Actually, when they expunge a record they generally shred it.  Regardless, I got lucky and my Dad had the original order for expungement signed by the Judge and the Circuit Court clerk in a an old filing cabinet at his home.  That original record along with a notarized statement of the surrounding events of the charge are sufficient.

As an update, CFO never even looked at her birth certificate.  Only looked at her passport.

Embassy interview was today.  I attended and she passed.

Ok. It's time to rock and roll. You have everything that I gave you and so the record for completion from receiving the case number to walking out of the Embassy with an approval is 22 days. Think you can match or beat the record?

Yes I did and thank you.  I actually have gone through all of that info the last several weeks.  It's super helpful.

The only issue I have at this point is reconciling why my fiance has two different birth certificates with different birth dates (her official has an October 1987 date and somehow there is another birth certificate from her home town with a Feb 1988 date).  Might be an issue as her CENOMAR certificate has the 1988 date and doesn't match her official birth certificate.  I"ll put this post in the Philippines subforum as well.

Also note, people here figured out the pattern for when cases go into transit. If you get your case number soon there is a good chance your case will be in transit 8/21/2018. The NVC seems to mail out cases every two weeks.

Just relaying my timeline here.  NOA2 hard copy dated July 24 (website indicated 7/25).  NVC acknowledged over the phone it was received today (August 8).  Looking at other timelines here it seems a good number of folks get their case number the following day after NVC receipt.  Hoping for the same.

Can be quicker too.  I submitted RFE response on 7/17 and have NOA2 dated 7/24.

I submitted a signed cover letter and I also had to get a notarized statement which I signed (basically an affidavit) since one of the charges was completely expunged and there is no record that can be found now (including no police report).  The RFE letter required the notarized statement in the event court documents were not available.  I was lucky enough to find the original expungement order to include in the response.  Here is what my cover letter looked like:

    Dear Sir or Madam:

Enclosed please find the following supporting documentation for the two misdemeanor arrests I noted in the I-129F, Petition for K-1 Fiancé[e] on Page 9, Part Number 3, Item 4a and 4b:

09/1997 – Misdemeanor Arrest for Possession of Marijuana
Original Order for Expungement (signed by the Judge and the Clerk of the Circuit Court); Original Certificate of Compliance (signed by the Clerk of the Circuit Court) indicating that all court records of the arrest be expunged; Original Order for Probation from the case, indicating the suspended sentence of 60 days for the charge and six (6) months of probation; and Notarized statement detailing the events that led to the arrest, the arresting agency, the charges filed by the arresting agency, the final disposition of all charges with a list of the charges, the location of the Court and any punishment
08/1999 – Misdemeanor Arrest for Possession of Marijuana
Judgment and Sentence of charges; Amended Judgement and Sentence of charges; and Arrest and Booking Report (with narrative)

Please let me know if there are any further questions or concerns.

    Yours truly,
