mlong1397 got a reaction from EM_Vandaveer in Could I marry my USC spouse on an ESTA?
If you come to the US on an ESTA with the purpose to get married, that is visa fraud. We got married in 2019 abroad. He came to visit me in the US on an ESTA. Was heavily questioned but made it thru. He got here just at the beginning of covid. It was out intention for him to return home after a few months, but with covid we thought that would be seen as a valid reason to change to AOS. Filed for that in June. Just had biometrics done. No EAD yet.

Okay, could be, that is just what I had read on other threads but perhaps I wasn't paying attention to the staying or leaving part. I would still think that you have to prove you are leaving and will be questioned more.

Just thought I’d share my filing timeline,
Originally mailed 5/16 USPS delivered 5/19.
Received back rejected 5/28 due to payment incorrect 🤨🤨🤨.
Remailed 5/29 and USPS delivered 6/1.
Got text messages for the 3 forms, AOS, AP & EAD 6/11.
Just have to wait now, good luck to all!!

The lockbox breaks down your packet into the correct format and or order whatever that is. They process your payment then send your packet to the appropriate center.

As far as I know, as soon as they start processing your AOS package your husband enters into authorized stay. I am super nervous because my husband began his overstay today and it has me all jittery but we will just have to push through until we can get our AOS package in.
Thank you for the reply. I went to add him to my bank account today and I am unable to since he is not a lawful alien yet... sigh. It is good news that photos, call logs, and affadavits worked for you though because we certainly have plenty of that.

Mine was received 5/16 and didn't get it back until 5/28. The date on the letter says it was rejected on 5/21
