    Hi,

     

    Did you use your lawyer address to receive uscis mail?

     

    I also filed I360 in November 2018, I just picked up my PF extension last week at lawyer office. 

     

    Issued date  was 10 days before expired.

    Your status is still active until you stop attend. Some lawyer i have seen suggested that keep your F1 until your I485 decision  incase your I485 denied and you get NTA and you get no options  then you could excuse yourself to stay in USA for your education. Some lawyer said it doesn't matter.

    I am a student with F1 visa but I can’t afford my tuition any more. I submitted I360 on May 2018. I got my C09 ead card this year Sept base on the pending 485, but I am hesitated to use it. I was told if I use the C09 ead, I will immediately lose my F1 status, which means I will need to out of US immediately if  my i360 be denied.

     

    I really want to work and drop my school, but I am afraid lost my F1 status will make me no choice if my I 360 be denied. Could anyone give me some suggestions? Thanks a lot for all

     

    My experience, I kept my F1 status valid until I485 denied due to I130 withdrew. My case was pending almost 3 years I never use EAD. I still received NTA 45 days after I485 denied.

If you have plans of working..which you should, simply file a new i485 and i765 C9 category and maybe i131 if you have travel plans..then you should get it in a matter of months..surely before your VAWA is decided!

     

    Do I have to pay fees for new filing of I485 and I765 or I can just file I765 and I485 later on or I can use waiver for those fees?

    You better find out if the officer put you in removal proceedings or not, depend on officer. 
    Not everyone ok... 
     

    I did not mean to make you worry. It’s complicated when i485 denied more than 30days. 

    you better send out i360 then wait.

    I’m Nov 2018 filers. My lawyer submitted only I360 coz I’m in removal proceeding but my case not even file with immigration court. I received NTA with no date set in March 2018. I wait patiently for miracle i360 approval so my lawyer could start to do something with removal proceedings.

    One last question, Did you get work permit from filing a relief in court or from USCIS after your case approved? 

     

    My lawyer told me that I can only get work permit after filing a relief in court.

    Quick recap of my case. Can you please advise?

     

    I have been in removal proceedings since 2015, I have gotten my I-360 back in October. I had my last master hearing here in Dallas back in February when my attorney asked the judge that we are ready to file I-485 with the court since my vawa  I-360 was approved  the judge said ok.

     

    Judge asked me a couple of questions like:

     

    ·         Have you leave enter the United States illegally?

     

             I have not

     

    ·         What was your port of entry that you were admitted?

     

    I said Atlanta

     

    ·         And then he asked why did you stay?

     

    I replied I don’t know

     

     

    Also the judge asked my attorney that if there crime that barred me from relief, she said NO. He have had a DWI back in 2014 and he already paid the price to society (case closed back in 2016)

     

    Based on that my hearing of merits is going to be next year in August. I don’t know what to expect…. have anyone in this forum AOS in front of a judge?

     

     

    My questions are?

     

     

     

    Can he denied my I-485 I understand he has jurisdiction on that? If the answer is yes any reason that you guys know?

     

     

    can be ask me questions about my vawa approved (my case) in details..... im scared if I said something wrong he can revoke my approved I-360

    I’m in similar situations. But I don’t have master hearing  yet. Not even the court system. May I ask...

     

    Did you apply for any relief in order to get a work permit on that day? 

     

    I wondered you have to wait for your next merit hearing 1.5years. Will you be able to get a work permit during this time?

    Vawa cancellation should be your second choice if I360 denied. Why wouldn’t you ask to put your case docket on hold until your I360 approve?  So you could adjust status in front of the judge.

    Unless you believe you have a very strong case of battery or extreme cruelty by your USC spouse, I would suggest that you focus on the I-360 because the Vermont Service Center is much more sympathetic and the standard of proof is much lower, requiring only "any credible evidence". If it is approved, you can then file an I-485 with the IJ. The VAWA cancellation is much harder to obtain because you need to show extreme hardship, among other things.

    @Jawithlove May I ask, you are in removal proceeding, and you already knew before you file I485.that Only EOIR has jurisdiction over your case not uscis. What your lawyer suggest you what to do next? File motion to terminate to close your case in court? or put court docket on hold?

    I don’t know much about FOIA that’s why I don’t want to give you wrong information. But you can request your immigration record to find out.. Some Lawyer charge $500-$800 just for that.

    When USCIS denied my I-485 based on I-130 I could never receive such a letter, supposedly the postal service said it could not deliver it to me, but by calling USCIS I could find out about the denial, but I do not have the details.
    I read in the forum that a person had received an NTA without a date to appear before the court, which is why she did not appear in the system when she verified her A number in the number 800-898-7180; that is, if USCIS or ICE issued someone an NTA and if for some reason that person could not receive such correspondence, it is very difficult for them to know that they are in a process of removal.

    I received NTA in March. Date and Time on NTA is “TBD” My case’s not yet in the system. Long wait for immigration court dockets. But your lawyer could find out for you. I’m not sure about request FOIA. Ask your lawyer.

    On denial letter stated that you have to leave US within 30days. Officer could send it anytime after 30days has passed. Did you receive NTA? If not how did your lawyer find out? Did you have denied letter?

    I received NTA 35days after denied.

    I feel so depressed. 

    It happened to me too. I asked my lawyer she said vawa is a law. Long process..If uscis won’t accept vawa applications after Dec7 anymore, Uscis should be announced by now . They won’t just stop it with out any announcements.. right?

    Am I missing something that they will need again?
