  1. Hi everyone,

     

    My husband and I have our interview tomorrow to adjust his status from K1 to green card holder. We filed in Sept 2019 so did not have to submit the I-944 public charge form. I’ve seen some couples get RFEs for this form at their interview even though they filed I-485 prior to the rule requiring I-944. Does anyone have government documentation showing when this rule originally took effect? I can’t find it online and would like to print it from a government website and bring it as proof it is NOT required for us.

  2. Hi everyone,

     

    We filed for AOS from K1 in late August 2019. We had an RFE for my financial records and everything was changed to “ready to be scheduled for interview” in May. We never had an interview scheduled but just got an update that our interview was canceled. Have other couples had this lead to a green card without an interview? Or is this more likely that they sent this “cancelation” update and we’ll have to keep waiting and hopefully get an interview scheduled in the near future...? We’re in NYC so the wait times are over a year here.

    I see in the timeline in Baltimore they have really such a long wait, last time I didnt see any that has interview scheduled after my timeline, but you're right, probably need to call them. Where should I call them? The baltimore uscis or central uscis?

    We had an RFE asking for my proof of income. I didn’t realize I had to send that as the USC. I submitted it with our K1 packet but left it out of AOS.

    I call the number for USCIS (+1-800-375-5283) and follow the prompts entering our case number then there’s a number you can press for “an issue with your case” after you enter the case number and that takes you to an actual person. You can search this forum, those exact directions are listed elsewhere. Then once you talk with someone you can ask if they have details on your case, if not ask for a tier 2 officer and they’ll usually have one call you the same day.

  4. @ShahnazSyahr my husband and I are in a similar situation. We filed Sept 2019 and did biometrics in early October. Based on other timelines I do think it’s a long time to wait without update, even despite COVID. We live in NYC and have long wait times too but saw a lot of people (pre-COVID) with interviews scheduled who filed after us. We ended up having an RFE that we took care of in March. It can’t hurt to call a tier 2 officer to just check.

    Yes, they received our RFE two months ago and updated our AOS status this week to “ready to be scheduled for interview.” We’re in NYC where the wait times for AOS interview are 1.5 years so I didn’t think much of it. Could that have been it?

    We haven’t moved. The tracking for both the EAD and AP say “fingerprints completed” but have said that since October.

    My husband came on a K-1, we were married in August 2019 and submitted his AOS application along with work/AP combo card. It was received 9/2/19 and his fingerprints have been updated since early October. We’ve still heard nothing about his combo card. We submitted an inquiry because we’re outside the window... is there anything else we can do to speed this up? The USCIS phone agents are unhelpful.

     

    It’s bad enough he can’t work for almost a year and we’re in the middle of a pandemic but we’re also supposed to go to Croatia Sept to have our church ceremony. Without the AP he can’t leave the country, even if everything turns out to be safe.

     

    Any constructive advice our community can offer would be appreciated.

    We are mid-September filers and just trying to get a sense of things.  Some September filers do have theirs already but I am more interested in the prior months to see how many still waiting...

    Your spouse without a green card is a Nonresident alien (NRA) to the IRS. A NRA isn’t allowed to file jointly.  But if married to a US citizen you can choose for him to be treated as a Resident alien for tax purposes. To choose, you have write and sign a statement and attach to the Form 1040. The only way to include a signed statement like that is by mail. 
     

    Also when you file jointly, both incomes earned in the year 2019 have to be reported...even money the immigrant earned in his home country. There is a tax form (Form 2555)  that can excluded the foreign earned income from being taxed...so reported to the IRS,  but not taxed.  However, to be allowed to exclude the foreign income, the foreign country has to have a tax treaty with the US. 

     

    CROATIA does not have a tax treaty, so his foreign income would be fully taxed. He would not be eligible for the exclusion. There is a form 1116 where he might get credit for income tax he paid to Croatia since he’s not eligible to exclude his income from a joint return, but whew I don’t begin to understand that form.  In your case it may be better to file Married Filing Separately and he files nothing because he didn’t earn any US income in 2019. It’s only on a joint return that worldwide income from both spouses has to be reported.

    Yes, us too. Our review has been complete as of 10/4/19 which is after you though. I'm tempted to call just to make sure we're not behind... my husband and I are in Manhattan where the wait times for an interview are 18 months so I don't want our application sitting idle for any part.

    The GC Interview is managed by the local offices. i.e. Manhattan in your case. However, the EAD and AP cards are still managed by NBC. So, I hope you'll hear soon about your EAD and AP. Also, you might have to apply for a renewal too as the GC interview timelines are crazy!

  12. Hi everyone, do we know if the EAD and travel auth come from the same local office where we are waiting for an AOS interview? We're in Manhattan where the interview wait time is over a year and I hope that if they're backlogged with those plus the combo cards we at least don't have to wait Manhattan-level times for the EAD... Or if all of the combo cards come from the same place nationally we should be getting ours soon.

    I'm wondering the same. We didn't get the text but got the letter on 9/12 that said our actual NOA date was 9/5. We still haven't gotten a letter with an appointment date for our biometrics.

     

    Does anyone also know if this biometrics appointment date/time is located anywhere other than the mailed letter we're waiting on?

    For those who have not received any text or letter of confirmation yet, I heard it takes 1-3 weeks to process. If your case took longer, it’s worth calling them or chat with Emma on their website..

    I never got the text messages and just received our NOAs in the mail. Hopefully yours is on the way... The Chicago lockbox received our package 9/3, deposited the check 9/5, then we got our letters 9/12. 

  16. We just mailed our I-485 and are under the I-129F category. According to the website we were supposed to mail it to the Chicago lockbox (which we did) but I keep seeing people with similar applications assigned to a service center like the Potomac one above. Will we be assigned to a service center once they start processing our application? Or our local office? Sorry this is a bit unrelated but I'm wondering which processing times to expect as well.

  17. My fiancé is flying in Wednesday and has his big envelope ready for his entrance. He gave the doctor a copy of his vaccination card with his records and we noticed some but not all of his vaccines were transcribed onto the medical approval form given to him by the doctor. Does anyone know if that copy of his vaccination records will be in the envelope if we need it for the future? Or does he need to go to his own doctor's office and get another copy?
