    You don’t have to travel to US to prove domicile. If you search VJ posts you will see other ways. You either have to prove domicile or intent to re-domicile. Show evidence like

    shipping estimates, emails from schools about reigistering children, also tax returns you have filed for previous years, any bank statements you have form us bank account, voting records, drivers license. These are just a few ideas

    And I don't think it's a month. I was researching cases with RFE's and it depends mostly on how fast you reply to it. A month is a worst-case scenario. Usually, it's 1 to two weeks.

     

    Aside from that....

    It's a bad day for me though. My husband was here visiting and he is on his way back to USA as we speak :( I'm so depressed....

    We didn’t even send birth certificates. I didn’t think it was a requirement until the next phase after I-130 is approved. 

     

    I cant imagine doing the process living separately. We live together but I wil have to prove My domicile since I’ve been living outside then US.  We also have two children but I applied for certificates of births abroad and that was a much easier process. They already have their US Passports.  

     

    Good news that you have already made it this far! Hopefully 2 more months 🙏🏻

October are already getting approved, while very few before that are pending. Also, many cases have issues and get something called Rfe (request for evidence) they are the unlucky ones who will take a bit longer due to sending in additional paper work. Doing this helps me  see how far ahead they are and back they are. We should be getting approved as early as the end of May to as late as August, this is according to people from previous months.

    The USCIS is always a few months behind. They don’t update their records online often. Before thy changed their website it used to update as of a few months back.  

     

     

    Heres to hoping none none of us get RFE’s. I read it sets you back a month each time you get one.

    We are temporary residents of Poland while my husband completes some schooling here. We applied to process through Polish consulate but I’m still not sure if we will get bounced back to Canada because he has a Canadian passport. I’ve recently started to doubt the set up.

    My wife is an American citizen and we've lived in Canada since she moved here 4 years ago. She is going back with me, buf it seems that for all practical purposes, she needs to not only apply but also get hired for a future date that is not even certain (you cant know when exactly you will be there in the US). What employer would hire someone over the phone, and will be willing to give a job contract for a job that she will start in a month or so? We are moving to a small town in Wisconsin.

    We are in a very similar situation. I’m a US citizen filing for my Canadian husband. I’ve lived with him in Canada since late 2010. However I grew up in the US. I went to grade school and university there. So I have transcripts and lots of w4 and taxes returns. I’m wondering if that would be enough. I’ve maintained a US bank account there and I’ve previously file for certificates of birth abroad. 

     

    I think the job offer is just one example of evidence. Does she have anything else?

    I am also a bit unclear at which point I have to submit the I-864 form? Is that together with the I-130? Since as I understand it, I have to show gainful employment there, but, as I am currently working in Latvia - wouldn't they be looking for employment in the US?

    I am also a US Citizen. I filled for my husband and we are both living in europe together. I filed the I-130 and on that form I chose Warsaw embassy for processing.

     

    when it’s approved we will continue to apply for his immigration visa (green card) through consular processing. This allows us to stay together.

     

    i have two children with my husband who i previously applied for certificate of births abroad for them to get the

     Theo us passports ahead of time.

Later we should have copies of Ryan's tax returns where he will add me as a spouse and we plan for him to visit next year to meet my family in person. This should be count as additional strong evidence, right? He's in Clarkston WA at this moment and we sent I-130 package to Phoenix, Arizona. I am living in Sosnowiec so not that far away from you guys. Maybe we could meet at some point :)? Especially when Ryan comes to visit! 

     

     

    Well all anyone can can do now is wait and see. If they need more evidence they will ask!

  8. We live in a Kraków now but we were living in Canada for the last five years. (I am a dual citizen) 

     

    I know what you mean. I found this site after I already submitted everything and I read things other people were including and I was disappointed I didn’t. I should have included our rental contract. Also I sent my passport as proof of US Citizenship but only he photo and info page.

     

    i saw other people were sending copies of every page of their passport.

    Thats great! I found it such a weight lifted after I finally sent everything in. That lasted about 2 days then I am constantly thinking about the timeline now 😂 it will be a long 6 months. And I’ll be here too!

    Copies of each childs Certificate of Birth Abroad 

    Statements from joint bank accounts from various years some form 2010, 2014,2016

    Copy of Marriage License and Certificate from 2010

    3 Photos (one from wedding) others from vacations together

    Copy of Contract from hotel where we had a wedding reception stating we had 120 seats

    I-130 and I-130a Forms

    5 letters from various friends/family members giving affidavit of bonafide marriage

    2 Passport Size Photos of myself (2cmx2cm) and 2 of my husband even though it says it was not required at the time. 

     

    From reading other posts I was a little worried that I didn't include enough evidence. But I'm hoping the fact we have been married since 2010 and have two children will help us out. The only thing I wish I had sent were lease agreements and a copy of the sale of our house that is in both of our names.

    You have to apply for CRBA. I did this for my two kids over the summer at The US Embassy in Toronto. I found the process to be pretty easy. I was approved on the spot at the appointment and recieved the kids certificate of birth abroad and passports a couple weeks later. Now we are filing i130 for my husband

  12. Yes we applied over the summer through the US Embassy in Toronto.

     

    I made an appointment online and gathered the following documents:

     

    -long form birth certificates of kids (original or certified copies)

    -my U.S. Passport

    -copy if my high school transcripts from US

    -my US college transcripts

    -proof of work/income in the US (W2’s)

    -kids Canadian passports for identification 

     

     I believe that was it. I showed up for the appointment and turned in my documents and then I had to be seated and wait some more. They called me to the window to ask me some questions about living living in the US and about my high school mascot. 

     

    I was approved then and their CRBA and US passports cane in the mail a few weeks later.

     

    i included copies of the CRBA in my husband I130 package

  13. Hi Everyone.

     

    I just submitted my i130 petition for my Canadian husband. We have been in Canada for the last few years about a year ago we moved to Poland for my husband to continue his education. On the i-130 I stated I would like to do consular processing here in Warsaw at the US Embassy. Was I supposed to put Canada since thats my husbands citizenship? I was under the impression we could do it here since we are technically living in Poland for the time being. We are legally in Poland on a temporary residence visa/card while he completes his studies. Now I am starting to second guess everything I did. 

     

    Also I know this is a long ways away -- but are children allowed in the interview? My husband and I have two children together but no family to leave kids with here.

     

    I hope I didn't make a mistake!

  15. Hi! 

     

    Im also December filer!

     

    i just got my first email yesterday saying they recieved my application. It was only delivered to them on Monday (Dec 4) and updated with email Dec 5.

     

    my Priority Date (PD) is Dec 5 and my application is being processed at Texas Service center.

     

    I’m a US Citizen applying for my Canadian husband of 7 years.

     

    Also I’ll be applying for Green Card via Consular Processing as we don’t live in the US.
