  2. Just wanted to let you all know that I finally received my Interview letter last night at 1am. It's scheduled for Sept 26th. Thanks everyone for their support, it's been long time coming.

  4. So, does this mean that all the EB interview letters for this month is already sent out? Does MTL typically update status after all the IL's are done for the month?
  5. @LMIV Please keep us posted if you hear anything this week. I just looked at the EB tracker spreadsheet, and it looks like days to interview letter is estimated to be now 856 days (if you get interview this week). It will be the longest wait until now - 2 years and 4 months!
  6. Agreed. Great EB MTL numbers for March! Either March DQ have abnormally high numbers or MTL consulate is giving higher priority to certain workers like medical professionals. Either way, the strong EB processing numbers is positive news for us all.
  7. yes, this did happen to me when my I-140 got approved and the USCIS online case status said something like they have mailed the document to NVC for further processing. After waiting for three months, and making multiple weekly calls to NVC and USCIS, I couldn't make much progress. I received the standard response from NVC that my case has not been received from USCIS yet. USCIS case inquiry said something like they have forwarded the case to NVC for processing. Ultimately, I reached out to my local Senator’s office and they made an inquiry to USCIS & NVC on my behalf. They fwd me the response from USCIS. It stated that USCIS has forwarded my case to NVC on the day Senator’s office had reached out to them. Then after about two weeks later, NVC confirmed that they have received my application. Hope this helps!
  8. Thanks! This is such a great news! Would you be able to confirm with Sarah for cases that are employer-sponsored EB category, will they need the employer's approval to file cases on their behalf? Also, if a court delivers judgment on the NIW EB cases, would it get limited to NIW cases, or could it be general enough for all EB categories? Perhaps, it's too early to tell but trying to understand if court judgment would be limited to individual cases since it's been filed individually and not as a group class action lawsuit.
  9. Gotcha, that great! I think it will be difficult to convince my employer to participate in this lawsuit, especially since they have been waiting patiently for 2+ years and we are close to the end - April 2020 DQ date. However, I'm willing to put in my share of monetary support for the lawsuit for this group. This process has been excruciating for me and wouldn't want anyone behind me in the EB line to go through the same experience. We need to get the Montreal consulate to get their act together by being fair for all IV categories and transparent with the process.
  10. Since EB cases are employer-sponsored, I believe the class action lawsuit might need employer blessings/support too? MTL Consulate/NVC can easily argue that the applicant is not in the jurisdiction to file a lawsuit and the petitioner is the main beneficiary of the EB visa. A lawyer would need to clarify if this is true which is make it tricky since employers don't want to get involved in a lawsuit with the government. I’m not trying to be a downer (I fully personally support this idea), but just trying to understand if we need employer's approval for a collective lawsuit.
  11. I'm sorry to hear that. My understanding is that we cannot just pick any consulate in another country. There needs to be some ties to the consulate country, such as dual-citizen or permanent resident of the country, working in the country, etc. You could also consider adjustment of status (AOS) if you could move to US on a work visa such as H1B.

  13. I thought USCIS always had premium processing for I-140 cases. I believe our company lawyers filed my I140 application via premium processing. I'm not sure what is different with this announcement? Did they suspend premium processing for I140 during the pandemic?
