  4. You mentioned an IR1 visa for your husband and probably IR2 for your child. As mentioned by Jan22 your son is now a USC he just needs to get his passport. Your husband is allowed to work right now, if he came in on an IR1 visa. The stamp in his passport is his temporary card. If you decide to give up and move back to Peru he would give up his permanent residency. For your mom, she can come visit. Do not say help take care of your son as that would fall under babysitting and not allowed as a visitor. She can be a Grandmother and spoil and spend time with her grandchild. What she does during that time does not matter. But she cannot be a babysitter as that would be taking a job and not allowed. So on to your expenses. You are living in one of the most expensive places to live in the US. If once your husband finds work (once he gets his SSN) and things are still too tight. Looking into moving, the US a big country, there are so many places that the wages better match the cost of living. My son moved to Washington, because he was enticed by the wages there. Sadly being young and dumb he forgot the cost of living is at least 3 times the amount of living in Arkansas. He has to have roommates just to keep a roof over his head. Since you pretty much just got back to the US and the shock of the cost of living and wages just hit you. Take your time, once your spouse finds work, re-examine the costs and make a plan to either find a better paying job, or better job and location. Weather that means leaving the state you're in right now or just moving around in that state that works better for you.

  6. Your husband should have been served when she filed for divorce. He should know where it was filed. Your lawyer needs to earn his fee and find that divorce decree. I would be more worried that you were not informed of this divorce and how he did not submit the decree at the time of filling.

  13. Thanks Tbone, I'll pass on stocks. It really isn't much. Not enough for a savings account. Just stuff I made playing video games. I think you need to give up on dating sites. Don't know what sites you found but they sure suck. You're better off paying a psychic to ask her where to look at this point. Or have your friend WCG set you up with someone.

  17. As both of you are US residents at the time of your divorce. I would say you need to speak with an attorney who is well versed with Muslim divorce. You are supposed to get divorce in your jurisdiction (the state you live in). I do not believe it would hold up in the US and you could still be legally married in the eyes of the USA.
  18. Email Manila yourself if it has been the lawyer doing it. You need to put in the Subject line- Urgent DCF request USC Job relocation or transfer either will work. You need to explain you are being relocated to the US and the date you have to be back in the US. If that date is not anytime soon it will most likely be denied. Expedites are for the USC rarely do they work for the beneficiary. They see it as, if you were not in the picture they would seek treatment in their home country. Do not confuse DCF for expedite. They are not going to expedite again as last time you were approved and your wife did not move. Yes it sucks it was do to the overlap marriages. It's years later that her medical has been ignore (See it how they will see it. She could have been treated be now). The thing about DCF is they do not have to take your case. It is totally up to them and their case loads. If you do not write the correct terms of requesting permission to file for DCF they are not going to spend time trying to figure what you want. If your lawyer send a DCF paperwork to them without prior permission it is going to waste valuable time waiting for it to be rejected. You need permission first.

  21. Both Canada and the US have similar rules for visiting. They count your 6 months in North America. It does not matter if you spent 6 months in Canada and then try to spend 6 months in the US. Same applies if you started in the US and wanted to go to Canada. You already used up your 6 months. There is no border hopping to reset the 6 months. They expect you to actually leave North America.
  22. I would not do the I-407 as you said you're not sure. He can always apply for another reentry permit. Never make a life changing decision with a not sure thought.

  24. I would not file for her. Since she didn't make the move she can either haul her butt back to the US to live and file for herself or deal with the fact she has abandon her US GC.
