    Hi! We are still waiting for an appt letter from Norfolk. We received the EAD/AP but our AOS still says “we received your response to our rfe”. We have close friends who have a scheduled interview for next month in Norfolk. They applied after us so its super annoying that they got their interview before us, but it happens.

    FAILURE TO MAINTAIN STATUS
    Title 8, CFR Part 245.1(d)(1) defines “lawful immigration status” to include nonimmigrant status (e.g. B2, F1, H1B, J1, L1A), refugee status and asylum. Temporary protected status (TPS) granted under section 244 of the Act and F-1 student occupational practical training (OPT) are also considered lawful status for adjustment purposes. Examples of persons not in lawful status include aliens who entered without inspection, aliens whose nonimmigrant status has expired, and parolees who were not inspected and admitted.
    In terms of Form I-485 adjudication, lawful status is counted from the date of the alien’s last admission until the Form I-485 is filed. Any gaps or violations that occurred prior to the alien’s last admission or after Form I-485 was filed are not counted. (These limitations do not, in any way, bar USCIS from scrutinizing an applicant’s full immigration and employment history within the record of proceeding to otherwise determine admissibility or eligibility.) Lapses or violations totaling 180 days or less are permissible under section 245(k) of the Act. 
    An alien fails to maintain lawful status when their status has expired, has been revoked, or has been terminated. In particular, an alien admitted as a nonimmigrant fails to maintain lawful status upon overstaying his or her authorized period of admission, as specified by the expiration date on the alien’s Form I-94 (Arrival/Departure Record) or Form I-797 (Notice of Action). Applicants also fail to maintain lawful status by violating the terms and conditions of their admission. This means that although the alien held (or was granted) a lawful status, he or she engaged in activities which violated the terms and conditions of that status.

    Hi guys, after a long wait and no updates from USCIS. I received an email this morning saying that USCIS has taken an action in my case. When I logged in I found out that my status has changed from case was received to we approved your case !! Ead was approved finally, I’m so happy !!!!! I hope you guys get some good news in these coming days.

    Just to share my experience with Ombudsmen and Senator.
     
    March 10th - I emailed Ombudsmen and Senator (I wrote about my name typo error causing delay and being beyond processing time. I scanned and sent all letters and documents that I received from USCIS)
     
    March 15th - I received RFE letter. (USCIS sent in March 12th)
     
    March 16th - I sent my response to RFE to USCIS.
     
    March 22nd - USCIS received my response to RFE.
     
    March 30th - I received a response from Senator by email.
    "Thank you for your inquiry regarding this constituent's immigration matter. The I-765 and I-131 are currently under review by an adjudications officer. Your constituent should receive a decision or notice of other action shortly. 
    The I-485 is within our current processing time. Processing time information can be found on our website on the USCIS Processing Time Information page."
     
    April 3rd - EAD and AP got approved. (My USCIS account got updated in April 5th)
     
    April 5th - I received a response from Ombudsmen by email.
    "We have contacted U.S. Citizenship and Immigration Services (USCIS). In response, USCIS indicated that they issued a Request for Evidence (RFE) regarding the application/petition referenced in your request. On 03/12/2018, USCIS mailed the RFE to you.
    Please refer to the notice for instructions and respond accordingly within the stated time frame. Please allow USCIS 90 days from the date they receive your response to issue a decision. etc...."
     
    I think it is better to try everything you can to speed up the process. It won't hurt. I hope this helps you.
