I believe the instructions are clear enough that you have to have been married in the last three years to the same U.S. citizen and still married at the time of filing and adjudication.  Soon enough she'll be eligible for the five-year rule and you can avoid a lot of the three-year evidence.
 
I believe you're right that the timing should have been caught before being called in for an interview, but I don't think you're entitled to a refund. Being correctly denied doesn't mean you get the money back.

On the other side, it's very clear. Reformulating, or giving an opinion on what's clearly written in the instructions might bring confusion - we see it all the time.

Obviously, you are worried you're on here and debating with people when they tell you not to worry. He didn't get arrested so calm down and stop over analyzing it. 

Seriously... talking to police officers is WAY different than being stopped or arrested.
 
Please breathe and use some judgment - do not get anxious over nothing.

This article is not correct. It says that the Netherlands do not allow dual citizenship, while in fact they do, as long as the second citizenship is acquired as a result of marriage to a citizen of that country. I think it's always better to find this kind of information on official government websites, instead of random articles.
