    I fact, my wife was arrested in 1994 in Cape Town (South Africa) during a student strike against the apartheid regime. The new president was just elected and all the country was in turmoil requesting the rapid transition. The apartheid regime was still in place. During the nationwide student strike, looters as well were on the road, vandalizing shops.

    Any student arrested was indicted "theft" and sentenced for 3 months prison or R300.00 fine.

    During her interview for immigrant visa on July 2018 in Johannesburg, she was deemed eligible to apply for I-601. This is qualified as petty offense, but USCIS didn't take it as such.

    Responding to the RFE we received on July 2020, I amended the I-601 by introducing the miss-presentation.

    In her visa application, she mentioned that she never been arrested because she was not considering the arrest. I realized that it is a miss-presentation and amended the application.

    We just got approved now after 2 years.

    Please note that I had to seek help from my congressman and the USCIS Ombudsman service.

    Know your case and articulate it yourself. I did not get a lawyer

    We were approved on September 24th, 2020 after filing a mandamus. I'm looking forward to November 3rd!  We're just waiting for instructions from the consulate now.

We've had our Congressman submitting inquiries every 30 days...with the rote responses. It is now 142 days since Nebraska has received our RFE.

     

    Anyone else having the same or similar experience?  

    UPDATE: Well, we've finally crossed a barrier but it took another year and a Mandamus to get to this point. Our waiver was approved on September 24, 2020. It took Lizz Cannon suing the government on our behalf. Don't be afraid to stand up for yourself. We all need our loved ones with us, and we should never be put through what many of us have been and are continuing to be. Keep the faith. We still have to get through the second interview. xx Bless you all.

    Our timeline:  601 received March 12, 2018, RFE February 28th 2019, NSC received RFE June 11th, 2019.  We have not received any further notification. Over 230 days in administrative processing and awaiting adjudication. We're devastated.

    This sounds good!  Though I'm not sure what exactly to write, how to phrase the letter.  And do you send a letter to all the people listed above, or pick one and see what the result will be.  Also do you send it to the E-mail listed or maybe by priority mail?  

    Personally I'm very frustrated, as I started the over-all process in November of 2017.  My then Fiance'e and now wife, her/our wonderful and sweet daughters, just want to be together some time this year.  Looking at others time lines it looks like about 5 month minimum following an Approval from the USCIS, until an interview can be scheduled. With the Nebraska Service center about 6 months behind the Texas and Potomac centers, and a PD date of July 22nd 2019, it may no be until December 2020, before I go to bring them home.  I know there are many others in the same boat.  It's the not knowing when that drives us crazy, and some are and I'm sure I/we will be soon seeing those blessed to not be at The Nebraska center getting approved.

     

    Anyone have ideas?

We have an attorney who is helping through the process and suggests waiting to hear back but 6 months+ time seems to be long time.

     

    Does anybody know how long it takes in similar cases? According to attorney, he sent inquiry to consulate but no response. She is currently in Pakistan.

     

    Please advise.

    Wait, it's taking a long time for everyone. We've been waiting 2 years, RFE submitted, 200 days after they received it, and Admin Processing since August. It will happen. xx

He was asked to redo the medical exam, bring all the original documents, and most current passport. It seems his visa is ready to be picked up. I applied for his visa the beginning of 2016. By the time he will be getting his visa, it will have been 4 years.

    I-130 approved Aug 2017, visa interview 2/2/2018, denied...601 waiver 3/12/18...RFE 2/2/2019...additional inadmissibility of fraud added a year and a month after first interview...RFE received 6/13/2019...12/31/19...still waiting. This process is horrible. We wish you and your hubby all the best.

    I'm heartbroken and, frankly, at the end of my rope. RFE request was submitted to Nebraska on June 11, 2019. 172 days and NO response. Our Congressman Jimmy Gomez has inquired every 30-60 days, and today I sent an email to Kamal Harris to advocate for us as well. CEAC site changed on August 22nd from refused to Administrative Processing. From what our lawyer says, it really means nothing. 

  8. We had our interview on February 2, 2018. My husband was found inadmissible for past crimes (40 years ago/ theft and a fight). We submitted the 601 waiver on March 12th, 2018. On March 6th 2019, USCIS sent a RFE for more evidence. We submitted additional evidence on June 11th, 2019. We have been waiting for a response since them. It has been another 172 days...so a total of 647 days just for the 601 waiver. Don't expect a response in the time that they say. They're not accurate.  I'm heartbroken and ready to give up.

My husband's passport was collected from him by the officer at the time of his interview and it is still at the embassy. The embassy handling my husband's case is the U.S embassy in Kabul Afghanistan. Also not to forget reading the forums here on visa journey I got to know that I could get help from my state's/city's senator regarding the issue and I did that the senator I contacted is Kamla Harris and she works for my area her office was helpful but the only thing I got from them was an official letter stating that I have to wait and this wait can not be expedited or waived. If you guys have any suggestions or similar stories please, please share it with us.

    There are many of us that have been fighting too. My husband and I submitted his 601 after his interview in February of 2018. They received it March 2018, and we received a RFE March 2019. Now we've been in AP, but still no approval. It's not just you and your hubby. My husband in from the UK.

    I turned in my rfe on July 25 and got a denial within 2 weeks, they said I did not have enough hardship. Which I do not understand, how much hardship do you have to have. I have health conditions and depression and my husband has been gone for the last 3 years. So now I had to appeal and turned in my paperwork on September 16th 2019.  and now I just have to wait to see if they accept my appeal.  Now all I can do is just hope and pray they say yes. Anyone else in the same situation.

    I'm so sorry. I'm hoping that since they've been sitting on our RFE for so long that it's not a denial, but you never know with this.

    Absolutely! I've seen those with overstay or just misrepresentation approved much sooner than criminal or drug related 601s. We've been waiting over 100 days for a response to the RFE we sent. My husband had offenses from 40 years ago, showed rehab, showed plenty of hardship, and still waiting. Now in administrative processing and they could sit on it as long as they want. 

  13. UPDATE:

    We received a RFE on March 1st, 2019.  Our lawyer sent the response on June 11th, 2019. We have our Congressman involved, and his office has inquired 3 times now. It has now been 100 days since the Nebraska office received our response. Our CEAC status changed on August 22 from REFUSED to Administrative Processing. From what I understand, they can sit on our file now from 2 weeks, to 6 months, to 2 years.  My husband and I are so frustrated, but we are hoping that after all of this we will get an approval.

    we got our approval yesterday! My service request came back and I opened it thinking it would be the same bs that it was still being processed and I nearly fell out of my seat when it said it was approved. I really hope you hear something soon!

    Waiver received by USCIS on 3/16/18. 

     

    Lawyer isn't sure if this is good or bad. Any insight?
