Hi, sorry to come into this but I was just wondering how you eventually resolved this issue? I’m in the same situation, I only put my maiden name on my adjustment of status paperwork as well as paperwork for the employment authorisation etc. I have my biometrics appt Tuesday so wondering whether to now put my new name on that paperwork or if there’s anyway to notify them or if I’m stuck now?

    Any help would be appreciated!

Hey, sorry, just saw the notification today.

I am actually just about to add my husband's last name as an additional name because my aos interview was waived and I've had my GC since April. So I will have to phase the maiden name out...  😅

For now there's nothing you can do. There is nowhere to change name at biometrics appt. Wait until your interview and ask to change it then. Otherwise, there's a name change application you can send but it's a waste of money imo... good luck!

Hey, quick question. Does anyone know if you can reschedule the biometrics appointment? I haven’t gotten the letter yet but I am fearing that the appointment is gonna be super soon and during a time that is not very convenient for us. We just recently bought a house and are moving within the month. Also, the worst part is, we live 600 miles away from the field office, so flying last minute is ridiculously expensive for a 5 Minute appointment and driving there is going to take us at least 10 hours so I would like to be able to make some changes in case the scheduled appointment is not a good day for us.

It's not a problem, call uscis, you will be transferred to a tier 2 officer and they will send you a new letter.

If there was more time before the interview, I'd say send a letter. But since that likely won't even be looked at by the time of the interview, my suggestion is to raise the item at the interview and ask if the IO can change the name there.

They wouldn't. I meant that if you don't tell them, they will definitely issue it in the existing name.

USCIS won't care, although the SSA may refuse to do so w/o USCIS doing so first.

Thanks. I'll contact SSA tomorrow and see what they say...

I'd suggest notifying them of the name change as soon as you can. Otherwise they will issue the green card in the name as written on the I-485. Changing it later takes months and a hefty ($455) fee for the I-90.

Note that there is a difference in process between a visa interview abroad and an AOS interview.

How would I notify them before the interview? And why would they issue it before my interview?

Your marriage certificate is the legal name change document. You're able to use your married name already of you want too.

I am using it for several things and I want to legally change with social security but I don't know if uscis will have an issue because of the different name.

  5. Hi all, since I was here before on a work visa and had a SSN prior to marriage we sent in aos packet with my maiden name without thinking about that aspect (regretfully). My interview has been scheduled (probably some time in April, waiting for letter) and I want to ask for my green card to be with my married name... can/should I change my name with SS before the interview? Or do I do that after uscis says it's ok?

Any help would be appreciated. Thanks!

You just got the update today? And not yet, still waiting for my letter I am hoping it should arrive either from today until monday... and I estimate it should be scheduled around middle of April

Yes, woke up and had a feeling I should check! I just got the ready to be scheduled yesterday like you... Also hoping for a date in April. Hope the letter gets there soon!

Hi, so my Adjustment of Status package (I-485, I-765, I-131) was delivered to the Chicago Lockbox via USPS 3 weeks ago, on 01/30/2020. I know this, as I tracked the package.

Since then, I haven't received any electronic or physical correspondence, and the check has not been cashed.

Has anybody else experienced a similar wait for the first NOA/ any form of receipt recently? It seems like most people receive a text/ email, and/ or the check is cashed, within 1 - 2 weeks 🤔 . I included G-1145 forms for each application.

    Thanks.

Took ours 32 days ... while others who filed wayyy after me received responses within days. Hope it comes soon!

Hello all.  I hope you can help my friend out.

She is currently employed and here on an H-1B working visa (in NY state).  She would like to get her license in this state to drive.

The local DMV told her she couldn't because she's not a permanent resident.  She's been here legally for over a year and her green card is forthcoming very soon.  I  believe they are wrong and she has a right to get a driver license here.  She's a professional Physical Therapist and would then be able to travel for her work.  Now, she needs to be taken or use taxis, which are almost non existent where she lives.  It seems I've read something about this and that an H-1B visa holder can legally apply for a driver permit and then license while here legally on an H-1B visa.  The locals said NO.  Again, I think they're wrong.  They were wrong on several other immigration issues before too.  One day I had to go down and straighten them out on this when my own wife applied for a permit.  They seemed a bit testy about it too, like they resented someone "not from here" wanting a license in this state.  Typical small town attitude, right?

Is the DMV correct on this?  Everything I've read up to now says she can indeed get a permit and then her license.  I'm hoping someone from NY state can help me and her out.

Once again, she's been here for over a year (with extensions) and has been processed for her 2 year green card (Bios, etc. )  - all nice and neat and pretty.

Thanks for any help on this and I've suggested she join this super duper web site because there's none better than Visa Journey.  Thanks for being here for us!!

    Doug

I got my license in NY and I was there on a work visa. I did have a SSN though so not sure if that's needed there but definitely don't need to be a PR.

Hi, is there a difference between I-797 and I-797C? We only received the I-797C from my K1 visa petition. Just wondering since the instructions for AOS app asks for the I-797 which we didn't receive. Can I submit the I-797C for my AOS?

You should have the approval form I-797 as well. I would contact uscis if you haven't received a paper approval.

You can see all 797 types in this link: https://www.uscis.gov/forms/forms-information/form-i-797-types-and-functions
