  1. Having a VAWA filed against you puts your under scrutiny, naturally.

Don't try to have a baby to play the system... not only would that be obsolete, but it is deeply troubling to even consider.

  2. Hello,

I began my AOS path shortly upon entering on a K1, starting with an SSN application. Two months later, I was starting to worry about the i-94 expiring, and so we've decided to submit the AOS packet without the SSN.

I received my SSN a week after sending the i765, and now I am confused as to where to go from here. I understand that the SSN and EAD are two different documents issued by two different agencies, but am I expecting to updat my i765 ? if so, how? I made sure to include a brief explanation on my i765, stating that the SSN was already applied for and that it wasn't received yet. will my EAD get denied or slowed down?

    thank you

  3. Greetings friends!

I came back to inform you that I have received my visa after a long administrative processing, finally!

I am currently in the United States, where my now spouse and I were finally reunited.

I was placed under administrative processing in late 2016, well before the ds5535 existed. We waited, and waited and waited, until one day, a year later, I was called. They asked to resubmit some documents along with a fresh medical exam, which we promptly did. We were then placed under a little bit more Administrative Processing, three or four months, I had stopped counting the days and months at that point... They then emailed us the ds5535 form. the latter took about 2 months to finish, and the visa was finally issued.

I had honestly never in my life felt more relief and happiness than the day I picked up my passport with the visa printed on it.

tl;dr: ap for 400+ days, ds5535 took 2 months to complete, visa was issued.

    Hi everyone,
I'm a USC, petitioned for my husband (CR-1) who is in Lebanon and we are still waiting for the interview, but after reading this topic, I've been very worried he could get a DS-5535, is there anything we can do to avoid this? anything specific anyone can recommend?

This will be my second time applying for him, because the first time they didn't consider the marriage "consummated" although we had a child. It's the rules and my only option was to consummate the marriage and reapply.

So we have been going through hell since 2015/2016 (3 years) :(

    Any advice is appreciated..

Unfortunately the Ds5535 has become the norm for some countries, and there isn't anything you can do to avoid it. But getting the questionnaire doesn't necessarily mean long delays--it could take anywhere between 2 weeks, to over 6 months, I'd say the median is 90 days. But then again, your husband might not get the form at all. Stay strong and remain patient.

Well my hubsand renewed his passport before his interview which was last year jan, 26 2017 but we told them to hold off the visa for one year. But when i sent it for stamping in november they send us this forum ds5535 n for 3 months they didnt tell us anything until i sent new affidavit of support to add my daughter then they called me n told me that they didnt recieve the form so i submited the form by mail on feb 4. So now just waiting. They did review my file 2 times which was feb 19 n 20. After that today when the officer called so he updated. He told me few months so lets c.

Oh I see. Then it shouldn't take long for you, hopefully within a few weeks!

    thanks for your answers

i already contacted the embassy and asked about my passport situation , the embassy said they will send me my passport to renew it and i should keep it til they ask me to send it

regarding the expiry of my medical check , the embassy already asked me to send them my passport , new police certificate and new medical check on 29 march 2017 , i submitted everything they asked for on 11 april 2017 , and on 12 april our case was updated from immigrant to non immigrant , and case creation date changed to be 12 april , as case last update

i did some research about these changes , and everyone said it was a good sign , since it is supposed to be the last step before issuing our visa , but since that time we are stuck , i tried everything , inquires from us , our lawyer and congress man , but the embassy always gave us the same automatic response " your case is under mandatory administrative processing "

any way i received my passport today and i will renew it

Hey bro. I'm in a similar situation, and I was wondering if your visa was issued. And also, were you given the Ds5535 at any point?

So i sent the embassy a letter asking abt the status of my husband’s case. Since it was approved already n ready for stamp. I got a call today staying that its still under administration processing cuz he renewed his passport so when they put his passport number in the system it tells them to do administrative processing.. this is what the officer said n he said it will take few months n to just watch the website for update. Im so sad and depressed because we had everything planned but it feels like we r just stuck n there is no ending.

I just have one question for everyone when u check the status does it say weeks or months?? Because before it said it can take up to weeks or months but it just says weeks n he updated it today.

Oh my gosh... That explains a lot. I am on the same boat as you. I had no choice but to renew my passport as it was close to expiring while my case was under ap. After getting a new passport my case was placed under administrative processing once more :(. I don't mean to be the bearer of bad news, but I submitted my valid passport 7 months ago, and I'm still waiting. I really hope the delay is not as lengthy for you :(.

My ceac says weeks too by the way.

Is your tourist visa still valid?

If so you could technically come for a short period of time. However I asked about visiting with a current valid tourist visa while in AP and the officer didn't recommend it as the border agent might think you are going to stay...

He also agreed that staying wouldn't make much sense but you still could get turned back.

I would advise against that. The odds of being turned down at port of entry are high, and I think it would potentially cause further delays with regards to the immigrant visa. Not worth the money and bureaucratic quagmire in my opinion.

Also @SabrinaJerome do you really think the social media handles are sent to Washington? I was kind of hoping they check them at the consulates...  oh man... The backlog must be huge,  since they're giving the questionnaire to the whole world... :(

ESTA was amanded a couple of years ago, I think,  to tighten security.

I really doubt that you are caught in the plot line of Bruce Willis thriller.

Like so many in this forum, myself included, your case is just undergoing a routine administrative processing. Some cases can take many months to get resolved.

    Hi,

My sister had her interview on 15th of Feb and was approved by VO . She has F3 category, five persons of family got interview call but her elder son went into army so he didnt appear in interview. Since the day of interview all four,s ceas status is in AP but that son was in Ready. One update on 21st and one is today but after today,s update they all five in AP.. What does it mean?? Are they working on his case too coz he wasnt updated before..

I'd give it a few more weeks before starting to worry. It's only been a couple of weeks since their interview, which is still within the norm. Were any of them given the form?

  11. Hi!

I'm no expert, but as far as I know, there aren't any restrictions for legal residents to attend college and earn advanced degrees.

You would be just as eligible as someone who is a citizen, granted you are able to pay your tuition. Perhaps, legal residents cannot benefit from certain public financial assistance programs, and you might also need to spend some time in your state of residence.

I'd take the time to do some research if I were you. But don't worry too much, and good luck to you.

The interview was last year in jan 2017. So told the officer to hold the visa for one year. So in november we got ds5535 but they never recieved our email. So we sent it by mail on feb 4 so lets c maybe they will do something now n approve our case inshallah

Oh wow, I'm sorry to hear that. Well,  getting ceac updates after submitting the form is definitely a good sign then. At least you know they've gotten it. And yes,  an update usually means that  somebody touched your file...  at least. But since you've said that you were already approved a year ago, I wouldn't worry too much if I were you. It could take a few weeks,  but your visa is on its way :).  Were you asked to submit a new medical exam along with your passport?
