    Thank you. Unfortunately the closest other office is 2 hours away, is this the only other option?

Hi everyone, so I arrived in the US on my K1 visa almost 3 weeks ago and I am trying to get my SSN, I have called the local social security office and I have been told that in order to get a number I need proof of my authorization to work or a job offer, as their chart shows that k1s are eligible to work. I know I can’t work on a k1 without the EAD but that can take months to get especially with COVID backlogs at uscis. How have others got their SSN? Is it just a case of my local office not knowing what they are doing? Does anybody have any advice? Thanks

    Also FYI - the document they want for verification of a bank account is called "verification of deposits" and is available online from at least some banks.

    This is really helpful, thank you. My fiancé’s income is more than sufficient for just myself as she has no other dependents, but it can’t hurt to have as much supporting documents, just in case they ask.

    Also, if your fiancé didn't send his 2019 tax transcripts or tax return last spring (which he didn't have to then, as it was before 2019 tax forms were due even ignoring the COVID-related extensions), he'll need to send them now.

     

    But if you've got his 2019 tax returns or transcripts and the form version hasn't changed, you're good.

    Thank you, do you know if a letter from the officer of the bank with the past years deposits is required as a supporting document, or will tax returns, letter from employer and pay stubs be sufficient?

    again the reason I asked because so many others got there's in 3 to 5 months DURING COVID 

    I can’t speak for other visas, but K1s were de-prioritised from March. A lot of people have literally had to sue the department of state just to get them to start processing them again.

    Instead of the usual copy and paste response, they now tell me to go to https://china.usembassy-china.org.cn/visas/immigrant-visas/contact-us/immigrant-visa-unit-question/, which I did, it turns out to be a case-specific inquiry and gave me nothing, since my case is still at USCIS. But I was asking for genenral information and not specifically about my case, seems like they're dodging the question.

     

     

     

     

    The London embassy started to schedule interviews for a few plaintiffs yesterday, yet when I contacted them (I’m also a plaintiff) they told me that I would have to wait for routine processing to resume, and that I should check the travel state website, even though the travel state tells me to contact the embassy to schedule an interview.

    I think so. Some embassies have been working on non plaintiffs cases but I think most are only working on plaintiffs at the moment. Other embassies seem to just be ignoring all emails regarding the Milligan v Pompeo result

    EDIT: This wasn't aimed at the two posts talking about how awesome our lawyers are. They're great. You should go with them. It was aimed at the stuff before that.

    besides, I understand that there will be a status hearing on December 3rd. That is the kind of topic (cascading the order to embassies to resume processing) that may be decided/negotiated with the judge then?....

    The lawyers sent out email templates for plaintiffs to contact the embassies/nvc. There is a status hearing December 3rd and I’m sure there will be conversations with the plaintiffs lawyers and government lawyers before then. It will come down to weather or not the government want to litigate this case now that the injunction was partially granted. In regards to them liaising with the DOS to have the decision enforced, there isn’t anything to enforce as the judge didn’t order them to process visas, just told them they can’t use the travel ban excuse.

    I have had 2 interviews cancelled from London embassy. When I emailed them they told me they was aware of the order but can only process spousal/child visas. I don’t expect them to act in good faith and start issuing visas unless they are ordered to by the court. At this moment I don’t see this as a win for anybody. Hopefully things change.

Not to mention the fact that there is only 190 plaintiffs spread out between multiple different embassies, hypothetically if all plaintiffs were interview ready, they could probably process all plaintiffs within a couple of days. It would not cause delays to any non plaintiffs who are close to the front of the que. 

    hoping for someone’s case to be slowed down because of a difference in opinion is horrible.

    If they rule in favor of the law suit, does that mean that the embassies "have to" issue my visa after that because the judge will order them to start doing so again? I'm not too informed about the whole lawsuit, but I've had my interview already (in March) and the only reason that they still haven't issued my visa is because they're saying they can't take action on any K1 case due to the travel ban that Sweden is included in. I'm aware that they'll most likely ask me to redo the medical, but that should be it, right? So even if they take the plaintiffs first, I already had my interview so I wouldn't need to wait for an appointment at the embassy...

    This lawsuit isn’t a class action so it will only affect plaintiffs if the judge rules in favour of the lawsuit. There is the possibility that this could have an affect on other k1 cases, but nobody knows for certain what will happen, and as of right now only plaintiffs will benefit.

I have been driving myself crazy (as I am sure many of you have) trying to find out if I will be able to see my fiancé again this year, so I think at this point it’s best to just wait and see rather than speculating and trying to read between the lines of all the different information we have been given.

    I know I said I would wait and see but I couldn’t help myself😂 this is directly from the London embassy website which clearly states that k1 visas ARE NOT included in the most recent EO. I’m pretty sure this was updated yesterday.
