Thank you all! I've submitted my Mom's I-130 form online without the I-94 number. I also submitted a FOIA request to CBP just in case.
Thanks again!

1. Yes
2 Apart from an FOI.. nowhere that i know .. FOI not warranted here. If you can use the additional info section of the I130 to explain its not available .. do so.. but don't worry over it
Thank you! What is FOI?

Hello all,
I'm a US citizen (just naturalized a few weeks ago) and filing form I130 to petition my Mom. My Mom visited me in 2015 under a non-immigrant visitor visa. In form I-130, there is a section requiring me to put in her I-94 number from this 2015 trip. I went to CBP website and put her information in but the website says "No Record". Anyone has experience with this before? I have 2 questions regarding this:
1. Should I submit my Mom's I-130 form without the I-94 number in the application?
2. If not, where else can I go to get help with her I-94 record?
Please help!
Thank you!

Hi all,
I got my 2-year GC in January 2017 and got my 10-year GC in October 2019. I was divorced before applying for my 10-year GC. My 10-year GC is already approved. My 5-year timeline is soon to be open in mid of October 2021.
My question is related to the time I was out of the US. I visited my home country for a 2-3 weeks each in 2018 and 2019. Should this affect my 5-year date? Basically, I would be eligible to apply for N400 on Oct 17th 2021 based on the original resident since date printed on my 2-year GC. But with a 5 weeks out of the US in the last 5 years, should I wait for another 5 weeks from Oct 17th 2021 to apply for N400? I'm very sorry for my confusing English

I went through divorce waiver with no issue. No RFE, no interview. Submitted my ROC package in November 2018, fingerprint in July 2019, approved in October 2019. One hiccup was I never received my extension letter. I traveled abroad in April 2019, and had to get a passport stamp.
I included all bank statements that were not submitted during my AOS application, 2 years of joint tax return, joint house deed, joint car title and insurance, joint home insurance, documents showing each other as beneficiary on investment/401k/IRA accounts and a very detailed personal letter walking through our relationship from when we started dating to the divorce, with the focus more on explaining why we divorced. I didn't include any pictures or affidavits. My package was about 4-5 inch thick.
I think I'm lucky since my process was only 11 months, but being well prepared probably helped my case a lot.
-
I sent all bank statements for every month that I didn't submit for my AOS application (along with other documents like house deed, 401k/investment accounts with my wife added as beneficiary, etc.). I know the IO will not look at all of the documents, but I rather be safe than be sorry. I didn't send any affidavits or pictures. My case was approved in 2019 with no RFE or interview.
My application package was over 4 inches thick lol.

You would need to get the divorce degree first. Then inform the USCIS immediately about switching to divorce waiver.
If you don't inform them right away and just wait for the interview to inform them, you could run into a weird situation where they approve your case without an interview. If this happens (most people will be happy about this), you will have a lot of problems when applying for citizenship since technically your I-751 were approved based on a joint application, but you were divorced during the application processing time. The USCIS would say you fail to inform them about your marriage status during the I-751 process.
I believe I read the above situation somewhere in VJ forum already.

Do you happen to speak Japanese?
How long were you married before the divorce? And how long had it been since you got your conditional GC when you divorced?
And finally, how long did it take for you to get approval after you ROC'ed alone because you were divorced?
I don't speak Japanese! Wish I could though
My marriage lasted 3.5 years before divorce. Divorce happened when my conditional green card has about 8 months before expiration. I applied for ROC in Nov 2018, got my 10-year GC in Sep 2019. I front-loaded a lot of evidences up until the month of my divorce.
-
You can file with a divorce waiver. If you don't have the divorce decree yet, they will send an RFE for it. A lot of people in here got approved with the divorce waiver, so you are not alone! Just need to be front-loaded with evidence when you submit your ROC package. I was in the same boat and got approved back in September 2019 with my divorce waiver application.
Besides the regular evidence (tax transcripts, any bills in both names, leases/loans in both names, etc...), I would suggest to also write/type a statement describing the time after you were granted conditional green card to include at least the following:
- Some explanations on why you two were separately then divorced (in this case looks like the cheating and spendy husband). Don't need to be too detailed but will need to clearly state the reason for separation and divorce.
- Why you two don't have comingling of assets (again, looks like because of the spending habit of you husband)
- Highlighting that you have been paying for his medical bills and living expense (maybe include your bank/credit card statement to show the expense items that you pay for and include the receipt from hospital for his medical bills).
- I don't know if it matters, but I have my statement notarized as well.
-
Yea, traveling should be no issue. But don't forget to submit your ROC package before the expiration date though (or as soon as the window for ROC is open)
-
I submitted the "masked" transcripts without any issue! My case has already been approved.

Try getting a clean social security card based on the passport stamp from Social Security administration office. They make it in five days. If you have a clean social security card (without "DHS authorization" written on it)and a driver's license then that's considered sufficient proof of legal work authorization by the HR of any company.
I submitted my clean social security card and driver's license, but HR still requires me to submit my green card. They said they need to enter the A-number and the expiration date of green card.

Oh my God. My first 4-digits is also LIN1990. I hope I'll receive the same good news as well, especially now that it's harder to check my case status because USCIS website doesn't work well anymore and my USCIS homepage is still saying you don't have to do anything else which is not updated 🤦🏻♀️
That's exactly why I hope they don't just send out the email by mistake

I also created an account on this website, but my case status here still shows "We received your case. You do not need to do anything right now".
-
Thank you! I'm glad that wasn't my computer issue.
-
Also, does anybody have issue that the case status won't load for your case? I was able to see my case status earlier this morning, but now it is just blank ~~

Yea, my receipt number starts with LIN1990.

Darn
it's a hefty price to just locate a record that should have been publicly available. I will keep this in mind if the USCIS forces me to go through this. Thank you for bringing this up! This will at least prepare me mentally when or if we need to file this!
