    3. If you wanted to get a green card in the US, you cannot do a “visa interview”, you would have to do adjustment of status. Your priority date would need to be current. At this stage being DQ at NVC becomes totally irrelevant. You would have to file an i485 in the US, pay the fees and...wait, probably a year, quite possibly longer, to get an interview. In the interim you would be unable to work without an EAD or travel internationally without AP; these two have been taking at least 6-8 months lately.

     

    There is almost no instance (now that the bans have lifted) where doing AOS makes sense if you are already DQ’d as it is almost certain to take longer.  And if your priority date isn’t current AOS isn’t even an option.

Hello Guys,  I just want to seek your advise regarding on my question if it’s possible to have a interview for immigrant Visa in the United States instead while waiting for the interview schedule here in the Philippines. I already DQ last October 2020 and I have my tourist visa and i am thinking if it’s possible to do that I will have to pay my visa and maybe the process would be faster?. since we are on lockdown and it may take a while to get that schedule and plus the backlogs. I’m just thinking if it would be the best options. Thank you so much for reading my post.

    OP’s priority date on the other hand is not current and he will not get scheduled an interview until it is. 
    I know we all want to help here, but please be a little careful about telling people things based on your own circumstances to someone who does not have the same situation.

I just want to share my case update sent by NVC.. see below in bold letters.                                  This notice is to inform you that your case for an immigrant visa is documentarily complete at the National Visa Center (NVC) and has been for at least 60 days. The next communication you receive from NVC will be either a notice that your appointment is scheduled, or if an appointment is not scheduled within the next 120 days, we will send a notice confirming that your case is still in line for an interview.                                                                                 Now my Question are; does anyone here who got the same letter and got interviewed within 120 days? And after 120 days? (Please note I got DQ’d Oct 2020 and NVC sent the letter last March 08) Especially now that the US Embassy in the Philippines visa interviews for all other immigrant visa categories remain suspended as of march 2021 Visa Update 😢 Thanks so much.. 

  5. Hi Everyone, I am from the Philippines and last October 2020 all documents have been approved and I am now waiting for the interview schedule from NVC. Is it still applicable that once you got documentarily qualified in the span of 1 year you will be able to get the visa interview since we are now in a covid era. Does anyone here who are still waiting for the visa interview as well and still waiting for more than 3 months. Thank You!

    You need to let us know what the relationship of 4 of you? Siblings or married couple with child?

     

    If she has no idea what to do, she needs a help from an immigration law office. 

    Yea what I meant is I-864 we are siblings and each of US should have our own packet. thanks again

    Part 5. She needs to list 4 of you + her household, that's how they figure how much she needs to make. 

     

    Part 6-5. Retired since.

     

    Using assets for I-864 is not simple, especially you are a large family. If she only has monetary saving, consider finding another joint sponsor.

     

     

    Part 5 since we have our individual form (4 of us) she will need to fill out the AOS form and sign it 4 times. thanks so much

    She cannot skip Part 5. All sponsors must complete it.

    Note that her household size is not necessarily the same as your mother's household size. The household size depends on one's circumstances. Completing Part 5 correctly will determine the household size for that sponsor.

    Note that no person is to be counted more than once. Your mother does not count in her household size (unless she falls under one of the categories in Part 5).

     

    She can list retired as her employment. They'll understand fine.

     

    Only required if you have one. Generally you would kn ow if you had one due to previous immigration involvement.

    How are you doing today, I just want to let you know that we are currently answering our forms DS-260 (almost done) and AOS form. We are currently at the OAS form which kinda confusing. maybe you guys can help me out.

     

    1. my mom is a petitioner and since she cannot support 4 for us, my aunt will be a joint sponsor she will be the one will give all the financial support. She will be using also the I-864 form right? and since she was already retired is she will use her assets to supplement her income so the part 7 she will need to answer?

     

    She will be skipping the part 5 Sponsors Household size Part 6 Sponsors Employment and Income part 20-22 and the part 9-10 for the interpreter and person preparing etc.

     

    2. for Sponsors USCIS online Account number if Any - is this required to answer if yes where to get it?

     

    3. Part 2 information about the principal Immigrant, the other information - this is connected to the principal immigrant? if yes is it not applicable to answer Alien Registration Number,  USCIS online Account number? Daytime Telephone number - is this the mobile number of the principal immigrant?

    Yes because she was the petitioner and the nvc already provided a new case number and Invoice ID number for us. And that’s how you going to start your process ie pay the visa for the applicant and the petitioner once paid next is the DS-260 and the affidavit of support

    Thanks. My mom already received the physical approved petition letter from nvc today but since it’s pandemic most of the government offices are still closed here in manila we cant get the required document tho. Thanks a lot

    As far as I know, NVC sends Welcome letters based on the Dates for Filing chart. For May the priority date will be February 1, 2011. I don't know if they are sending WL during this emergency, but if so, you should receive a WL soon.

    You have not received a WL yet because for April, the priority date was reached for a date earlier than October 1, 2010.

    Is the NVC send out a welcome letter via email or post mail? Our PD also showed up for VB may 2020.
