    The I-864 is between you and the government, not you and her. She can whine all she wants but you have no obligation to give her a penny. If she does receive public assistance you might be on the hook for paying the government back. 

    Thanks, that's seems like it will be her cycle indeed!! What would be the kind of public assistance that will makes us liable for?

    Seems baby daddy is pulling strings. He already arrived for his own petition. 

    Russia, she's 23, baby daddy just showed up a bit ago, taking both daughter and baby with him.

    She would NEVER expect her to act this way. Even after her interview, and visa approval, we told her that if she wishes to stay back in her country, she could do so because of the baby and baby daddy situation, she was NEVER forced to come over,

    This might sound like the most bizarre petition for children of permanent resident. As some of you have followed and reply to several of my post, I want to let you know that my stepdaughter is finally in the USA, and, as many of you expect otherwise, It's been an absolute hell since she was on her way to the USA. 

    For starters, she snapshot the part of the affidavit of support and sent it to us, like a "reminder" that we are financially responsible for her. She actually thinks that she will be getting a monthly salary from us just because the affidavit of support. 

    She's been completely nasty towards her mother, even to the point that she attempted to hit her more than once. Constantly threatening us the she will make our lives miserable, etc. 

    Now, the latest, Apparently the father of the baby arrived in the USA, we exactly don't know how since he's not from, and never being in the USA and she's planning to leave and be with him. She's expecting to receive a "salary" from us, as "stated" by the I-864.

     

    Any guidance, Please? just as I was writing, I was about to call the police on her, throwing stuff, and getting into my wife's face.

  4. Hello Y'all!!!

    Stepdaughter's upcoming visa appointment next week!

    We filed an affidavit of support for my stepdaughter back when we started with her visa process. Things happened, so my stepdaughter got pregnant, and now she has a baby. The baby was added to her petition, and it was approved!

    But now, my question is, Do we have to update our affidavit of support with the baby's information as well?, or does the original stands? NVC requested our latest tax transcript, which we promptly submitted to them.

    I just cannot find any information in regards to this.

    You should not give up , call /email the embassy again and reach out to your congressman for help. ..


     

    That’s exactly our case! I will be calling the embassy again tomorrow morning, and try to talk to someone with a higher rank if possible.

    Who Petitioned for your Stepdaughter? As @Boiler noted it will confirm what category she is in and if derivatives are allowed. 
    Just based on the first response from the Consulate, it may be a category that does allow derivatives…otherwise I would have expected them to tell you adding baby is not possible at all.

     

    My wife, who is a green card holder waiting on removal of conditions.

    Only one of the family-based immigrant visa categories does notdo so: the so-called "immediate relative" category. This includes a U.S. citizen's parents, spouse, and unmarried children under 21 years of age. 


    So as @JeanneAdil notes there is no derivative available to your step daughter.  
     

    How old is your step daughter?

    She’s 22, baby is 7 weeks.

  9. Hello Y'all!

    We are in desperate mode because we just got two different responses to our question.

    Here's our situation:
    DS-260 submitted for my stepdaughter. during waiting time, we found out she was pregnant. during pregnancy, she received an appointment for green card interview. Baby was born almost two months before the appointment, and as soon as she had her birth certificate and passport, we submit the documentation, and added her to her mom's application as derivative. 

    We called yesterday to the embassy to make sure that all documents were received (10 days after submission) and they confirmed that they were received. I asked about how to pay the fees, and the person stated that we must contact US Travel Docs, and inquire about it to them. We asked the representative about add the baby to moms appointment, and he said to come with the baby the same day as mom's appointment.

    Once we got the response from US Travel Docs about the payment, they stated that since an appointment is already scheduled, you CANNOT ADD ANOTHER APPLICANT TO IT!

    What to do? Anyone has gone through the same situation?

  10. Hello Everyone,

    So, our Earliest filing date was 1/4/21

    Package sent 4/7/21

    Now...

    For some reason I decided this time to send BOTH the I-751, and the Biometrics fee in one check. Then I found out that the Biometrics fee has been waived. I'm concerned that sending just one check will delay our I-751 process.

    Has anyone done the same mistake I made? Did you get any notification from USCIS? I attempted to call, but seems like that's an impossible task.

    I checked today about being able to add her to my health benefits, and employer said that it will be no problem as long as I add her within 30 days of entering the USA. All I need to request from them is a confirmation from my benefits provider stating that she will be added to my insurance.

  12. Hello Everyone!

    I might be drowning in a glass of water with this form, but I want to make certain that we are filing this correctly. My stepdaughter has been approved for interview with the embassy in Russia. Going through the NVC and DOS sites, it advised us not to forget to fill the DS-5540, Public Charge Questionnaire. I'm so confused since she's just 20 years old, working part time, and learning English while waiting for the interview. Other than what she's making from her part time job, she has no other assets, debts, etc. Never filed US taxes since she's never been in the USA. 

    I'm sure that due to her age, she should be okay since she's just starting to work, and was waiting to get to the USA to start college here, but still worried that the fact that there are not many answers on that form, will adversely affects her interview and/or chances of getting her visa approved.

    We are a bit confused on a specific issue, hope you guys shed some light as you always do.

    My wife (green card holder) filed a I-130 for her daughter. 

    We recently received her I-130 Approval letter, as an unmarried child under 21 of permanent resident. She's currently 20, and will be turning 21 in 4 months. Our question is, if she doesn't get an appointment for interview before she turns 21, would she still be considered as a child since the approval was BEFORE she turned 21? or could it default to adult, and delay the process for months or even years?

    Thanks so much for your input! we are very happy that we will be all together, but this issue, and not knowing how it proceeds since she is in that border between child / adult is kind of worrying us a bit

  14. Hello!

    I'm right now in the middle of filling the DV lottery form for my stepdaughter, and I have a question. One her travel passport, her name and middle name are written in Russian, but only her first name translated into English. I'm stuck in the passport information, and debating if I should mark the option of "no middle name" in her passport information, or still write her middle name even though is it not written in English.

    Any pointer will be greatly appreciated.

  15. One Last question about the DV Lottery...

    Can we use mine or my wife's email address to register her daughter for the DV? or can we open a new email account that she can access from Russia and us from USA?

    we just want to keep an eye on the status as well.

    Just a question. My wife and I are planning to submit her daughter's DV lottery application. We are in FL, and she is in Russia.

    Can we fill her application for her in FL, with all the required information?  Should we put in her current address in Russia (the address info states "in care of")?

    We already have a family-based visa in process for her, would applying for the DV lottery affect that process in any way?
