  1. I have my recently issued 2-year green card and I'm planning to go through the process to get a court order to legally change my full name soon.

    To my knowledge, USCIS must be notified immediately of the name change once it is issued.

     

    Does this mean that I am required to file a I-90 and then wait for it to be processed on top of paying a $455.00 fee?

    Is the I-90 actually necessary? Should I expect to be penalized in any way if I choose not to file it? Can I choose to simply notify USCIS by a phone call or something instead?

     

    I've heard about others not filing the I-90 and simply having their name updated during their following interview for the 10-year green card renewal.

    I wouldn't mind having an outdated name on my green card until then if it means avoiding a $455 fee, so long as I don't get penalized for doing so.

    Yeah, not in the state of Missouri. Here we like to have all of our offices permanently closed due to Covid as well as all of our phone numbers directed to the same support line.

  3. Yeah, I'm pretty SOL out of being able to do anything in person at my local social security offices. They've been closed since Covid started last year which is why I had to file for a I-765 to get one as my visa expired during the process. Of course I tried calling them over and over but I kept getting the same person who talks to me annoyingly on speaker phone the entire time and refused to help at all.

     

    More likely we'll have to apply for an extension on our taxes and I'll need to mail out my passport or something to get an ITIN for filing because of how garbage our local social security offices are.

  4. I had my biometrics appointment a few weeks back and I just got my interview notice in the mail today 😃. Progress!!

     

    I'm concerned about when exactly I'll be receiving my SSN in the mail. I had filed my I-765 with my I-485 in June 2020. My spouse and I are going to have to file joint taxes soon and I'm starting to worry that we won't receive it in time. 😕

Psychiatrist, counselor, social worker etc. Or a court order of your gender change- if you are changing your gender (First name as well) it would probably be best to have a court order that way you can just present that document for changing other aspects of your life (drivers license, passport, health insurance, etc; I work in healthcare and to update someones records we need a photo ID of the their new name with their gender; otherwise it will be listed as preferred name in quotes with their birth name and gender gets a bit confusing if there isn't a document stating other than what they were born) US government only recognizes male or female FYI. From what I gather both your passport and green card have to match genders if you are traveling so I would work on getting those changed at the same time. I would suggest doing some research to gather the most correct info.

    Ok so my process would be something like this?

     

    Get SSN

    Get State Drivers License

    ---

    Change name w/ court order process

    Update Drivers License / Notify USCIS of name change

    (If I intend on traveling) Go to Embassy, apply for a new foreign passport with new name supplying court order/updated drivers license as proof

    ---

    Undergo plastic surgery significantly altering appearance and get a letter from my surgeon

    Update Drivers License / Notify USCIS

    (If I intend on traveling) Go to Embassy, apply for a new foreign passport with new photo with a letter from my surgeon as proof

    ---

    Change gender meeting whatever criteria such as therapist letters/gender reassignment surgery for the court order process

    Update Drivers License / Notify USCIS of gender change

    (If I intend on traveling) Go to Embassy, apply for a new foreign passport with new name supplying court order/updated drivers license as proof

    ---

    Then apply for my US passport as the correct gender when I qualify for it.

    I was wondering what will happen if I get plastic surgery and significantly change my appearance while I have a green card or am awaiting an interview for one.

     

    What kind of process is there? Would I just get a letter from my surgeon to reaffirm my identity? How would I go about updating the photo on my green card, and would it be necessary? Would I be required to update my foreign passport photo first as a prerequisite by going to an embassy?

  7. We recently filed our I-485 AOS package and got our I-797C/NOAs in the mail.

    Right now on the USCIS website our case status is just listed as "Case was Received"


    I was wondering if we're in the clear now or if there's a certain time window where we could be declined or RFE'd.

    Is it normal to get I-797C/NOAs if your case gets declined or RFE'd?

    How long should we expect USCIS to take for fully processing our package or update our case status on their website? (speaking prior to the 9 month or longer wait for the interview/biometrics, ofc.)

    Are you 100% sure about this? This was a quote from the stickied thread about immunizations, which says otherwise, and is why I'm concerned about how it was filled out.

    Only thing you need to concern yourself with is how is the form marked in the lower left corner.  Was it marked complete?

    My concern here isn't for K1 purposes, it is to make sure the form was filled out correctly for AoS.

     

    Yeah, in the bottom left corner of the form it was marked as "K Visa applicant voluntarily completed vaccination requirements"

  10. Do I have anything to worry about how my DS-3025 was filled out for the placements of the "A" marks signifying the shots as not being age appropriate?

     

    Hib and hepatitis A share the same mark between both types of shots, Polio has one mark for two types of shots, Meningococcal has one mark for two types of shots, and Pneumoccal has two marks for four types of shots.

     

    It seems really inconsistent, however there were no issues with it at PoE or for obtaining the K1-Visa.

    Fantastic news! Thank you! I'll make sure to bring it with me for the interview anyway just to be safe.

    It's such a relief knowing now that I don't have to go see a civil surgeon to get the I-693 filled out now! 😁

    Oh snap, I thought for sure from the I-485 instructions that I'd have to do another examination.

    I read some of in the instructions for I-693 just now and it does say all you need is the vaccination report for K-1 Visa holders. Nice!

     

    I didn't include the DS-3025 vaccination report with my I-485 package, will this matter or should I be fine just bringing it with me for the interview in place of the I-693?

  13. You should be arranging to have your I-693 done after you marry your fiancé and you're both in the states together since the examination is only valid for 1 year and the Adjustment of Status often takes longer than that.

    To my understanding most applicants don't have a medical examination done until around the time they're scheduling their green card interview because of that.

     

    As for the DS-3025, I received one from the panel physician in my medical examination in Canada when I had to get a medical examination as a prerequisite for a K1-Visa.

  14. In a similar boat, and we mailed off our I-485 package yesterday.

    We don't have any IRS transcripts since my wife wasn't required to file taxes in 2016, 2017, or 2018.

    We do have proof of income for 2019 above the poverty line, but she hasn't filed her taxes yet.


    What we did was I included a copy of her W-2, offer of employment, letter of employment, and recent pay stubs - similarly to what we included in the I-864. I figured that these would be enough evidence to substitute the lack of an IRS transcript or tax return. We'll see what happens- It's impossible to provide something that doesn't exist, so just include what you can. If you include an offer of employment stating your annual salary, a letter of employment, and recent pay stubs for 2020, I would expect it would be taken into consideration. You should also include a page in the additional documents section as well explaining your situation and why you included the additional evidence.
