  1. He's not asking about the problem for his wife to be, he's wondering if HIS visa lottery is listed as single and he gets married before he comes to the USA, that HIS visa will be considered misrepresentation since he got married and is no longer single. Am I getting that right?

I'm trying to know what the OP really wants.

    Ivy wrote it:

Okay, so let's see if I got this.

    1. You have a girlfriend.

    2. You won the lottery.

    3. You want to marry her between your interview and the flight to the US.

    4. Then after you come to the US, you want to petition for her as LPR.

Please correct if any of this is not true?

I understand that it's his question.

Sorry I don't know the process, so I can't help on this one.

    BUT

Did he choose this step because he wants it (so Ivy replied) or because he told himself that "I don't have any choice because of what the us embassy asked him".

I'm more sure that he chose the red steps because he told himself I have no choice.

SO, if this last note is true:

let's see: if they marry tomorrow and he has an interview in one week: the us embassy can't ask him utilities bills, properties bills...he needs proofs of dating, if you don't have any...try to find proofs, if you don't have like e-mail...ask several people to write affidavit (i don't know if the embassy will accept that). Try .

The real answer depend on what is the real concern behing the question asked.

My question is do you want to go with your wife? and avoid her to wait on your country so long.

If it's yes, so your question would be: how can i bring my wife with me without any tangible prooves that we lived together or meeting (something like that, sorry it's late).

and ask this question on VJ.

  2. I'm not an expert, and I don't know if you already have your interview, but if you want your wife to go with you quickly, your plan is not the best (don't take it in the bad way, please).

If you don't have bills with both your names (which is undestandable), give them proofs of dating.

It seems me that you just need proofs of dating not proofs of sharing properties or utilities.

Proofs of dating: pictures with dates (if possible), e-mail, phone calls...just that you knew each other before marrying.

I don't know at what level you are in the process, if it's before the interview or after. But it seems me that you will need more help from VJ members, to see if you don't have the option to go with your wife.

Please, if you want your wife to go with you, don't choose the plan that you choose only because you think that it's your only option. Ask on visa journey, whatcould be your different options?

I'm pretty sure that you can go with her, but you need some subject-matter expert. But if you don't mind...

  3. Hello,

Your child will be fine, it will be much easier for her than for an adult.

Regarding the cost of preschool, it depends on the state, the day care.

In NY state, for example, for WMCA a full day day can cost 800 per month. I don't think that it's so expensive in Florida or on some other locations.

Regarding free preschool, you child needs to turn 4 before december 1st (i'm not sure that it's the same for every state); also you can have free preschool, depending also on where you are living, I'm living on a suburb but my son can't go to a free preschool progamm because we don't live in the city. So next year, we will move.

So when you will know where you will live and want your child to go on a free preschool program, check with your town city school district (something like that online). And check with the closest city.

The price of a preschool program can vary greatly, so do some research to have an idea. Like california day care ( search by cities), Florida day care (example, miami...), to have some ideas...

On google, you can do a research on "how much do you pay for preschool" that will give you an idea. As you will see it vary greatly.

    Good luck!

  4. Since I will be the one flying over to the usa to meet my other half for the very first time, when I arrive back to Australia, can I just scan and send the copy of my entire passport which will show the entry and exit stamps to my fiancée as well as my birth certificate?

She can then print the copies and send them with the k-1 forms together. Will that be ok?

And another question, if the petitioner, in my case will be in the usa when I meet her, how can she prove she has met me, we will be taking a lot of photos together with herself and her family, when i being the beneficiary will have the hotel itinerary, passport stamps , luggage tags etc?

    Thanks a lot smile.png

I think that your questions is not so much clear, you can:

-you can scan whatever you want and send them to her

-you can do some copies in usa and give them to her

you can scan or copy , using mail or e-mail- what they need it's the copy of the forms, scan, copy, or print they don't care.

  5. -I don't see any red flags regarding all the points that you mentioned, I don't think that the Us embassy will see some red flags.

    But

Because you said that you were concerned, and when I read you post I didn't know if your were concern about we think about this case or what the us embassy may think about this case.

    So

In the beginning i though that it was kind of her to be ready to give up the I-140, really kind. I'm glad that I waited to read the VJ members' opinions.

    1) I met my husband online, it was on a website, they give you: the choice of the country, so when somebody find an American citizen on a website, they know what they are looking for: An American

I also think that they are more present online than other countries (maybe that changed, i don't know).

    2) So you have the state also, and the location (not the address).

If you want to meet somebody in Buffalo, NY. You do a search of a man (single, divorced... like you want), Buffalo, NY.

And you have all the details, color of the eyes, height, age...

I don't think that the "randomly stuff" works for the dating websites.

You find what you are looking for on dating websites.

If some people met on a forum game, it can be more "by random" than a website. But... On facebook and Skype, I don't understand how the dating search functions.

    3) I don't think that all those things are red flags or scams, it's more a security love (or sometimes economical love, don't know the difference) which according to me last longer that those kind of passion-2 year-love.

    4) The last one is the I-140. It's more likely a scam, it's true that if you want to get out of your situation and anybody promised you a good job, it's normal for some people to be ready to pay some money for a better future, even 2000$.

If she paid 2000$, it's in the logical line of thought, I'm not worried about what is logic.

But my question if, "is it true that she paid this amount"? - I would ask to see those papers, or an address or phone number that I can call...and do my own research. I'm surprised that she never asked you to call, it will be one of the first thing I would ask you to do for me, if I were on her basket. I don't even give up 5 dollars.

So I don't understand why she is ready to give up 2000$ so easily. I would wrestle for it and ask you to check for me, and cry everyday for it.

It's a logical attitude, for me; so a part of me don't understand why she doesn't react in a logical way. The only way for me to give up this amount it's if I make 50000$ per month (lol).

Sorry, I don't want to be harsh, I have just this kind of technical view of everything.

If she paid this amount really, so she is a treasure of girl.

    Good luck for everything.

  6. First of all, there is no way for you to enter the US with your girlfriend on a tourist visa with the intent to get married and stay. That's illegal, so you can disgard that. The only legal, fair way you can do this is by filing the IR-1/CR-1 and waiting it out. You can either move back to the States and have her wait in her country while the visa is being processed (which could take several months to a year), or you can live abroad with her, which is perfectly fine. As a matter of fact, couples who are living abroad during the processing times usually get approved quicker than cases where the USC is living apart from their foreign spouse (though nobody's really sure why this is). You could also do a K-1 visa, but if you want her to be able to work immediately after getting into the States, you should disregard that idea, too - it takes nearly as long to process as the spouse visa, anyway. These are, unfortunately, your only real options.

    They are married.

  7. People visiting can use their out-of-state or out-of-country licenses for as long as they want.

However, "residents" must get a California license within 10 days of becoming a resident.

But exactly how "resident" is defined is kind of murky. I think it's a common sense thing based on whether you're considered to be "living here". I don't think it has anything to do with your immigration status.

I agree with you, I read plenty of times the NYS booklet to try to understand the meaning of resident.

There are also the intent to stay, if for example you have a K1, just married, so you have the intent to stay in NYS. So you need a valid NYS licence (around 30 days after your entrance in usa).

There is no link between being a resident for usics and being a resident for DMV, and to add to the mess each state has its own requirement.

  9. Incorrect answer.

Mother is not a USC. She would be an LPR, so she petitions her 17 years old daughter in the F2a category. The wait is 2-3 years and the baby would be an eligible derivative.

The daughter must stay single. Marriage voids the petition since an LPR cannot petition for a married child.

Adoption is a horrible idea because it would be a sham for an immigration benefit.

I checked on uscis.gov, i didn't see anywhere that the baby can be an eligible derivative, can you please send us a link.

I hope that can help you.

    (5) Derivative Beneficiaries . Any alien classified as an immediate relative must be the direct beneficiary of an approved petition for that classification. Therefore the child of an alien approved for immediate relative spouse classification is not eligible for derivative classification and must have a petition filed on his or her behalf.

However, the children and, in some cases, the spouse of an alien approved for family preference classification, may be included in the principal alien's preference visa petition. The derivative beneficiary will be accorded the same family preference classification and the same priority date as the principal alien.

If the derivative child of a second preference beneficiary reaches the age of 21 years prior to the issuance of a visa to the principal alien parent, a separate petition will be required for that child. The petition must be filed by the same petitioner that filed for the principal alien parent, and, if approved, would retain the original priority date. Remember, this retention of the original priority date only applies when the derivative child's principal alien parent is accorded second preference classifi cation.

When adjudicating a petition, it is important to determine if there are family members eligible to derive benefits from the petition.

If the family is in the United States and the principal alien is outside the United States, the derivative beneficiaries may be eligible for adjustment of status under section 245 of the Act once the principal alien has immigrated (provided they are not subject to the bars contained in sections 245(a) or 245© of the Act), and should be so notified.

  10. I know this post is very old,Thank you again for all the replys.I was thinking to update and let everyone know how the things turned.

So i left USA and refuse to talk with my husband(because i was convinced that he was cheating me).

The first month i was very mad about all the things that happened, and as the time was going by was very hard to be apart from him.It was a mixed of fellings beeing mad, sad, missing him and doubts about what if i am wrong?

I camed back and i went in court to file a divorce.I was standing there holding the papers in my hand and i couldn't stop crying!I can't explain what i was feelling but was a very hard pain, and i couln't control my tears. The officer was expecting me to handle the papers and i left outside to calm down a little bit.

Since i got back i noticed my husband stopped any comunication with his ex's and her family, and tryed in every possible way to make our marriage to work.

    I never filed those papers.

We are togheter and very happy, and the things for the last 2 years(almost) are perfect!!Next year we want to plan our first baby :)

I don't regreted that i gived him a chance,i think i was too stubborn with all the situation, and actually i gaved us a chance.
