    USCIS Moves to Strategic Data-Driven Approach to Waive Interviews for Conditional Permanent Residents

    Dear Stakeholder,

    On Thursday, April 7, 2022, U.S. Citizenship and Immigration Services (USCIS) announced that it will take a risk-based approach to waiving interviews for conditional permanent residents (CPRs) who file Form I-751, Petition to Remove Conditions on Residence. The Office of the Citizenship and Immigration Services Ombudsman (CIS Ombudsman) fully supports this change as it reflects one of the recommendations from our 2021 Annual Report to Congress.

    What Does This Mean?

    USCIS will no longer require everyone who obtained their CPR status via processing at a U.S. consulate overseas to go to an interview after they file a Form I-751.

    Instead, USCIS will assess if a CPR needs an I-751 interview based on whether:

    • There is sufficient evidence in the file that the marriage is real,
    • The CPR is eligible for a waiver of the joint-filing requirement (if applicable),
    • There is no indication of fraud or misrepresentation in the file,
    • There are no complex facts or issues that require an interview to resolve, and
    • The CPR does not have a criminal history that would make him/her removable from the U.S.

    Why This Matters

    In 2018, USCIS implemented a policy requiring mandatory interviews for all CPRs who obtained their status through consular processing. In our Annual Report to Congress last year, we found that this policy did not help USCIS to detect more marriage fraud cases. It did, however, dramatically increase processing times and backlogs. As a result, one recommendation we made was for USCIS to rely solely on a risk-based analysis for interview waivers.

    By adopting this risk-based approach, USCIS is working smarter. This approach allows USCIS to strategically focus its interviews—which take more time, staff, and resources—on cases where there is a question of fraud or national security. It will also help USCIS use its staff and resources more efficiently, improve processing times, and reduce its backlog to the benefit of all applicants and petitioners.

    Unfortunately, my husband and I getting a divorce he been in the states for a year this has been a nightmare..    I’m sponsoring him and marriage base green card will expire in March of 2023 he will need to have his conditions remove.  Once the divorce is finalized and the visa expires  will I still be sponsoring him?? I would appreciate anyone help on this matter.     @N & K I would suggest reading again the terms & conditions of the I-864. You are responsible to "support" him up to the federal poverty line for your household size - I think, if I recall correctly. You would also be responsible for paying back means tested benefits if he chooses to get those. Again, I am paraphrasing here. He would actually have to choose to live in poverty to even try to enforce the I-864. 

    Bottom line is that you are not on the hook to put him up on a condo overlooking the beach or supporting him 100%. Truth is it would not be very much money and he is way better off getting a job and being productive member of US society.

    The house we live in is mine, but the mortgage has my and my exhusbands name on it as he had to cosign with me otherwise I  wouldnt get the loan, so not sure if I should include this or not. 

     

    Do we include photos of my husband with our kids even though I am not in them? We do have few selfies of us from a date night we had for our anniversary. But thats about it. We honestly havent been anywhere, havent done anything, covid and newborn, now toddler twins and 3 older kids (mine) really make it impossible to do things on our own. Or just honestly do anything in general. Would it help if I wrote a letter explaining the lack of photos.

     

    Frankly, I am freaking out, we've been putting things off because of holiday and just general life stress and now I feel like we're running out of time. My husband is our sole provider and the prospect of his green card expiring and him not being to able to work is terrifying.

    Any help/pointers would be hugely appreciated.

    I would not worry too much about photos. I would definitely make sure that you include bank statements. I would include them all. That's what we did. Same for insurance, car loan, etc. Show the longevity of the accounts. Don't just include the most recent statements. They want to see as many documents as you may have available that cover the entire time you have been married.

    You can't show what you don't have. Just show plenty of what you have is what I say.

    This looks fantastic! You asked for feedback. Frankly, your submission is great as is. If I had to say anything, I would say that it may be useful to add "effective date" or "since date" wherever you can. I think it makes it easier for the officer to go through your file and establish if you covered the entire time span since the date of your marriage. You added it for some items but not all. :)

    Yes, that happens sometimes. I would keep calling. I would also reach out to your US Senator or US Congressperson ASAP.

    And so  what if you wanted to stay in the US? Who cares? Just bring your evidence and do not let anyone put words in your mouth. Officers ask questions in such a way that prompt you to respond. However, if you disagree with anything they state on their question, you must correct or clarify and THEN answer the question. :) 

    You're a highly educated immigrant. The US is LUCKY to have you.

    But the thing is, My husband and I are moving out of state on 01/28.

    We can definitely travel back on the 31st to do the interview (because I know rescheduling can delay more),

    but Our concern is, if we get approved on the same day, the green card will be probably mailed to the old address(Orlando) after a week or so,

    but Does Signing up for Mail Forwarding via USPS also forward the green card mail from USCIS, too?

     

    Honestly, I just want to get it over in Orlando for the 31st interview without the change of address on USCIS until we receive the green card,

    but I am not sure how we are supposed to receive the mail to our new address.

     

    Should we just request a rescheduling?

    You might want to ask if USPS Premium Forwarding service will forward government mail. I know I looked into it before but did not find a solid answer. It may take asking at your local post office. 

    You could also ask them if they will hold any government mail. I know they did this with my US Passport when I renewed it. 

     

    I'd say definitely attend the interview in Orlando. If the green card gets lost in the mail, you are still a green card holder and may request the I-551 stamp.

    Exactly how I feel but it is what it is. Our marriage is not legal in Malaysia.Thus, we will do as USCIS says. :)

    This is what the instructions state. I guess there will be plenty of overlap between the I-751 and N-400. And that is fine. We have copies of our AOS and I-751 filings. No issue there. :) 

     

    Evidence that you and your spouse have lived in marital union for at least 3 years at the time you file your Form N-400. Such evidence may include:

    (a)  Joint bank and credit card statements;

    (b)  Leases or mortgages;

    (c)  Birth certificates of children;

    (d)  Insurance policies; and

    (e)  Internal Revenue Service (IRS)-certified copies of the income tax forms that you and your spouse filed for

    the past 3 years (or an IRS tax return transcript for the last 3 years).

    LOL, yes, it is literally my bible. I used it as a template for our AOS and I-751. It has worked well so far. :) N-400 window opens up in February and will use it again. 

  11. @Mimoha Singh Do not let anyone corner you into saying that your goal was to be in the US all along. You did a masters, H1B did not work out, then did a second masters, applied for asylum and then met your current spouse. Whatever, just go through the motions and present solid evidence of everything. It may just be simple interview. If it makes you feel more secure, then see if your lawyer can suggest another lawyer from his/her practice to go with you.

     

    We brought a lawyer to the AOS interview mostly to ensure that we would be treated fairly. And we were.

    My husband and I have more new proofs to show for our interview.

    My question is, how is the I 751 interview, together or separated?

    Just to add to what others have said. Stokes interviews are not surprise interviews. They happen after a "failed" initial interview. Thus, they are second interviews. 

    I would focus on the money trail. This is a nice example of evidence you can have ready for the interview. https://www.visajourney.com/forums/topic/699699-i-751-march-2019-filers/ Notice how the applicant explained in full sentences what the evidence submitted is proof of. By doing this, there is no room for interpretation. You have to connect the dots for the officers. 

     

    ***One last thing, the officer may decide to interview the petitioner or US citizen first. Even if they interview you at different times, that is not a Stokes Interview.

    This might be overkill but I would suggest bringing a trail of documents that show her age progression. For example: bring all US passports she’s had or Bolivian ID’s she’s had since she moved there. 
    They may take you to secondary inspection to double check everything and that’s fine. After all, she’s been gone for 15 years.

    You’ll be fine.

    OP, if you sent copies of your passport, you should be fine. Just bring your passport with you. After all you are not a US citizen unless the department of state says you are. They won't question your US Citizen status unless you were born in a border town or a ranch or had one of those delayed report birth certificates issued to you.

     

    The list of required evidence gives you the option to bring any of the items listed. Passport is fine. 

  15. @Positive_Vibes sorry you had to go through that. Question, did you submit a detailed Table of Contents outlining each piece of evidence and explaining what the evidence means? As redundant as it may seem, it is important to tell USCIS in full sentences what each piece of evidence means and also break down the bank statements for them. 

     

    You will be fine, though.

    You can't "renew" a conditional green card that is only valid for 2 years. It seems like maybe you are referring to filing the 1-751 Petition to remove conditions. 

    You can "renew" non-conditional green cards with form I-90.

    We filed 5-2021, got the 18 month extension letter right away and about a month ago - I think- we got the 24 month extension letter. I would not stress out too much about it.

Well I refused to go to the 1st interview, he did something (rescheduled). After several months went past they sent him another scheduled interview letter for September of 2020...I again refused to go. Well since Covid-19 hit I'm pretty sure he told them one of us had Covid-19. I'm not sure what's going on now (the truth)...all I know he is trying to may mends and move back into our home. I'm not sure if he has received another appt or not...I don't believe anything he says. He has not received his 10yr green card and i do not know if his temp has been extended again. Do anyone have insight on something like this? H

    To add to what everyone else said, you could also let him know that he can switch his I-751 to a divorce waiver. USCIS routinely approves such cases. You two should file for divorce. He moves on and you move on. There is no reason to drag it out. 

    Advise him to create an account on this site and to ask questions.

    That is a start. Build up on that. Here is a nice example of a solid Joint filing. Use it as a guide. I am sure that you have more evidence than you think. The devil is in the details and explaining to USCIS in full sentences what the evidence means. Don't just send them stacks of papers without telling them what they mean. They won't connect the dots for you even if it is obvious.

    Make it three! The third group would be people that work at the DMV. I had the most horrible experience there. I went to renew my DL about three weeks before submitting my AOS. Of course, I had to take my passport. Once I left the office, I couldn't find it anywhere, so I went back to look for it. The lady at the front desk said that all documents lost and found go to her and "nobody brought me anything". I requested to speak to the guy at window 10 and she denied my request. Came back home and still my passport was missing. So I went again the next day and told them that I was not going to leave until they let me talk to the guy at window 10. Guess where my passport was?

     

    SSA is a joke. I called during the pandemic (right before they decided to open their offices for appointments that required a green card) and I spent nearly a month trying to explain to them what a green card was. There was no way to have them understand that that is a very important document and that I was not going to mail it. Period. So I just contacted my Congressman and he managed to get an in- person appointment for me. 

    Point is, I do understand your frustration. Ugh.

    Why is no one taking a GUESS??? I say WINDOW 10! All my money is on that! lol
