control (if you have flied on time) IMHO, it's not someone i would want to further be employed by. Ride it out, save your pennies for an emergency and hope for the best if they really don't understand your situation. Just an opinion. Like stated before the employer has the last resort to consult USCIS directly on how to handle this situation. Firing is an excuse, unless they wanted to do this from the very beginning.

    Good luck to us all
