    my husband checked that box too and ended up having to go to the local office and get it mailed to him. We waited about a week to see if it was going to be mailed to us automatically but it wasn't. Took about a week to get it after we went to the office.

    He was very thorough with the ROC explanation and guidelines and says that the chance of it being approved is only at 50% so we must be prepared for it.

    Do you mind telling us what all he said regarding ROC? My husband wasn't verbally approved at the interview so our officer never told us anything about it.

    it took ours about two weeks to update. We got the interview notice two weeks later and it was a month after the interview notice was printed. So it said "ready to schedule" On December 14th, "interview scheduled" on December 26th, and then the interview was for January 30th.

    I couldn't help but notice you skipped over my replies showing where being in the United States is a requirement for adjustment of status. Why would they deport you to another country if you have to get a special document for you to leave the country while your AOS is pending? It logically doesn't make sense.

    you have to have special permission to leave the country while your application is pending. why would they deport you to another country then if your application is pending? 

  6. Considering one of the requirements of applying for adjustment of status is that you are not allowed to leave the country, then you are allowed authorized stay.

     

    "Adjustment of status is the process that you can use to apply for lawful permanent resident status (also known as applying for a Green Card) when you are present in the United States. This means that you may get a Green Card without having to return to your home country to complete visa processing."

    I also applied for one with my EAD and while my EAD did arrive I decided to go to the SSA since I highly doubted that I would get one (we changed address 2 times in the process) and turns out that they had nothing in their system regarding any SSN for me, so I gave the nice lady my EAD and birth certificate (I had more stuff but she didn't need any), she put some stuff in the computer and in a matter of 10 minutes everything went smoothly and she said my SSN would arrive in the mail in about a week. 

    Since you received your Greencard before your EAD I highly recommend just going to the SSA and applying right for one right there.

  8. My husband just received his green card in the mail (K1  AOS). When we applied, we checked the box saying we want to apply for a social security number for him. His EAD/AP card was not approved in time, so we never received it. I know that's when a lot of people get their social security card. When will he get his? Do we need to go over to the social security office or will they automatically send him once since we asked for it when we applied?

    I got an RFE for sending in my joint sponsor's wrong birth certificate. I sent in what was approved for this K1 visa, but it wasn't what they wanted for AOS. And the income needed for AOS is not the same for K1. It's 125% of the poverty line compared to just 100% for the K1. So if you were cutting it close with the K1 visa, there's a chance you don't make enough for AOS

    it's been a week since my interview with no decision. hopefully we get ours soon

    you won't receive a letter until your case status changes to "we scheduled an interview for your Form I-485, Application to Register Permanent Residence or Adjust Status" and then you can expect a letter saying when your interview is and what to bring about a week later. And the interview is generally a month after that letter was sent.

    I was wondering why all these people were worried about filing after the 90 days. Some people wait months to file. You just have to marry within the 90 days. 

  13. We had our interview in Nashville yesterday, so this is how it went. We showed up at 8:50 to our 9:15 appointment and was given a number. They called two couples ahead of us that got there after us, so I started panicking that we missed our number or something. They split one couple up. But our number was finally called and our officer took us back to her office. She had notes written down from his file, so I think she went through everything. We swore in and I actually didn't know what to say so I had to let my husband say something first so I didn't look stupid lol. She confirmed some information in our paperwork and asked him all the yes/no questions. She looked at our birth certificates and marriage certificate but didn't ask for any copies. She then asked us

     

    When we first met

    Describe our relationship progression

    When did we start talking about marriage

    Describe the proposal 

    Describe the wedding 

    Who all we had from our family there 

    What our most cherished moment was from the wedding

    Any trips we've been on since he's moved here

     

    Then she told us to give her any proof of relationship we had. We only had a bunch of photos and our car insurance letter since he doesn't have a SSN and my small town requires that for everything and we live with my mom so everything is in her name (which we explained to her). Then she asked us if we had any questions and I gave her a copy of the IRS transcript for my joint sponsor (because I only sent in the H&R block version since I didn't know you could print it directly from their website). She then said we'd hear the decision in 2-3 weeks but everything looked good from her end. Was in and out in less than an hour. Kinda bummed we didn't get the approval at the interview but we hope to hear something soon.

    He doesn't have SSN. There's not a WF in my area, but I'm considering asking the bank to write a letter saying why he can't be added to my bank account. I pay the rent, so I have copies of checks from that but it's from my bank account that doesn't have his name on it, so I might write up a rental agreement and have the 3 of us and our landlord sign it.

    You should be able to put him as an authorized user on your credit card, have pictures of your wedding and with each others families. You can even get your mom to write a letter about the authenticity of your marriage. Collect mail with his name and your address. 

     

    My interview is in 3 weeks and is only 4 months after we applied. I just plan on explaining if they ask. There have been many others in the same situation of not having a lot because of the states restrictions with needing an EAD for most things, just go with all that you have and you should be fine. 

    I have Discover and I called them and they said he needs a SSN which we weren't able to get at any office here so we're having to wait for the EAD for that. We're currently on our honeymoon (I'm a college student so we have to plan around my breaks) so we'll have plenty of pictures from that and our wedding. Just paranoid we'll get someone super strict who will give us a hard time

    don't think it is a cause of worry.  I think they are sort of separate processes in some way.  I think many people who have interviews scheduled are waiting for EAD.  based on the timelines, I think EAD/AP for September filers is most likely to come late Jan or during February.

     

    I would just focus on the great news of having your interview scheduled, wish we were in that position! 

    Yeah I'm excited for the interview but we need the EAD for almost everything in my small town so I'm worried they'll deny us from lack of proof.
