It is my understanding that a 212 waiver applies to someone with a visa, which is not applicable in your case because he doesn't have one yet, a he has a five year bar. It seems that your attorney made a mistake by simultaneously applying for a 212 and an I-130. Like I said, I am not very familiar with 212 or 601as, but I do know that in most cases applicants need to attend an interview first, be denied, and then apply for a waiver. It seems that the DHS caught on the fact that he applied for both concurrently and out right denied the I-130 since he hadn't have an interview yet. Regardless, you need to provide more information about his case: Why was the F1 denied? Why was he put under "expedited" removal? What Embassy is he going through?

Your timeline is incomplete. What country are you from? Which embassy are you going through? Why are you so interested in visiting the US? Why did you not mention "Cuba" in your application? Is this the only omission/lie in your application? I don't think you're getting that US visa. Time to vacation somewhere else.

If the interview letter asks for a birth certificate, then I would bring it. How far ahead is the interview? Sometimes BC do not take that long, and it is a good document to have. What if she loses her passport and needs proof of citizenship asap? Google Vital records of the State she was born. Sometimes you're able to request it online. For my own interview (I applied on the three year rule) I brought my husband, his birth certificate, his passport, my passports, a physical copy of all the documents I'd submitted with the application, plus new, updated evidence. Officer just asked for my DL and my green cards. But I feel it's better to have what they ask for in the letter and let them handle it however they want it. -
File asap for the 485, i864, i131 and i765 asap. After you file, have him get his vaccinations (if you have insurance, go through their providers so that it costs less). Then, once he has all the vaccines needed, he should go to a USCIS civil surgeon and complete I-693. Wait until you get an RFE for it, then send it. He shouldn't travel outside of the US until he as the AP.

That's why nothing beats good ol'e handwriting to fill out the forms, together with reading instructions and the questions 20x, to make sure one understands the form entirely. -

I'm so sorry you're in this situation, and I wish you all the best with your health issues. As others have suggested, you're not getting a B1/B2. Your only chance is to fight this denial, which I know you will. I also see that you're worried about an NTA and I wanted to say, just do the next right thing. And the next right thing is to either file by yourself (but you said you don't have any more evidence), or hire an attorney ASAP that will file for you. I know Hacking will. He has a YouTube show where you can ask questions for free. Just Google YouTube Hacking Immigration Law and it will show up. Next show is today. -

Be careful with your wording. You are worried about your timeline, but you yourself are saying you will "visit" the US. Looking at your post history, the fact that your name isn't on the lease and you don't have a joint bank account PLUS the domestic violence charge do not guarantee a successful outcome for N400 under the three year rule.
