    Thanks for your reply. Just to clarify, so CBP presumably will have forwarded my packet including the medical from the port of entry to USCIS and I don't need to send in the DS3025 with my AOS? I'm just being very careful so I don't get an RFE.

  2. Hi everyone, I need your help here!

    So a week after I got married, I had most of my AOS completed, however I realised that the hospital in my home country that done my medical couriered off my results to the embassy without giving me a copy of the DS3025 vaccination report. I called and emailed them and eventually they replied that they "don't have a scanned copy" of it and that I'd have to have another medical report done by the doctor. 

    Feeling VERY frustrated as this was my second medical done by them, and funnily enough they have my first medicals vaccination report but not the second one. So now, I have no idea what to do. Do I have to get another exam in the States, and do I have to submit the AOS with my vaccination report?

    I know it's a shot in the dark, but I emailed them back if they could get the doctor to write up a report with my scanned vaccination reports I used for my medical last November. Just left feeling very stressed and unsure what to do here at this point.

    It's wrong how many people are apart of this utter F-up, I'm glad you and others have brought it to the fore front. I've been trying to convince my lawyer for months to do something but I guess it doesn't really work out that way.

    I think they already added plaintiffs but I could be wrong. Fire him an email! 

    There's some bad news though. Dublin is closed for 6 weeks due to the lockdown. This is from someone who had their interview this Friday (cr1).

    Especially since we didn't have the opportunity to pay the MVC fee. I wish there was a way to have that guarantee. Everything about this seems so wrong but I digress.

    They definitely still have your paperwork on their desks, with the notice. I kept hounding them about rescheduling my interview but I kept getting replies about covid, proclamations etc preventing them from interviewing. I know quite a few people in our situation including cr1s and Dublin is currently getting all the backlogged cr1s out of the way first i think. Hopefully soon they move on to us. The embassy is deserted right now though. 

    Perhaps if you email them about this? Might put your mind at ease.

    I am just confused as how you were able to book an appointment for an interview... did the packet they sent you not say to submit your Notification of Readiness until after you  already have documents for your medical and also not to schedule an appointment until they email back to tell you to schedule? If that's the case we would've had our items in a bit sooner and probably wouldn't be in this boat where we are stuck in LIMBO because we didn't pay the application fee... /:

    Well I submitted my notification of readiness in February after I got every single document, incliding medical in hand, sorted. They then got back to me a few days later with my interview date and gave me instructions to pay the fee and schedule courier delivery. Oh and from what I remember you don't schedule the interview, they automatically schedule it after you submit the notification of readiness. 

    From what you have told me, its not because you didn't pay the fee. Its probably because you submitted the notification of readiness so close to when they closed in March, which is why you didn't get an interview date and further instructions to pay the fee. I understand this is all so confusing and frustrating, but from what I'm reading you didn't do anything wrong! We just need to wait for the embassy to get back to us.

    Also, I am not sure if you can help answer this question but prior to your interview, were you told not to pay any fees until you were notified? We haven't paid the MRV fee because we were told to wait and now we're freaking out thinking we'r'e stuck in limbo.

    We submitted our application in August 2019 and got approved November 2019. Our application was scheduled for interview in April 2019. (Delayed due to busy medical centre, could only get our medical booked in Feb) so technically our case has been "ready" since the start of the year. However, when the embassy was closed my case showed up as "no status", then changed to "ready" after they reopened. Have you got your noa2 yet?

    I payed my MRV fee because I got prompted to after I booked my appointment. I really wouldn't sweat it!

  7. Hello, all - something happened yesterday and it got my attention. For reference, I am a K1 beneficiary, and had sent in my notice of readiness to the Dublin Embassy on February 20th and got back an interview scheduled for April 14th, 2020. They shut the Embassy down mid March, and so my CEAC status came up as "no status" ever since... Until yesterday, 23rd of August. I checked, and it came up as "Ready". I will attach a screenshot of this. 

     

    Curiously, another K1 applicant who's only a few days behind me on their visa journey and had their interview scheduled around the same time checked her CEAC status yesterday also and it changed from "no status" to "ready" too. Those that had their application at the NVC still said "at NVC".

     

    Maybe I'm getting my hopes up too much, but should I think anything of this? I wonder could they be starting to reschedule cancelled interviews at Dublin? If any other Irish VisaJourney members could check their CEAC status, that would be a huge help. Maybe its a positive sign!

    I never claimed that this lawsuit would speed things up for everyone filing K1, nor would it slow things down. I was asking you where you are getting these claims/ line of thought from as it can be interpreted as misleading and you haven't presented any hard facts to your points.

     

    I'm only sticking to the fact that those that are filing this lawsuit are:

    1. aware that it is not a class action suit (i.e. not affecting all K1 applications)

    2. doing so to get the ball rolling on their own visa application

    3. are also aware that no lawsuit is ever guaranteed, but the other choice is waiting indefinitely on the government to make a decision on resuming the processing of K1 visas.

     

    As per point one, I would have loved it to be a class action suit but kept getting dead ends on how to finance it, and the time it would take to happen. In the end it proved way too drawn out and expensive, and no lawyer was considering taking it on pro bono. It was actually cheaper to go with this one, and faster. Furthermore, because it is not a class action suit, it should not affect your case, nor anyone else's not involved in the lawsuit. What we do not know is if it is going to set a precedent for them to resume all K visas, but for the time being, no, it absolutely shouldn't affect other visa applications.

    Have you got any evidence to back up these claims? And do have any suggestions for a better way to go about it?

    Except its not even about thinking long term or the big picture with this situation.

     

    Literally nobody seen a pandemic coming and the ensuing travel bans. Obviously there are pros and cons with filing K1 vs IR1/CR1. Nobody would have lumped in Covid-19 with those cons in 2019 because it didn't exist. Obviously now, tragically, we know being a USC's spouse is the better option. We can talk consequences all we want but the reality is we couldn't prepare or consider this when starting our petition back in August, otherwise we would have made a better decision. Unfortunately we're not psychics.

    I got a message on twitter from a lady that’s been hounding the embassy and getting the same generic answer “there’s nothing we can do etc etc”, though something changed this week. Instead of getting that same standard response, they said to keep a daily eye on their website, to check for updates. Still all hearsay, but fingers crossed there is something in this sudden change in advice from them. As an interesting aside, I hear certain Irish embassies around the world will start standard visa processing and consular services from 1st July onwards, so maybe the US might do something similar in Dublin. We’re close to stage 3 on that diplomacy strong doc, well as of June 29th we will be! 
     

    out of interest, what date did you send the email to receive that generic response above?

    That email was sent last Friday. I'm hoping we will get some news in the coming week. It seems like a lot more American embassies are more open with information if you email them than Dublin is. It's frustrating. Hopefully after June 29th we will get an answer. 

     

    Just as an aside, did you have your medical already done in the mater? Mines out of date in August and it looks like I'll need to do it again 😕 But I'm waiting until they give us more information.
