  1. You can use any USC or LPR living in US but i will be honest It would be wise if your wife returned to the US and found employment that would have the needed income and health care insurance so she can add u. she needs to have US income and proof to US residency. A joint sponsor is not obbligated to support u/ he would be responsible pay back monies to government if u use "means tested government benefits" Just having US wife and joint sponsor does not guarantee a visa
  2. Visa Information for Nationals of Haiti Last Updated: April 15, 2024 The Department of State has suspended visa services in Haiti it covers immigrant and nonimmigrant cases as stated if u google a question to ask about interviews in Haiti the embassy site tells u how to transfer case to another embassy https://travel.state.gov/content/travel/en/News/visas-news/visa-information-for-nationals-of-haiti.html
  3. u make an appointment with social security and update that with form SS-5-ss https://www.ssa.gov/forms/ss-5fs.pdf also register to vote
  4. How to assemble from USCIS site is a good read https://www.uscis.gov/forms/filing-guidance/tips-for-filing-forms-by-mail Do not use binders or folders that we cannot easily disassemble. Do not use heavy-duty staples. Instead, use fasteners or heavy clips to hold together thick or bulky applications or petitions. Two-hole punching the top of the material for easy placement in the file is appreciated. Note: this is only applicable when submitting filings at a USCIS lockbox location. We recommend that you do not use fasteners, hole punch, staple, paper clip, binder clip, or otherwise attach documents to one another when filing directly with a USCIS service center or the Asylum Vetting Center as that may cause delays in scanning the documents into the electronic database systems.
  5. not an issue they want to see real relationship and income to support
  6. CR 1 is scheduled by NVC and embassy so wait till u know when the interview is Reason: the visa is dated and expires 6 months from medical exam and u don't want to do it too early take copy of vacinations to medical and ask dr to complete the needed ones u may be able to find the correct chronopost envelope when u get to France / u can buy the other and ask embassy if it will work for chronopost delivery
  7. He can't work on B2 -not even care for the mother i am so sorry u go thru this Have u looked into the agencies near u that offer assistance Meals on Wheels delivers 1 evening meal a day https://www.mealsonwheelsamerica.org/ The Commodity Supplemental Food Program (CSFP) is a federal program. It provides monthly food boxes to people 60 years and older. Learn if you are eligible and how to apply for CSFP. Senior food box programs are monthly food boxers from local food banks. Other than meals, does she qualify for PT and OT to help her mobility and daily living functions?
  8. My concern is that this new woman not only has not met the OP but has to deal with the complications of an ex and children with disabilities/ it is not fair to put anyone into this slam dunk she needs to know and be able to handle everything / first to meet the USC and be told the whole picture/ online communication is not the same as meeting in person
  9. it will not matter where u interview, being from Pakistan means u will go into long AP after any interview while the embassy does the additional security checks Cyclic notification from NVC evey 2 months? I didn't and never heard of this before / u do need to inform NVC during the 1st year that u want to keep your petition open but NVC does not have to respond
  10. Before starting this new adventure, u need to settle the situation u are in 2 sites tell u what to do in California 1 how to file https://selfhelp.courts.ca.gov/child-custody/filing-options 2 parenting time and child custody https://selfhelp.courts.ca.gov/child-custody It is not fair to the new proposed relationship to bring her into this without taking care of these issues / u can't just throw another person into this Family court doesn't necessarily require a lawyer the judge will look at your attempts to visit you paying child support and in the case of these disabilities, do u carry health care insurance for them the gifts u send for birthdays and Christmas how the kids react to u take care of your initial responsibilites before taking on a new one
  11. u signed the application and should have a copy give them a copy of that
  12. You changed the country from Pakistan to Australia? If u do want to delay the interview as said in last post, keep it in Pakistan as the wait time is probably a year and then the AP time for extended security checks is months and months (can also be another year) giving u the 2 year commitment u need for present obligations
  13. the income for I 864 is 125% and is enforceable buying a house will depend on income, length of time at USC job, down payment, credit history and a lot of other factors immigration does not play a part As per another post the new spouse will not have an US income, credit history and will not be on the mortgage till that is acquired but can be on the deed. BTW it is expensive to go thru the AOS process /you need to look up the cost
  14. its the same for spouse or fiancee its a matter of having US income and filing US tax returns of the USC
  15. you must be a legal resident of the country
  16. Affidavit of Support USCIS (.gov) https://www.uscis.gov › green-card › affidavit-of-supp... Mar 19, 2021 — If your relative is either a K-1 fiancé(e) ... You cannot combine your income with that of a joint sponsor to meet the income requirement.
  17. file for divorce (attorney )ASAP some states u need legal separation and wait time of months or a year for a divorce to be final so, delay is harmful to u both provide her with divorce degree (court /judge stamp) as soon as it is decreed and so she can do her ROC with a divorce waiver
  18. Knowing the airport would help as VJ members have them all JFK and Atlanta let the non citizen go with spouse to USC line and traveling to US with USC spouse, CBP can assume u have intent to adjust and stay
  19. whoever gets the additional documents in their inbox and opens your file will work on it (as in any office )
  20. This is something a state rep might be able to help with (to locate the petition) he/she can not find out the reason for denial but should be able to tell u if it is still in Sengal embassy since USCIS says they do not have it BTW site says Gambia and VJ Members need the correct country /embassy to give best advice/ past post u say Sengal AND NO to filing a new petition/ if u don't know reasons the 1st was denied October 4,2023, u would be unable to correct the CO's understanding of the relationship u do need the NOID or NOIR to address the issues with actual proofs of relationship or to file a new CR1 and address them in that petition state representative will need a signed release from u to do an inquiry
  21. Continuous Residence and Physical Presence Requirements for Naturalization | USCIS need to read continuous residency requirements and the following In addition, applicants are required to show they have resided for at least three months immediately preceding the filing of Form N-400 in the USCIS district or state where the applicant claims to have residency (See 8 CFR §316.2(a)(5) & §319.1(a)(5)).
  22. Credit has to be US credit history for over a year / the 2 year they require is because of commission job salary plus commission or salary or hourly would be different There's a lot of other factors in considering mortgage like amount of down payment loan to value ratio debt to income property type discount points closing costs it helps to know where u and the property stand on all these so just applying is not enough understand the system and ask if u will need to pay extra for 10 years the MPI (mortgage insurance to cover the mortgage is u default on loan -this is different than the regular homeowner's insurance
