    Immigration wise, make sure to be honest with USCIS about living arrengements etc. They'd understand if a couple had a rough patch, but won't accept hiding facts or misleading information on forms / during interview.

    We will take proof of counseling and write a letter, we are not sure if add that on the N400 application or if take it to the interview.

  2. Hi everyone!, I want to provide update on my situation. Throughout the time apart we continued in contact, to make story short we decided that after being together for 11 years we have a huge history that goes far beyond any difficulty we may face as a married couple. So we are giving our love a second chance, ❤❤

    Sometimes time outs help to get things together, when that significant other is not there, you realize that the day to day arguments mean nothing compared to what the other person means to you. 

    If you get in a crisis with your spouse, give it a chance and make sure divorce is really what you want because we realized it was not what we really wanted and I thought counseling was not going to be an option because he said no when I proposed that back then but he said he wants to do whatever it takes to heal.

    Thank you everyone! After all we are not going to divorce

    I'm sorry you're going through separation and heading towards divorce.

    You don't want to wait for the ROC interview. You may be approved for 10 year GC without interview.

    If this happens, you could have big problems at later stage, during naturalization. You may be accused of fraud or misrepresentation.

    You need to file for divorce and convert your petition to divorce waiver by notifying USCIS.

    How long a typical divorce would take in your state? Did you consult a family lawyer?

    I appreciate your concern, it's been hard and sad to see how a person changes when has so much control over you, and being so afraid to lose everything put me on a tough situation now.

     

    I'm in NYC and to be eligible for divorce you need to be separated for a year. I'm struggling to find an immigration lawyer and a family lawyer because I don't want to get scamed or misrepresented and get a denial. If anyone can help me finding a family lawyer and/or immigration lawyer or firm that is legit and good I will very much appreciate 

     

  4. Hi everyone!, I'm looking for some insight on my situation. I already filed for ROC Jan 2023, and got separated after that. We are close to reach a year separated now. In my situation separation and counseling is not an option, so I believe a waver is what I need. Since I'm waitting for the ROC interview and the gov sent me a letter stating my expired GC is extended for 2 years, that means I should ask for a waver at the interview or file one? I would appreciate some insight about how to go over this situation, as of course I will need legal advice, but at least any data that can put me in the right direction will be much appreciated, thank you!

  5. hello everyone! I have a question. I have a sponsor who did an affidavit of support Form I-864, but the rep at the USCIS didn't want to take it, so I'm not sure how to add the sponsor, also did any of you added employer letters like the ones we had to get for the AOS together with paystubs,1040s IRS forms,W2's from your spouse and beneficiary?

     

    Guys you added bills, services bills or bank letters mailed to your home since the begining of marriage or since the last interview?

     

    I'm thinking to do a summary of pictures since the begining of our relationship in 2011 until now, they already have all that but maybe it will give them the idea we already know eachother for a decade and been together for 8 years despite having a young marriage since 2019. What do you guys think? 

    I don't want to add things just because, but add as much proof as possible.

    Another thing that some people don’t include is a timeline of pictures. 100 pics, 4 pics per page, dated, venue, names of people in the picture. 

    Thanks!, yes that's the best thing to do, in every instance of this process we have sent a lot of proof, as much as possible, to a point that at the interview the rep told me with a smile, " you're over prepared" and told me to send a lot of the proofs for the ROC so, will add everything I have until the day of Shipping. 

  8. Hello Everyone! I'm getting back to this chat, I'm in the middle of a lot of things sorry for being away this long. 

     

    I'm getting a little confused about when to send my ROC, because my Green card expires on FEB 11, and I have 90 days to prepare it. I am planing to send it on FEB 1 bcs the letter says if you send it too soon they will reject it. 

     

    @Fe.Ta have you already sent it??

Our rep told us we had lots of evidence, which was good. Like you, we were over-prepared. She did tell us that because we had an interview for the GC there was a high chance of not having one for ROC, especially with the evidence. She did emphasize, though, that it was all about the pictures because it is what shows the “organic” and true side of a relationship, which is why she appreciated we had an album. I think they will look at progress, yes, like how it has developed. But, with COVID, I think they are aware that economic stability might look different for this season than in a pre-covid world, so I will submit all that we have and pray for the best.

     

    I might start the ROC thread this week if someone doesn’t get to it first.

    Oh my October 2022! Leading the way @Fe.Ta! You'll do good, we all did almost the whole thing with the previous administration, so I think that at least now there won't be unexpected bricks added as law changes that affect not help applicants. 

     

    What you say about covid is very true, not being in debt and having a stable household and relationship is more than enough now, and even more if we add inflation to covid crisis.

    Congratulations to you too and everyone!! Yes, long time no see. I got my conditional residency last year, I will have the last interview to remove conditions on February 2023. What about you guys?. I took vacations of paperwork last year, so I don't know if there is a thread created already. Now it's time to start organizing pictures, proofs and everything for it.

     

    The USCIS rep told me in the interview I was overprepared in a good way, most of the Affidavit of support of my sponsor and husband was not required last time, but he said that the last interview will be more related to our economic stability and any personal highlight like, moving/buying a house/being promoted/kids/experiences, but most of all, money related. That starting to get things done 3 months prior the interview it's enough, but...I dedicated more time and effort all this long so I'm not gonna leave everything for the last minute right now at almost the end of this process. (I considered it done when we all get our citizenship)

     

    Hope everyone is fine and healthy! Let's make this 2022 our year! 

  11. Hey guys, today I received a USCIS notice for "Initial Interview" asking for all the paperwork we already presented (I have the GC). Have anyone experienced something like this?

     

    The notices date is February 18th, my interview was Feb 11th and was approved the same day, and I also have the approval notice so, I'm confused.

     

    Will chat with USCIS to check if it was a glitch.

    The law changed in 2018, and even if K1 visas are exempt of performing a new medical examination, the USCIS can consider to ask for the medical examination after 2 years of completing the k1 medical examination overseas.

     

    My medical was still valid, but as I got a formal notice I had no option to do what they asked. To verify talked with a USCIS rep thru chat and said that you have to do everything the USCIS notices asks. 

     

    The exam is just the same as the one you did in Argentina for the K1.

    Hey lily! I had my interview the Feb 11th. I had to do the medical examination because I received a formal notification 2 month prior the interview and the same notification with the interview appointment. If you received it, no matter the K1 rules, you must. I'm in NYC, and my medical cost was $450 + vaccinations I needed was $900 total. 

     

    I also have a job and created a folder called "beneficiary employment documents" added the same info you add on a Affidavit of support without the taxes (employer letter,paystubs,bank statements & check deposits,w2 & 401k & retirement plan).

     

    The rep didn't ask for this paperwork, but its better if you have it just in case, he mentioned I will be asked for that info for the removal of condition in 2years.

    Unfortunately the weather conditions in Texas have not gotten any better and the field office in Dallas has been closed since Tuesday (Monday was President Day and they were closed anyway) and not going to be opening until Thursday as it seems like. So we weren't able to have our interview as scheduled! Hopefully our interview gets rescheduled soon but we don't mind the wait since I have my renewed EAD combo card which is valid for another year.     Good! Take these extra time to practice some questions for the interview. You can search for most common AOS Interview questions and that will help you focus, and know what to expect. Good luck! And congratulations for your EAD combo card
