    That said, you need to keep in mind that statement you made above. You are Canadian - different country, different government - we are not the U.S. and they are not us - I can't think of any reason why Canadians should be given any special treatment.

    That's not for you, as canadian_wife already mentioned in her first post. You cannot do that now, it is not an option for you.
    Minted, the people who are replying to you here, me, Pushbrk, canadian_wife, we have already been through he immigration process. You don't think that we would tell you to apply for a CR1 visa if there was any way you would be allowed to simply have your Husband come to the U.S. and adjust status?
    Anyway, you obviously want to look at all the immigration sites, perfectly understandable, most people do when they first start to investigate U.S. immigration - it's not a bad thing - however, I really don't want to have to discount everything you read on other sites, that you don't understand, because you clearly haven't read the guides here.
    It also concerns me that you haven't really read the replies in this thread either - not for me, but for you, it's no wonder you are feeling overwhelmed.
    So I do wish you good luck and if you do read the guides and have questions, I would be happy to help you at that point.

    Yes you can visit him in Canada while it is processing, keep in mind that you have to sponsor him though - so you will need to have income of 125% of the poverty guidelines and be able to prove that (or have a cosponsor who can).
    The K3 is all but obsolete.
    You don't mention what your status in Canada was, did you file for Canadian permanent residency?
    I'm going to leave it at that for now. You are getting confused because you haven't read the guides yet - you are focusing on how you can be together now instead of what is involved in the immigration process. Think of it as being akin to planning your time off from work - but you haven't had the interview for the job yet.
    Read the CR1 and DCF guides and see which might work for you. Once you understand the process - THEN start figuring out how you can spend the maximum amount of time together during that process.
    Come back and ask questions you will have

    I agree with Darnell - they need to reapply and need to beef up their proof.
    Do they rent or own their property in Canada? If they own, bring mortgage documents, if they rent, bring a copy of the rental agreement. Do they have memberships to anything - like a Gym etc? Do any of them take classes? If so, bring proof of enrollment. Driver's license, health care card, proof that they have more than enough money for the 3 of them to support themselves while there.
    Did the letter from the employer state when the Gentleman was expected back at work?
    Try thinking outside the box a little bit. Also, you never mentioned if the other 2 people involved brought any proof of ties.

    Short of wearing something offensive - I think it makes absolutely zero difference. They have already made their decision (98%) before you appear.
    Now if you have some great information to add at the interview, that can make a difference - but even then, they already know what they are going to ask of you and ask you before you get there.
    I doubt what jeans you wear are on the list

    Well you can file both the I-130 and I-129F - however, if they are both approved at the same time the I-129F is tossed aside in favour of the I-130 (for CR1/IR1).
    So really it's up to you, you can go ahead and try for the K3 if you want to - won't harm anything, just be prepared to be doing the CR1/IR1.
    Important Notice: Effective February 1st, 2010, when both the I-129F petition for a nonimmigrant K visa and the I-130 petition for an IR-1 (or CR-1) spouse of a U.S. citizen visa have been approved by USCIS and sent to the National Visa Center (NVC), the availability as well as the need for a nonimmigrant K-3 visa ends. If the NVC receives both petitions:
    The nonimmigrant K visa will be administratively closed.
    The application process explained below will not be applicable and cannot be used.
    The NVC will contact the petitioner and you with instructions for processing your IR-1 (or CR-1) immigrant visa.
    For more information on the immigrant visa process review the Immigrant Visa for a Spouse webpage.
    If the NVC does not receive your I-130 petition and I-129F at the same time, the NVC will process your I-129F petition.

    Hi and welcome,
    As Huggles mentioned, it's a good idea to read the guide first.
    You need to start with forms I-130 and G-325A, which you will read about. These you will send to USCIS to start the CR1 process. You might want to download the forms and have them all filled out to send in now or when your Husband gets back to the U.S.
    You cannot apply at the consulate in Calgary, to do that both parties must live in Canada. You will ultimately interview in Montreal.
    The interview is basically so that they can look at you, ask you a few questions - nothing too awful, just an awfully long trip to Montreal
    You will also need to have a medical, done by a panel physician in Canada. There are 4, one in Vancouver, 1 in Montreal and 2 in Toronto.
    Anyway, once you have read the guides you will have questions and we are here to help!

    98% of the time, where domicile is involved, he is the guy that does the interview. In more than one case he has mentioned to the interviewee that he had to be apart from his wife for some time as she was also an immigrant.
    One would think that this would have made him more compassionate, based on people's stories I have heard, it appears to have just made him bitter - now all of you are paying for that bitterness.
    Some of the people who work at the Mtl consulate, at least the 'top' guy, read some of these threads, or at least have. I had hoped that in reading some of these stories there might have been some action - that domicile had been reviewed, that people could have clearer instruction etc etc - obviously that is not the case and is not going to be. When people are at the interview and are asked for more proof, they are not given a clear picture of what they need to submit. Why is that? Is there a U.S. immigration law that states that a CO cannot tell an applicant what documents they need to submit to prove their intent?
    I cannot understand why the U.S. consulate in Montreal wishes to put people through extended waits for no particular reason. Even if we look at the case of Jonesg111's wife - proving domicile - it took them 9 months and the intervention of a senator to get approved.
    While I completely understand that there are rules to be followed, when there is clear intent to reestablish domicile (even if the person gave inadequate proof or stated incorrect intent during the interview) why can they just not be approved.
    It's been several months since a few of us wrote to Montreal regarding clear guidelines for proving reestablishing - I never received a reply to my letter and i'm sure no one else did either.
    So if anyone is under the false impression that Montreal does actually care - you can put that aside right now. That is the reason why, when I see the Thank You Montreal!! threads, I just shake my head.
    Normally I would probably just close the window here and not post this, because what is the point really - but i'm not going to this time.

    I appreciate that response Kathryn,
    Honestly, I don't know why people write - well you can just immigrate to Canada - as Kathryn mentioned, it is a separate country with its own immigration laws and procedures - they will not allow you to immigrate simply because U.S. immigration has denied you
    Also OP, there are many, Canadians at least, who move to Mexico, while the community where you wife lives may not be to your liking, perhaps you can look at other areas where you two will be more comfortable. Good luck.
