Depends if it is active or passive
For example nothing wrong with buying and cars but at some point you become a Dealer.
Begs the question why you chose the K1
I think as long as you don't leverage trade and use lenders money you should be fine?
Also yeah, I am no day trader. I don't make swing trades. My purchases are passive, and so are the dividends I get paid.

And coincidentally, I received a non-residency approval today in the mail, dated 11 Jan, based on acceptable nr73 application. So this process is now complete. It appears from start to finish, just shy of a month to complete. Lightning fast.
Great news and thanks for keeping everyone updated!

Original post explains need for NR73. Tl;dr: do nr73 if you have a locked in investment (LIRA) or pension fund if you want to unlock itand take funds; otherwise it seems no need for nr73
mhm gotcha, i've got an RRSP and that's it
-
Is NR73 necessary? I just sent a mail(In October) to the CRA stating that I left the country and am doing so permanently so I won't be filing Canadian taxes anymore. They updated my address and contact information on their portal. Haven't heard anything back since then.

Are you in MI?
Nope, NYC.

Ha sorry...
Didn't read the fine lines

Must meet all the requirements. https://www.uscis.gov/policy-manual/volume-12-part-g-chapter-3
The spouse must establish that he or she meets the following criteria in order to qualify:
-
Age 18 or older at the time of filing.
-
LPR at the time of filing the naturalization application.
-
Continue to be the spouse of the U.S. citizen up until the time the applicant takes the Oath of Allegiance.
-
Living in marital union with the citizen spouse for at least 3 years preceding the time of filing the naturalization application (the citizen spouse must have been a U.S. citizen for those 3 years).
-
Continuous residence in the United States as an LPR for at least 3 years immediately preceding the date of filing the application and up to the time of naturalization.
-
Physically present in the United States for at least 18 months (548 days) out of the 3 years immediately preceding the date of filing the application.
-
Living within the state or USCIS district with jurisdiction over the applicant’s place of residence for at least 3 months prior to the date of filing.
-
Demonstrate an understanding of the English language, including an ability to read, write, and speak words in ordinary usage.
-
Demonstrate a knowledge and understanding of the fundamentals of the history and principles and form of government of the United States (civics).
-
Demonstrate good moral character for at least 3 years prior to filing the application until the time of naturalization.
-
Attachment to the principles of the U.S. Constitution and well-disposed to the good order and happiness of the United States during all relevant periods under the law.
So going by that it sounds like you can file after living in the US for 3 years & being married for 3 years, don't actually have to be a LPR for 3 years, correct? (Wife is a citizen by birth)

Same boat as me. I've had two AOS interviews cancelled and about to go to my third one, which may be cancelled next week as well due to upcoming snow storm lol. If they cancel this third one I am moving to a different state so will likely have to wait many more months which will push me over the 2 year line -- but not much I can do about that.
By the way to file for US citizenship do you do that after 3 years of having LPR or 3 years of marriage?

The law is very clear; USCIS should* issue 10-year GC in that case: https://www.uscis.gov/policy-manual/volume-12-part-d-chapter-2
*If wrong card is issued, then file Form I-90 for free. Select reason D "My existing card has incorrect data because of DHS error."
Awesome, thanks for that information. 👍

Only if I-485 is approved on or after your 2-year marriage anniversary. See INA 216.
Hmm so I'm moving out of NYC when my house is built. Which will move my Field Office, so I'll probably likely have my next "interview" past the 2 year mark. Which in theory should give me the 10 year GC instead of 2 year GC.
-
Heya VisaJourney friends,
First had my I-485 AOS interview cancelled in April due to COVID19, now my interview got cancelled again today - Not sure why it was cancelled I am thinking it's the snow storm but the thing is the snow won't even start to come down for 6+ hours after the interview would have finished. Was supposed to have the interview tomorrow. I know that after the Interview I'd be getting my 2-year Conditional Green Card. What I'm wondering is in June I'll be having my 2 year marriage anniversary with my wife. Will I be eligible to get the 10 year green card instead of doing this 2 year green card instead? Would be better so I don't have to keep "re-preparing" my papers/files for every interview.

The Montreal clinic charges you in Canadian funds and I doubt any of the clinics on the list charge USD. They are not American clinics but Canadian clinics approved to conduct immigration medicals. But it’s a private clinic so yes it’s more expensive. 35$ for flu vaccine
Hmm I remember paying USD for mine 2 years ago at Montreal.

I never had the original of the DS3025, I had a copy that was given to me at the medical place. And I sent the copy of the copy I have with the I-485 package.
Yeah but surely you made a photocopy of it while you had it ?

There's no such thing as send within 90 days for the DS3025 to be valid.
The AOS package has to be sent within 1 year of the date of the medical for the whole medical to remain valid. DS3025 is just one form of the medical.
Ah I must be thinking of the I-94... But you should be able to still use DS-3025 if that's what you sent in the original petition within the 1 year time frame for your interview.
-
Just use your DS 3025. I have my interview in 3 days - I am going to be using it. You just need to have sent with your original I-485 package within 90 days of entering the US the DS-3025 to be valid, there is no "expiration" for it I believe.

Heya, I've been living in the US for nearly 2 years now and am planning to buy a home soon. Planning on buying it with cash so I want to move my CAD to USD. I was reading about norbert gambit and remembered your post. Do you reckon Norbert Gambit is still the best option for me since I reside in the US but still have CAD? I did file FBAR & whatever else my account had me do last year. I think questtrade doesn't accept non-residents which is a pain so I'd have to use something else...? Also the superficial loss rule wouldn't apply to me since I don't reside in Canada would it?

Coming from Canada I think USA is better then Canada in almost every way except one. Health care. and then even then the us system is better in some ways then Canada's
oh and that we call it kraft dinner not macaroni and cheese is maybe the only thing we do different. There maybe some other differences but they are not enough to bring up or cry about.

Thinking real hard about just telling my field office I'm moving and to move it it to the new field office. -_-" stressful
-
No luck here. Sucks because I'm moving states in 2 months. Was suppose to have it over with in April as well. Now I'm afraid I'll have to come back to current state... 😕 Hope they will move my interview to the new state. x.X
-
I'm the same case w/ my conditional green card interview. Hope it won't take 3-4 months to get an appointment like last time, then appointment takes place 3 months later. 7 months extra in total would suck.

You have to file within the timeframe of one year after the medical for it to be valid. Doesn't matter when your interview is.
gotcha, thanks. all clear then

Will medical exams need to be re-taken due to Corona and being in the country for over 1 year after entering as a K1 -> Conditional GC?

Definitely depends on your state. I moved to FL and had no test to take except vision test. Also my friend moved to NYC who had no testings either.
