  1. We just received mail yesterday from USCIS for our biometrics appointment. It stated the appointment was April 29rd and if it was missed the application would be rejected. Apparently it went to our old address even though the address was updated on USCIS. The label forwarding it to our new address from USPS has a date of May 5th. Since we have this as evidence that it wasn’t delivered prior to the appointment will USCIS reschedule it? We have contacted our local congressman and are waiting to hear back. Has anyone else ever have the same experience and what happened?

  2. We filed the I-751 but did not include an I-90 and are in the process of filing it now. On my wife’s permanent resident card they put the wrong birth year even though we pointed out that the birth year was wrong in the NOA for adjustment of status at the interview for adjustment of status they still put that date on the permanent resident card. In the I-751 there is a variety of documents showing actual birth date such as mortgage documents, visa/passport with birth date listed. Will the I-751 still be processed as normal if there is enough evidence to show they messed up and put the wrong birth year on the card?

We sent out the I-751 today and I just realized I may have made a mistake and copied the k-1 visa page from my wife’s passport and not the biographic page from the Philippines even though it is listed as the biographic page on the cover letter. Is this a serious mistake or will they just RFE? We included photos of the front and back of my wife’s permanent resident card with the application.

     In an i751 case the green card holder is the petitioner and the beneficiary, the US based spouse is only the spouse and should only sign the spouse section of the i751 if it is a joint case.

    The place of marriage is just a blank space and instructions don’t say anything. Should we put the name of the church or the city and the state?

    For the I-751 form for place of marriage should we put the city and state?

     

    The second question is if the spouse of the petitioner completes the form does the petitioner check the box that says I have requested the services of and consented to   (spouses name) prepare this petition for me on page 6 than the spouse fills out the preparer section as well?

    Well, you made my doubt ! I could swear I read of cases in VJ that sent it right before the deadline and somebody said that as long as it was postmarked prior to the expiration date it was fine. Now, I am not so sure! 

    Anyways, OP: why are you wanting to send it so late?

    We are finishing the i-751 and will have it sent 11 days prior to the expiration of the green card and we are going to have it sent overnight shipping so it arrives the following day. Is this enough time?

  7. We are getting ready to send our I-751 and have compiled the following evidence and would like to know if it is enough. We have two years worth of checking and savings account showing purchases from both our debit cards, 2 sworn affidavits, two years of jointly filed tax returns, two years of leases, paperwork applying for mortgage and putting an offer for a house that was accepted with both of our names, our sons birth certificate, insurance with both our names listed for dental, vision, prescription and health. Photos from our vacation to New York. Spouse listed as emergency contact for work and beneficiary for life insurance and retirement.

  8. We have two questions concerning the I-751. Does USCIS have to have received the application by the green card expiration date or does the application just have to be sent by then? We don’t have much transactions on bank statements showing commingling of finances (it is a joint account) will this be an issue if we have other evidence including joint leases, tax returns, mortgage, joint credit cards beneficiary for retirement and life insurance policy, and our 18 month old son?

    We had ours today, and it went the exact same way.. two weeks for the letter in the mail saying if approved or not, she mentioned if anything else is needed, Id get a RFE letter in the mail.. but it sounded v positive. Holding thumbs! 

    Our case updated online the same day we had the interview saying the card was being created and the following day it said it was approved.

    We didn’t submit anything from the insurance company but we did give them a copy of the checking account statement for the month which shows the payment for the health insurance. The USCIS officer never asked for any health insurance information even when we told her we were expecting. She asked my wife the same questions from her I-485 and checked off that the answers were the same as on the application. She asked us to put all evidence we wanted to submit to support the application on the table such as leases tax returns etc... The only other questions were how we met, where I proposed, my wife’s port of entry and where I work.
