    I'm not sure. The I-751 went to NBC originally as a "we received your case", then it went MIA for about a week, as in "case status unknown", then suddenly it was "new card being produced" and I got it in the mail a few days ago. 

    Receipt number started with MSC.

    Once you complete the interview, you do not need to attend another interview. If you complete the RFE after the interview, it's normal to be approved / scheduled for an oath.

    No requirement to be physically present in the US to send in the I751.  You can either do your plan, prepare the package and have someone else mail it for you, or send it in when you return which would still be within the 90 day window based on your dates.  Just make sure the person mailing the package, if you choose that option, does not mail it even one day early.

    Sounds good! Thanks! I'll leave the packet with my wife's family, who all greatly support me, so no chance of sabotage. 

     

    I'll have them send it 2-3 days after the 90 days starts just to be 100% within that time frame.

    I'll be required soon to file for an I-751 but the date conflicts with some short travel plans I have. 

     

     my 90 days to file starts late November, however I'll be out of country on business purposes until the beginning of January. 

     

    Would it be possible to prepare the I-751 packet completely and have someone bring it to the post office? Or do you have to be physically present in the US when you ship off the packet? My GC doesn't expire until late February, but I'd rather get an early jump on submitting the forms by having them get sent while I'm not here, in case any bumps in the road happen. Or should I just file as soon as I return? That'll leave me with about 45 days to file.

    another question regarding this situation, considering that this Foreign spouse was admitted in 2017, would that make them eligible for N-400 naturalization as well? They’re resided in the US since arriving, albeit as an overstay, but when they file the I-485, could they also file the N-400, or would they need to be a full fledged I-551 holder for 3 years before qualifying?

  6. Hey everyone!

     

    I’m helping out some friends file their Adjustment of Status, and I got some questions and they do as well:

     

    The now foreign spouse entered on a K1, they married within The 90 day period. They entered in 2017, and just now are able to file for the AOS, which I know is well beyond the typical 90 day thing.

     

    first question to top off things:

     

    - do you think this situation requires a lawyer considering the amount of time that has passed between arrival and now? the foreign spouse did NOT engage in any employment and they also did not violate any laws (excluding the failure to file AOS), the US spouse also has a clean record. They also never left the US since and they were lawfully admitted with the K1.
     

     

    - when they file the AOS, I assume all they need to file is the I-485, I-864, , and a renewed medical examination? (If they want to work they can file I-765, and any other optional documents)

    - are there any special handlings regarding this since the AOS is being filed so much later than the arrival?

     

    The foreign spouse is a parent to a US citizen as well, if it makes any difference.

  7. Hello everyone!

     

    Im here collecting some information for good friends of mine who are in a situation.

     

    the situation is as follows:

    the fiancé entered the US via K1, and they got married within 90 days. The now spouse also performed a medical exam and passed.

     

    they have a dual national child together now, and the spouse still has not filed for Adjustment due to career changes and monetary issues. 
     

    they have been in the US for longer than 1 year now without filing AOS.

     

    Here’s some questions they got:

     

    if they leave the country, will the spouse be susceptible to a travel ban to return? 

     

    what steps are needed now to file for AOS? Would they have to file an I-130 now with an AOS, as the K1 is expired?

     

    also what is their current legal status? I assume they are a overstay by law and deportable, but they asked a lawyer and he said that they are “status pending”.

I have no idea if they plan to reschedule folks like you at the Consulate instead (see the comment I pasted below). That may be why they didn't give you details yet; they're trying to juggle hundreds of appointments with limited staff?

    Below the big "alerts" box, it says "USCIS permanently closed its field office in Frankfurt, Germany, on Jan. 31, 2020. The U.S. Consulate in Frankfurt assumed responsibility for certain limited services previously provided by USCIS to individuals residing in Germany (see table below)." And then they have a table with some explanations.

    Most of these people filed DCFs when USCIS field office Frankfurt still accepted/processed the final case load. The cancelled appointments refer to the visa interview for CR1, which means they have approved I-130’s from USCIS already.

  9. If you opted in for social security issuance upon arrival via DS-260, your card would’ve been applied for the day of or the day following your entry. 
     

    it can take up to 3 weeks to receive your SSN card, and considering the viral situation, it can definitely take longer. The SSA site mentions if you don’t receive your number within 3 weeks, you can call them and inquire about it.

    I had a connecting flight. It was 4 hour layover in Detroit (DTW). Spent 3 hours idling at my gate feeling good as a newly admitted resident
