If you filed a solid affidavit of financial support, they may just waive the interview. Most interviews for parents of US citizens are waived. My mother got her green card in the mail in less than 6 months from her priority date.

Actually I am not filing for her. My stepdad is. I just did the paperwork for them. They've been married for 7+ years, sent in sufficient evidence, imo. Do they waive marriage based interviews?

    Thanks for your advice.

We have to wait for another year for car insurance because we had a good deal under each other's parent's insurance shortly before both were married.

We don't have life insurance yet.

We just opened a joint bank account and made a small deposit. There is nothing much other than $300 deposit. Is it ok? (He makes enough, we didn't get a chance to make a joint account under mine or his). We haven't filed taxes, but my husband did a calculation, and we might just do married filing separately, because the state tax is such a mess if you're trying to file together.

I guess only thing i have is a joint account now, and maybe health insurance. would it be sufficient? Did you get a sworn letter from your husband's parent?

Yes, it was a well-written notarized letter. And the deposit shouldn't matter. What matters is that you are both sharing the account  and there is joint activity. Like purchases, both your salaries being deposited in the account etc. Just don't open the account to have it - ensure that you're both using it.

I think you will need more than just the joint account and health insurance. When do you plan on filing?

Why is that her only option when she wants a divorce? And when it seems pretty clear from what the OP describes that the husband only wants her money and is using threat of deportation to get it, and now the husband’s girlfriend has jumped on this bandwagon? Of course he won’t file for her, he loses his leverage over her as soon as he does that..... if she becomes legal they can’t threaten her anymore and then where do they get their money from? I’m sorry but she’s being blackmailed in a totally toxic situation. She needs to get out of it.

You're right. I read it as an ex-girlfriend being jealous or something. Didn't know the husband was in it too. Isn't there an option for battered/abused spouses of US citizen? I'm sure it'll be difficult case for her.

  8. I was in a very similar situation - living apart and married at courthouse. My interview lasted less than 15 minutes and was approved on the spot and got my GC a few days later. The IO didn't press. IDK, maybe we were just lucky, however, I strongly believe the IO just was able to tell right off the bat that we were a real couple. I would advise to be living together at the time, since that's safer and you may not meet an understanding IO like I did or at the minimum be able to prove that you intend to move in together in the very near future.

One thing I noticed is she gave us back our telephone histories, text etc - she didn't seem very interested in that. The bulk of evidence she took was mostly financial - insurance (car, life insurance, heath insurance etc.), bank statement, taxes etc. She also took a letter from my spouse's parents and placed it at the top of the file.

Also, you do not need a marriage certificate to open a joint bank account - just IDs for you both. Open it right away.

Your case is so similar. I thought we were gonna get denied based on what lawyers had told us and what I read on the internet.

I’m not sure if I misunderstood something in the OP but it sounded to me like the friend arrived on a visit visa and never filed for AOS thus is working illegally and has overstayed. She wants a divorce. It doesn’t sound to me like she has any option other than to leave the country?

Her only option is to have her US citizen husband file asap. And try to work things out and move in together, if they are able to.

Hello everyone! I haven't been here for a while, too busy studying:)

Congrats on all the approvals, interviews, new cards and other good news!

I got my EAD approval in the mail yesterday, now waiting for the card, yay!

My AOS interview was scheduled on the 22nd, hopefully the letter with all the details arrives soon.

How long does it usually take from getting the letter to the interview? Our baby is due in July, it would be wonderful to have this quest over with by then:)

Mine was about a month. Good luck!

  11. We had our interview today at New York City's Federal Palaza. About a year after we initially filed. We arrived at around 10:54 and had to race into thr building. Our appointment was 11:00. We barley made it, we were called as soon as we checked in. The immigration officer came in - a petite lady, very stoic. She appeared as if she was about to drill us. We walked to the back of her office and got sworn in. We did not have a lawyer with us. After, she seemed to be the nicest person ever and very friendly. However, our lawyer had informed us to not get complacement about friendliness. Her first question was what's the biggest personality  difference between my spouse and I. She asked about our future plans, we both responded that we wanted to further our education - she seemed pretty pleased with our responses. She then asked how we found our apartment. This is where we explained our situation. After, she asked why we decided to get married. She then took a look at pictures and asked us about it. She then said, where did we plan on spending our upcoming anniversary. She then took some documents for her file and gave us back the rest. That was pretty much it. She was very warm throughout the interview. It felt more like a conversation - we got in a few laughs as well. She then went through the standard yes and no questions and handed me a white paper letting me know that it is being held for review. I was kind of sad by this... Then she said it's standard procedure and everything is good for approval and I would be very happy because I was not going to get the conditional/temporary green card, and i would receive the permanent one in a few days. When we left she shook our hands and wished us the best with school and life. About 30-45 minutes later, I received a text stating that the green card was in orodictuon. My spouse and I were super nervous because we were living apart at the time of filing, however I believe she saw from the get go how comfortable we were with each other and the personal details we were able to describe to her that only a couple would know. All in All, we made a big fuss about everything and it lasted about 15 minutes and went extremely well. I would advise anyone to prepare for the worst and hope for the best!

Hi guys, I have been reading this forum for quite a while... Excited/Nervous that I haven't gotten any transfer/interview notice yet...

    Case Received: April 24, 2017

RFE for initial evidence (marriage certificate) - April 12

    Biometrics Appt: May 24, 2017

USCIS Received RFE: June 02, 2017

    EAD Approved: August 03, 2017

After that nothing. Is this normal? I live in New York...

My case status has finally been updated to "Testing and Interview." The interview notice has been sent out. Almost a year to the date they received my case.

The status says "Employment-Based" Interview when it's "Marriage-Based." Is that just a minor error or should I be concerned?
