    I entered to U.S on March 2nd with K1 visa
    My fiancé and I will get married soon but I have a question.

    I know we need to get married within 90 days of my arrival. But, do we need to apply for the green card within 90 days? 
    There are so many documents for green card and I don’t know if we can apply till May 30.(it’s my 90th days of arrival). We need to gather so many documents till that time. We will do our best to apply before that day but what if we apply on 100 or 120th day of my arrival? Would i be out of status with my k1 visa? Is there any rules about applying for the green card within 90 days of arrival with k1 visa?

    no need to worry seriously i got married on sep 30 2019 filled on january 5 2020 which was i guess after 90 days .. had interview on 31 dec 2021 because of this covid.. just make sure when you file application click on box when it asks is that you overstayed say yes.. officer only asked me is that you overstayed .. i explained i filled after 90 days so it counts overstay and i said yes.. so we had no problem also we have 6 month old kid so officer barely asked 3 questions and approved the case and gave letter of approval right away.. waiting for greencard which is getting produced

We will contact you once the administrative processing is complete."  

     

    but once she got home she check ceac status it says "Refused" 

     

    does this mean its denied and I need to try something else? problem is I have already paid for some planned wedding expense and was planing visit her in India in November. should I put my plans on hold? or Try filing I-130 and get married when I go see her?   

    If u would post a picture of 221g latter then it will be easy to understand your problem.. also the screenshot of CEAC website

    From my experience.. there is a good news for you.. By Monday u will have your passport

    because same happened with me AP on non immigration nd then changed to issued

    The best place to follow is ceac.state.gov and when you see dates change and you no longer can access the information from "immigrant" you move over to "non-immigrant" then you are moving closer. By the time that happens you can safely assume you are in the clear and you will have a visa. Can't tell you any timelines so you just have to follow along with ceac.

    yeah i m following ceac.. date chaned once when they received documents.. they will send me letter for asking passport? or my documents back before it changes to nonimmigrant? or i m gonna receive those after it changes to nonimmigrant?

    sorry for too many questions guys just trying to understand the process..

    It's rare that a person in AP after the interview would get a denial. The embassy does not do an in-depth background check. If you never received a 221(g) while in AP then you can safely say you will get a visa. India is just one of the few embassy's that put people in AP for longer then usual wait times. We have not been able to explain why that is.

    i got 221(g) during interview.... basically just proof of relationship documents were asked by consulate officer on 221(g) which we submitted nd its more than 40 days on AP .. so in our case u can say that there are chances of approval??

    @Aj1320, that I’m not sure but I hope there’s a way you can update ur new address. Also if you hve opted for courier service anyone can sign it for you & receive the pkt or letter. If you haven’t then you will be getting all documents from the embassy at the drop box location which you will be going there to collect. As I said I never received any emails or phone calls from embassy other than a sms from courier company when there was a delivery

    thats what i m asking.. i didn't opted for courier service... nd i know a way to update address ..just question is updating address at this stage will cause any problem? cuz i m on AP after interview.. they asked for few documents before approving which i submitted on dropbox location.. so waiting from 1 month. . so maybe they ask for any further documents or passport if they approve visa so that letter will come to my new address or not?.. or should i call embassy helpline nd ask for the same query before changing the address?

    Everyone is in AP. AP for every embassy can be different. As long as you are in AP and your dates are changing then their is movement on your case toward approval. You need more patience and you will have your visa. This is all NORMAL. 

    had interview at mumbai embassy... had interview by female officer but 2 juniors getting trained under her nd they were learning from my case how to handle case.. seen them taking notes... so that made kind of worried.. was keeping eye on all reviews here felt like getting connected to u all guys for suggestions

    the first AP is the immigration unit doing the paperwork for approving the visa

    the first ready is a notice that they are finished and the paperwork is being sent for visa issuance

    the second AP is the visa issuance people doing their own paperwork

    the second ready is that the visa has been issued and is currently being processed for delivery

     

    Then "issue" is posted and the visa has left the BIG house to YOUR house.

    so u can say that this first AP in our case is fare chances of approval? nd what about case got updated for 3 days straight after submitting documents
