  1. Hey,

My wife went in for her AOS (Form I-485) on October 30th. They didn’t approve us on the spot and told us we will be notified by mail if additional information is need/ or decision results.

I checked the app today and it says that her I-131 was approved and the case for the EAD now says that a card was picked up and we should receive it Saturday. However, the status is the I-485 still says that interview was scheduled?

I guess they approved the other two and not her green card application? I guess I don’t understand how she got approved for those two, even though we went in for an interview already for her AOS

picture included of the case statuses

Thanks in advance for the help!

  2. Hi everyone,

So I misunderstood how the K-1 visa worked and thought that there were not any risk if we waited to file for an adjustment of status (AOS). We waited because of financial reasons, my wife gave birth, and had dental issued that needed immediate attention. We had gotten married 5 days after her arrival here, so I thought if we waited to file the AOS that it would be ok, while we addressed the other medical related issues first.

Well, after reading on the forums the last few days I realized that she is “out of status”. Because of this I want to submit her packet ASAP. I have everything done except for her vaccines, which she could not get before coming here because she was pregnant.

I read in the instructions that it is not necessary to include the I-693 with the AOS:

    Quote

You are NOT required to submit Form I-693 at the time you file your adjustment application, but may do so if you wish. Because of the time-limited validity of Form I-693, you may choose to submit your Form I-693 after you file your Form I-485. You may also submit Form I-693 in person at an interview in a USCIS field office, if an interview is required. By waiting to submit Form I-693, you may avoid having to repeat the immigration medical examination.

To avoid any possible issues with law enforcement I would like to mail off her packet today and have her I-693 and vaccines done and bring those to the interview with us. This should be ok, or should I wait until the I-693 is completed to send in her AOS?

    Thanks!

This is a very good point. I was able to easily add my wife to my company's health insurance plan.  The  company plan paid for a good portion of the civil surgeon's fee. That certainly help soften the financial bite of the civil surgeon's appointment.

As an aside, my wife and stepson each had to see a civil surgeon, to add my stepson to my company's health insurance plan would have been prohibitively expensive (>$400/month !!). Since he was a young, healthy boy, we purchased, on the online insurance market, a general high-deductible catastrophic policy with a small dental and vision service included for about $225/month.

Good luck on your immigration journey.

Ok, thanks for the information, I really appreciate it!

Even if you don't think there's any chance your wife will need or want to work before she gets her green card, and you don't think there's any chance you will need to travel internationally before then either, you should still apply for EAD & AP. It doesn't cost anything extra, and unexpected things can happen (especially on the AP side; what happens if there's an emergency back in your wife's home country? Yes, you can apply for emergency AP, but it's always a risk that what you think is an emergency is also seen that way by USCIS. Or heck, because of your very good career you've got some time off and would like to take an international vacation with your wife? ).

You said that the EAD and the AP doesn’t cost anything extra? When I looked under fees, one had a fee of $410 and the other a fee of $575? Or are they waived when you submit them with the AOS?

  5. Hi,

I was wondering if the green card serves the same purpose as both the EAD and AP or do you need them even after receiving a green card?

The reason why I ask this is because, I am about to submit the Adjustment of Status (AOS) for my wife. I am fortunate to have a good career in the medical field, and my wife and I agreed that she was not going to look for work until our newborn child is 5 years old and has started school, also my wife does not have a reason/desire to return to her country of birth any time soon. The process time for an AOS in my area is 11.5 to 18.5 months at the moment. Once we receive her green card, she can then travel and/or work if needed or would she still need an EAD and AP? Thanks in advance!

  6. Hello everyone,

My wife's K-1 visa was approved and she arrived in the united states back in November of 2018. However, she was pregnant at the time so she did not receive all of her vaccines. She also didn't have any childhood records. So, on her vaccination documentation the doctor put "c" (contraindicated) for the majority of her vaccines. My wife has since given birth, and  I am now about to send off her forms for her adjustment of status, and understand that she will have another biometric screening done.

    My question is:

Should she go get the required vaccinations before her biometrics appointment, or should she wait, and they can give them to her at the appointment? Thanks in advance!

    Hi,

So, did your fiance get her biometrics done before the case was sent to the Embassy? My fiance has his appointment at the VAC next Tuesday and our case is still at the NVC? I just want to make sure that won't be an issue, since our case isn't "ready" or "in transit" yet.

Yes it was already done, and we have already scheduled our interview. However, like one of the users stated above, they can’t go in for their medical exam until they have a letter from the NVC.

Nothing was sent physically to me or my fiance. NVC sends it via email you forward it to ur partner so they can print it. And of course always have a copy for yourself. Another secret do not stress the affidavits have it but they do not ask for it. I believe since its a K1 they dont but you will need it for the adjustment. I stressed so many things and its easier than what I thought. The police certificate you can send for it online they will email u it just print it and have it instead of going to the actual place n waiting. Save time! Do it online more convenient just wait closer to ur embassy appt date to do it.

    Thanks! 🙂

Hello! They say to wait 8 weeks, but after 2 weeks you should call. Mines was approved in April NVC received it in June. You shouldve waited for NVC to get in touch via email just to be on the safe side. Once you schedule an embassy appointment your visa receipt gets locked meaning you cannot reschedule until they unlock it. Some cases take time while others take less. Once NVC receives your approved petition they are quick because they do not process K1 Visas the embassy of the country u r applying for does. All they do is put it together electronically and its between 4-7 business days. You can check on CEAC for your status. Once its at the embassy it says ready for interview. At that point you make a profile on ustraveldocs and book your VAC appt and Embassy give it like 10 days in between to make sure they have ur results because for medical is walk in no appt necessary. I had my fiance do the VAC in the am and from there get the medical done. So, when it was time for the embassy appt everything was there. FYI: for the medical you will need your NVC letter do not forget that or you will not be seen a lot of people were turned down for not bringing it..

I love to help because I had a hard journey with this process so if i can shine some light on others it will be of great pleasure to tell you... good luck 😊

Thanks for all of that info! Once I get the letter can  I scan it and email it to her, is she allowed to take a copy? Will they email it to me also, or does it come via physical mail only? Thanks again!

Not she doesnt have to go to the vac again they already took the biometrics and picture.. if u have ur appoiment letter she should make the medicals...do u have the police record, birth certificate??

Ok thanks! No, so far i got her passport, and biometrics done, she will visit the doctor on Tuesday, and get her police record and birth certificate next week also.

Could take 14-20 days.. medical are kinda a week labors week. So for October 12 is fine tho... keep calling nvc  for ur nvc  number and ur filed should change to transit in Sept 18.. nvc send batches every 14 days. The last batch was sent Sept 4

Thanks! One more question? Do I need to have her visit the VAC again to stamp her new appointment date if I change it? When she went to the VAC initially she took her DS-160 along with a form with her VAC and interview date. She stayed that they stamped her paperwork but she can’t remember which and she’s in Santiago for for the week so she can’t check.

During my process for the K1 Visa, I did not find much information. Their website is out of date, but common sense will help you achieve it. After NVC receives your petition and its ready status, you must make a profile at ustraveldocs. This will help you book your VAC and Embassy appointment. Do not sit and wait for package 3-4 it will not happen. As you book your appts the confirmation page will let you know the documents to bring and locations. Please please go with your partner!!! This country is hard for some. Make sure you have everything organized and concrete evidence. If any questions arise you r more than welcomed to email me. Good luck!

Thanks for being her to help! My fiancé’s case was approved September 4th, and I have yet to contact the national visa center.  I’ve already scheduled her interview at the Embassy in Santo Domingo for October 25th. However, a much closer interview date opened up. I wanted to reschedule for October 12 but I’m afraid that the the embassy May not have received my case from the NVC by then?

How long does it usually take for the embassy to receive one’s case from the NVC? Do you think scheduling an interview for October 12th is too soon? Thanks !

As it says that’s for immigrant visa, k1 is a non immigrant visa.

ds160 is the non immigrant version of ds260... so unless your embassy specifically says k1 will also ds260, you don’t it (which would be a pretty ridiculous request by the way)

so there is no going ahead.. as she won’t be applying for an immigrant visa.

    OK thanks! 🙂

If you are doing K1 visa you  need to complete DS-160 and it for the beneficiary.

Thanks, yes we are doing a K1 visa.  I completed the DS-160 for her. But I was hoping to go ahead and get started with the next steps so that I could schedule an interview asap.

When I go to the U.S. embassy DR site the site states:

After you have completed the steps on the Immigrant Visa Process on usvisas.state.gov, including paying the necessary fees and submitting the required immigrant visa application form (DS-260), Affidavit of Support, and supporting documents to the National Visa Center (NVC), they will review your file for completeness. Once your case becomes qualified for an interview, NVC will work with us to schedule an interview appointment for you.

When I click on Immigrant Visa Process it takes me here: https://travel.state.gov/content/travel/en/us-visas/immigrate/the-immigrant-visa-process/petition.html

Where step 1 says: To choose your agent, complete the Choice of Address and Agent (DS-261) form in the Consular Electronic Application Center.

If she no longer lives there, I would email NVC once it gets to that stage. Or email USCIS if you can. I think it's important to keep them updated on where she currently lives and what your email address is. Most of our important updates came to us via email, Then paper receipts came to us by mail months after...

The visa won't be issued until after her interview at the embassy. It will be placed in her passport, then mailed to a local mail carrier where she can go pick it up. We were asked NOT to return to the embassy. We had to go to the mail carrier to pick up his passport along with a very important packet 4, which he had to show ID for and sign to receive. Of course, I'm just speaking from my experience! Each case is a little different, so it's important to keep them updated on current addresses, just in case.

So, I guess generally speaking, they may not need her address but I would keep them updated anyway. More than likely she'll be going to a mail carrier office to sign for and get her visa and packet. Good luck!

Ok, thank you so much for this info! This helped a lot o really appreciate it! :)

  16. Hello everyone!

Now that we are getting closer to reciving our NOA2, and subsequently our spouses receiving their VISAS  I was wondering how is it issued? The reason why I ask is the address that i used for my fiancé during the initial application, she no longer lives their anymore. Is the VISA something that will be mailed to her, or can she return to the embassy to pick it up? Thanks in advance for the help! :)

Hi, medical was done like 48 days after the NOA2. It should have been sooner. We were able to schedule the medical exam when we had the interview appt and paid the visa fee.
