    Hi! We received our NOA2 on 11/23/2020. NVC confirmed receipt of our petition on  12/22/2020 via email inquiry. I called for our NVC case and invoice number today (1/27/2021) since we have not received any email about processing at NVC. I was given our case and invoice #. The woman I spoke to at NVC told me that our petition was ready to be sent to Lagos but Lagos is not accepting K1 visa packets yet. I was shocked to hear that Lagos was not receiving K1 petitions since March due to covid-19 shutdowns! Can anyone confirm this?

    Hello I'm an April 2020 filer. I just came across this forum specific to Lagos K1 which is great! Unfortunately, I don't see much activity.

    The K1 visa can be denied at either the USCIS level or later at the US Embassy. In either case, a denial suggest that something is wrong with your application and you will likely need professional help to fix the problem. K1 Fiancé visas that are denied by USCIS can be appealed. Once denied, USCIS will provide you with a written notice of denial and instructions for filing an appeal. If you chose to file an appeal, you will have 30 days to do so. Unfortunately, filing an appeal is expensive. The filing fee for an appeal is more than the filing fee for the original application. Another alternative when your application is denied by USCIS,  is to re file your Fiancé Visa petition. This means you are starting over and many times this is the best way to proceed. Whatever problems or deficiencies that where present in your first application can be completely avoided by re filing.  Its also less expensive than an appeal. K1 Fiancé Visas that are denied by the US Embassy or Consulate have no formal recourse. Although there is no formal right to an appeal, you can try to contact the Embassy and asked for a review by the Embassy’s Consulate General or a Supervisory Officer. You will need to act quickly because once the case is sent back to USCIS for revocation, the Embassy no longer has jurisdiction over the case and therefore cannot change its decision.  If you are able to obtain a review by the Consulate General or a Supervisory Officer and its still denied, there is nothing more than you can do. You only recourse is to apply again or get married and apply for a marriage visa instead.
     
    As for both of you attending the interview, it is up to the US Embassy where your fiancé's interview will take place. Not all embassies allow that. Check with the embassy specific to you for that information. If they allow you to attend, I would go if I were you.

    Yes. At first I tried to get a hold of a CSC agent over the phone, but I couldn't get passed the automated system. So as soon as the processing time chart passed my date, I submitted the OPT (outside of processing time) online form on the USCIS website. I figure we will be seeing similar trends as March filers. Most March filers submitted the inquiry form as soon as they could. Then, they got responses around 15-20 days later. If they got a reply specifying their petition is being adjudicated, then they got their approval within a week (give or take).  I'm hoping this trend will be similar for us. Fingers crossed and good luck!

    My date is April 2nd too! I was planning on submitting my inquiry as soon as the "receipt date for a case inquiry" marks April 3rd. Is that an acceptable move to make? Would that annoy the CSC agents? Should I wait a few more weeks to submit an out of normal processing time inquiry?

    I just imagine Covid19 is making things function differently. It's hard to get backlog information.
