Normally,  your husband is receiving the K-1's from the company, or he should get an estimate from the Accountant of the company . as you mentioned earlier, he filed an extension, he should have estimated tax paid, while filing the extension. as long as the estimated tax has been paid, you are good but you never know the decision of the embassy.

    Good Luck!

Thanks! Yes, he's waiting for the K1 schedule which he will get only in June - July when the company audit is over. And you're right, the estimated tax was paid and the due balance is zero according to the 4868 form (the extension). Anyways, I hope everything will go smoothly ☺️

Same thing happened to me in 2016 i filed extension and we just took extension letter and tax forms to interview. They didn't ask for it not needed. We were at NVC in January Case complete in February. Interview was end of April.

They will accept extension. They can't make you file. Just make sure you have his 2018 W2's to at least show his income just in case they ask.

Great! Thank you for sharing your experience. I'll have my husband's original W2's 2018 with me at the interview.

They don't care about "can't" or "why".  However, if his income has consistently been well over the required amount, they may go ahead and issue the visa without seeing the 2018 transcript.  All you can do is all you can do.  It will be what it will be.  They are going to make a judgment call based on what they have in the file and what they decide to consider from what you bring with you.   Don't expect "sympathy" to be a part of their consideration.

You are right, it is what it is. There's nothing we can do now.

Hello I am on the same situation as you, and this is what they say about tax extensions on the Travel state webpage instructions (step 4). So I don't think it would go to AP if you provide proof of extension, just take it to the interview, they will not review it on ceac.

Let me know how your interview goes, mine is on May 3rd. Good luck!!!

Thank you so much! I will let you know. Good luck to you too! ☺️

There have been a few people put into AP until they submit their transcripts..Dont mess with CEAC anymore...bring the letter with you to the interview...you should just be ok with 2017

Thank you for the advise! I also saw some cases put on AP but not due to the extension. Seems like some people provided tax return forms, but CO wanted the transcript.

They usually ask for most recent year......and I have seen instances in which they have delayed visas......maybe you will get lucky....

Yeah, I hope we will get lucky. We provided NVC with W2's 2018 that meet the financial requirements. I also have a draft of tax return 2018, but as I mentioned earlier my husband can't file it with IRS yet.

  7. But my husband won't be able to file taxes at least until June - July. Will they put me on AP for that? The thing is that partially my husband's income comes from his family's business. He needs some document from the company to file his taxes. He can get it only in June if not later after the company audit... He always fully files his taxes closer to October because of these circumstances.

  8. Hey everyone! Hope you all are doing great!

My husband couldn't file his taxes 2018 by the deadline since he didn't have all the necessary documents to do it. Instead, he filed an extension. I have my interview next week. Now we are wondering if we need to upload the extension form to CEAC or just bring it with me to the interview? At the NVC stage, the extension wasn't filed yet, so at that point we uploaded a letter explaining why taxes 2018 weren't filed.

You need a copy of your approved tax return extension & any confirmation notice plus W-2.

Maybe, a letter explaining why you had to file an extension.

My husband and I are also in the same situation. My interview is on April 23. My husband should have his Tax Return Extension Document by the end of March. Does anybody know if it is enough to just bring the extension document to the interview or we also need to upload it to the CEAC?

Unsure if this is the place for it...

After waiting 101 days of AP, our interview was on Nov 29th 2018, and sent a message via ustraveldocs from me asking where our status is at to help with this pain of waiting, and gave details that the paperwork they sent to hubby said our ap should only last 2-3 weeks, and a few other things as well..... Yesterday we were told in Russian, that our visa was approved and it will be sent out to him in 2-3 days. This morning our status changed to Issued, after 106 days of AP.

Congratulations! I followed your story. I'm happy it's finally approved and you can be together 💕 of course this waiting was painful and seems like they just dragged time, but it's finally over for you guys! Yay 😀

Ok...But whatever you do make sure he uploads the 2016 also, because they are asking for 2 most recent.  I’m telling you this because I uploaded 2016 and 2017 and it was accepted.  I just filed my 2018, but it wont be ready by the time my husband go for an interview.  Don’t start giving them things that they are not asking for.  Your interview date might even be before your husband files his taxes, since he does them after April 15th.  Just tell him to upload 2016 and 2017 and NO letter explaining anything.  If they need 2018 they will ask for 2018, then he can send the letter.

Yes, we submitted tax transcripts 2015-2017. And we havr already submitted the explanation for not filing and W2 forms for 2018. I hope they won't reject just because we gave them extra documents 🙏

His most recent is 2016 & 2017 majority havent filed 2018 yet.  When you are going on your interview, you can bring the 2018 tax transcript just incase they ask at that time.

I won't be able to bring his transcript 2018 to the interview since my husband will file his taxes in summer/fall due to the fact that part of his income is dividends from a business. So, he always files taxes after April 15. That's why my husband decided to submit a statement explaining it. But we uploaded W2 forms for 2018 to show that last year his income was enough with his earned wages.

  13. My husband and I are just about to submit all documents to NVC. We have one last question. As my husband has not filed taxes 2018 yet, he wrote a statement to explain the reason. Shall we upload it as an additional document or upload it first in the required field for most recent return/transcript and as additional document too? For now, we uploaded transcript 2017 as the most recent transcript and statement for not filing tax 2018 as additional one. Thank you for you help in advance!
