Hello my friends!
I need to close my AoS case, and start K3 visa process (the same person). Can you please advise me what is the proper way of doing that.
1.Just do nothing, and what consequences could be of that?
2.Call and explain my situation and they will close it?
3. Write letters? If I need to write letters, can you suggest where they suppose to go to. It were 3 cases (AoS, EAD, AP).
Completely lost.. Someone told me that I can not start K3 case until I properly close AoS case. Is that true?
Of course I want to submit my docs for K3 as soon as possible.
Will appreciate your advises on all that!
I'd just file the I-130 as normal but include a separate cover letter from the foreign spouse asking to withdraw their application to adjust status, AP and EAD. In that letter, reference any case numbers and simply explain an emergency required him to leave without advance parole.

Thanks a lot for all who responded!!!! Now I see our way more clear, still difficult to admit that we need to start all over and it's scary that our previous case can arise as a problem to a new K3 case...but seems nothing else we could do. May be someone has in mind a really good lawyer to help me with the case?

I understand now that K3 process is still available option, but many of you are right, it's horrible to imagine the length and the same process all over again :-((,
Thing about AP sent to him sounds very good. But how to find out if it's the option?? I have got his biometrics appt, after he left, so it was never done, if it matters
Just don't know should I ask lawyer about it, or INS?
About hardship waiver , is it something that can shorten the wait should we go K3 route?

to Dias Melhores- we can't do K-1, we are already married, we could not think of emergency AP, because it was real emergency, time was counted by hours, not even days
to rebeccajo-I also had in mind K3 route, but my paralegal who prepared our doc's for K-1 (she is very experienced and strong specialist), told me that it is practically no way for him to get to US, she told that the only possibility may be if we divorced, and then I go to Ukraine to get marry him again.... That sounds completely devastating to me..
Even if we start with K3 route, what will be with his adjustment of status process? Would be our K3 process harder and look like it has red flags, or it might be quicker since he was already approved recently??
should I hire really good immigration lawyer??

Hi my dear fellows VJ's! I have the following situation now;
My fiancé then came on K-1 visa. We got married and submitted documents for AOS. Everything was done in a timely matter.
Then suddenly in one week after we got notice from INS that they got our doc's -we've got a situation that required him to come back to Ukraine. It was a combination of events that we just could not do it differently at that time. We could not wait even one day. So we bought tickets for him and he left.
Now everything is back to normal, and of course we want and need to be together.
I realize what it means to drop the status; I understand that it would be extremely difficult. Just don't know where to start, and if it ever resolvable???????
Anyone who had some experience, or heard about simular situation-please advice!!!
Anyone who thinks I need to hire lawyer-please advise me on names!

So happy to announce-our visa was APPROVED!!!!!!!!!!!!!!
Interview was very easy, full of humor and jokes. appointment was at 9:30, by 11AM he was already done (including waiting time)
Can't even believe that that stressful time is almost over! (will be fully over when he gets here
)

Hi friends! Just wanted to share my great news!
It's already more then 2 weeks since Kiev Embassy got our case (hard copy). We called every day since they got it, but were unable to schedule interview. Today finally we got it! It is DECEMBER, 11 !!!! A week from today!!!
I almost fell of my chair, I never expected it so fast. Statistically Kiev is about 20-40 days from scheduling to actual date. Seems it has changed recently.
Anyway I am very happy!!!!

Finally!!! After speaking to 3 supervisors at CSC, USCIS and NVC..they finally found our paperwork. NVC received it last Friday and it's leaving NVC for Tokyo today and I got my new case number. I'm so excited!! What a rollercoaster of emotions over the last few weeks, I'm so glad this part is over! Thanks so much to all of my friends here at VJ for your support! (I just realized that I spelled "finally" wrong on the other thread..too excited to type I guess
)

Hello. I have two questions:
1. In part 7. at the very bottom of the page it says" I derive an annual income of:......"
My question is : should I put a figure based on W2 form of the last year, or figure that is stated on Employer's letter, which has a different amount since they increased my salary?
2. Oath or Affirmation of Sponsor part. Who should sign that part along with me ? Should it be done before notarization? Can Public Notary sign it?

Called to NVC today, they forwarded my case to Kiev today . After it gets to NVC everything is just so fast!!! The rep again was so attentive, told me that my case was completed and if I have questions about Embassy procedures I should call DOS number I never asked , but he just offered me a lot of info
I don't have it handy now, but will look it up if someone is interested

Thanks a lot for your answer! I was worried that on petition approval stage (where I also sent translations and my last name was different then it is on my Passport) we did not have any problems, but on interview when they see it again (and being able to read in Russian) they will spot it and it can cause a problem

Hi.
I am preparing docs for an interview and came across this question. I slightly changed my last name (just took off 2 letters at ending). And even completely forgot about that . Now when I am translating my original birth certificate and also previous Divorce certificate (Ukrainian) I noticed that it's different from how my last name written on my Passport (and on 129F). Will it be a problem ? And if yes, what should I do?
I don't have any documents about the change. Those who gone through naturalization know that it's offered by officer during the interview and then it's a done deal. Please advice me on that!

hi everyone! we just got our NVC case number today - MNL2007XXXXXX. i think, uscis sent it last nov 1 to NVC and NVC got it on Nov 8.
just be patient and we will all have our cases sent to NVC.

Thank you!! And 'afterforever' don't hesitate to call, it can do no harm to you. I called them every second day starting this Monday, because waiting and more waiting is killing me already. I am doing to call on Monday again to see if they sent it to Consulate

We got it to NVC too!!!!! On the same day!!! My recommendation is to call right after 6 PM Eastern time. Absolutely different treatment. No rush to get rid of callers giving them BS info. The rep was so nice , answered all my questions. I am very happy today again

I just called NVC and YAYYY they got my petition in, I was given the KEV number!!!!! When I asked them when they send it to consulate they told me in 1-2 weeks. I just hope that it would be sooner, based on what others reported.
Anyway-good news!!!!!

in K-3 Spouse Visa Process & Procedures

Is anybody knows what it could possibly be? My check was cashed 3 days ago. I was able to obtain WAC number from the back of it. When I entered the number into uscis site (I have account)-it says something that the case could not be found, not in a system.
Yes, I entered a correct number, 13 characters total, WAC and 10 digits. I even called and their automated system also could not find the case
Is it correct assumption that if check cashed and number is assigned -it's suppose to appear online immediately?
Can it be that they rejected it by some reason and sent it back, and that is why it's not in a system?
