Yes. Which is why it is an issue that the OP took the ill advice to not disclose the truth initially. Nothing to be done about that now though. The OP just has to know that he will have to reap the repercussions of making the original choice to sign and submit the DS160 which IS a legal document, untruthfully.
Yeah I really messed up, I thought cause I was a teenager and wasn't arrested/charged with anything that it didn't have to be disclosed. We're getting a lawyer to help cause I don't want to make anymore mistakes. Should have gotten one in the first place. I'm heartbroken that I might have messed everything up.

I agree with missleman. You will be answering the questions of your I485 at your interview under oath. It's too late to turn back now regarding the D160. Be truthful, obtain the necessary criminal records or a statement from the charging jurisdiction that their is none and submit photocopies of that. The I485 says if you are unsure of the question state yes and explain just as you have to us. Bring the originals to your AOS interview.
Yeah I'm definitely not trying to hide this, I was just stupid. Thank you for your answer.

k1, currently in the states, we got married... applying for AOS soon.. I hope.. but....
I am so worried that I really messed up. When I was 14 I got in trouble for underaged drinking (Canada, Ontario). When filling out the DS160 I went to the local cop station to ask them about the "Have you ever been arrested or convicted for any offense or crime, even though subject of a of a pardon, amnesty, or other similar action?" the officer told me to to say no, cuz I was never convicted of anything. I literally asked her a couple times because I was surprised. She told me I was a part of a diversion program, so from what I understand nothing ever went on my criminal record. (I've had so many criminal record checks done now, and they're all clean). However, she was able to pull up all the information in her computer system about me to find out about the information. Now here is what is freaking me out on the i-485 the question about ever being ordered punished by judge including rehabilitative programs/community service. I did have to go to court, and I did 20 hours of community service. So i'm fairly certain I should say yes to this question on the i-485? But now will I get in trouble for saying no to the DS160 question? Should I hire a lawyer to help? I feel like I NEED to clarify this otherwise it's going to eat at the back of my head for the rest of my life and I'm so worried for the AOS interview. Any help would be appreciated. I really hate my 14 year old self right now. And I really wish I would have said yes to the first DS160 question and just got all the records I could. 😥

Hello. Is there any way for someone to send me that automatic email? We have been waiting forever to get our passports. Thank you
what's your email? The only issue with the automatic email is that it has my name on it. You can just copy and paste the email into a word doc an take the name out. Thats what a lot of people have done here. It's so silly they're still not sending everyone the email.

Thanks, This whole process has been such a challenge to say the very least! I've emailed Montreal twice but just get a statement reaffirming that they won't ship anything. They won't even let me know if picking up is an option! When did you receive your email about pick up? Do I need anything, or can I just "show up"?
Picking up is an option. They have about four bins of packages. They won't ship anything out until the strike is completely over. You can email the Consulate and tell them you are picking up your documents for a certain date and to not ship out your documents and they will do this. When I went to get mine the lady had written on my package to not ship, that I was picking up. Just copy and paste the email into a word doc and print it out, or screen shot it on your phone, and just bring a piece of government ID. I was in and out in 16 minutes, it's a huge pain in the ###, but this strike could go on for a month.

Does anyone have a phone number for the US consulate in Montreal where I can actually speak with a human and not a recording? Me and 2 children had our appointments Sept 18. All was approved and went well, we received our passports/visas within 6 days. However my youngest daughter was somehow separated from us during processing and finally got her appontment Oct 16. So we flew across Canada from BC AGAIN for her interview. All went well, she was approved. But we still have nothing! I see that as of Oct 17 the Canada Post announcement on them not sending them out. Her status on CEAC says issued, as of the 17 but we still have heard nothing? I see that others are getting emails and flying to Montreal to pick up Visas? But I can't get any kind of response by email? Not sure what to do? I can't really just buy another plane ticket to "go check" but is that really what I need to do?
Hey there, I had my interview Oct 17th. I will say it is weird you didn't receive an email. I can almost guarantee it's still there if you haven't received a shipping notice with a tracking number, check AIS I believe it's supposed to update there when documents have been shipped. From my correspondence with the Consulate they will not ship any documents out until the postal strike is completely over. This is the generic email they're sending every one below.... the contact they list will NOT help you at all though with the postal strike, they will tell you to email the Consulate. My only luck with contacting someone is through this email, make sure to write your childs case number and name in the subject.... montreal-iv-dv@state.gov
Good luck and take a deep breath, you've come this far.. and you guys will make it though this mess!
We are contacting you in relation to your recent U.S. visa application.
Due to a possible postal service interruption we will be unable to ship your documents to you for the moment.
For this reason, we are offering you to pick up your documents in person at the time and place listed below:
- Date: November 6, 2018, from 10:00am to 12:00 pm
- Place: 1155 rue St-Alexandre, Montréal, Québec , H3B 1Z1
If you were issued a red pickup ticket, please bring it with you at pickup.
If you were not issued a red ticket, you must bring this email (printed or electronic) with you at pickup and present it at the consulate.
If you cannot make it at the given date, you are free to come Monday to Friday, from 10:00am to 12:00 pm
If you cannot make it, a friend or family member can pickup for you. They must provide the email or red ticket and a government issued photo ID at the time of pickup.
If it is not convenient for you and you prefer to wait until the postal services are reestablished, you do not need to take any actions. We will ship your documents as usual once the service is reestablished.
If you have already picked up your passport, please disregard this email
For any questions, please contact our official U.S. Visa Information services at: https://ais.usvisa-info.com/en-ca/niv/information/contact_us

So I read somewhere that DHL is handling the courier drop-offs, has that changed in light of the mail strike? Is there anything on the consulate page about that?
I'm not sure if this answers your question... but I paid for courier drop off at my home address and the Consulate is holding my documents till the strike is over.
I am on my way to pick up my documents for Tuesday. So they better still have them lol. No amount of calling or emailing has been any help what so ever.

We filed Dec 4th 2017 and I will be moving there November 12th 2018, this is for k1 visa

This might not help you... because it's for Ontario... but I was able to access my records here https://sdhu.icon.ehealthontario.ca/#!/welcome .... depending on your province you have a website similar where you can access them... I would call your local Public Health centre and see if they can get your records for you.
I also had a checklist form the doctor that I had to take with me to my clinic to my have my doctor sign off on. (Td/Tdap, MMR, Varicella, and the flu shot) were all on this checklist
The visa doctor will need to see your immunization record, so I highly suggest you try your best to get it because it will make the ride a lot smoother. Good luck!! My medical exam was fairly easy in the end, so just make sure you have the right paperwork and the rest isn't bad at all!

So I took a red eye last night from Vancouver -> Montreal and was able to pick up my passport + visa package!!
After checking in at the door, I was sent upstairs to a window where a lady asked for my ID.
Lady: Ok I'm going to go look for it now
*finds my stuff*
Me: Have things been crazy because of the Canada Post strike?
Lady: Oh...you have no idea...
So yes, second confirmation that they are holding our documents until the strike is over and they are very backed up. I'm not sure when the strike will be over, so if you do get the chance to pick it up, definitely do it!
PS HUGE thanks to @MariahK ❤️
No problem!! Happy you got it! Looks like I'll be heading there soon too lol..

Did they say anything to you about the strike? Normally anything past 5 days is unusual. However, cuz the strike they're keeping all the passports. Make sure to check the CEAC website for your updates on when your visa has been issued.

I still wonder why would Home deliveries be impacted since they're not through Canadapost I assume
I know!! It's driving me nuts. Nothing make sense. I'm so mad at Canada Post lol they just need to agree to their workers terms so we can move on lol! 😲

Maybe? But if passports were mailed, wouldn't we have gotten a tracking number via email? Who knows...they could be a mess LOL
Yeah! I don't think anyone can retrieve passports unless they have the email with their name on it. Maybe they are setting up pickup for home deliveries first before mail couriers?
Yeah, I would assume you would. So it's so weird. They're just a mess lol.
That could be possible, since we did pay a fee for it. But I don't know at this point lol! 😢

That's what she said. They are going to send us dates via email for pickup. @MariahK got an email twice regarding her pickup.
Honestly, I just want my passport back so I'm actually considering flying from Vancouver->Montreal to retrieve it.
If your ceac says issued and you haven't received an email regarding the pick up date (they also state they will ship the passport out once the strike is over) I would honestly think they might have mailed it... because that is weird. Unless they really are just a mess lol.
You need to have the email to be able to pick up your passport, otherwise I don't know if they will give it to you. (Mine only has my full name on it, no other personal information). So I wouldn't make any plans to fly out yet lol!

My sister and brother in law drove me down almost a year ago now with all my boxes in the back seat with me and my cat and the truck full. I did make an itemized sheet but they never even looked at it. Nor did they look at my cat. I mentioned her and they said yeah that is fine long as you make sure she has the shots she needs for Colorado. The only reason we were 2 hours at the border was because I went through the 24 hour port at the Peace Garden and they hadn't done a k-1 visa in years and had to call to find out how. LOL
Oh wow, two hours lol! We're going through Sault Ste. Marie, in Ontario.. I know they've done at least one k1 visa lol! I'm going to make a vague list of items just incase. Did you have to pay a fee to enter?

To add to my previous post...was anyone informed of how they would pick up passport that was supposed to be mailed? I'm waiting to hear back from consulate via email.

I had my interview the same day. Which province are you from? I'm in Ontario, and it seems like the strike will only effect a couple provinces this week.

I took a uhaul full of furniture etc. You can move all your things at once. Just make a general list.
Example:
Box 1 - books
Box 2 - clothes
Etc...
Thats perfect, thank you!

we did it the other way moving a daughter to Brantford 2 hours west of Toronto
took our small motorcyle trailer full of furniture she boought here
no one checked it at the niagara falls location but we handed them a small list of items in the trailer
since Canada was now legalized pot i would think they could be checking for that now to make sure none is coming in here / maybe not
Yeah that would make sense, I don't smoke it anyways so no worries there lol! Thanks for your answer!

You can make a general inventory list covering the big items, you don't have to list every shade of lipstick unless you have nothing better to do with you time. I have never heard of any so called limits on how much you can bring ( But I don't suggest a 53' tractor trailer) from what it sounds like you only have a truck bed full of items, so no big deal. Check the CBP website for a list of any items that must be declared ( Firearms/ ammunition, etc.) and make sure you mention those and have them available for inspection. They understand you are moving your whole life to be with your fiancee, so they are pretty reasonable to let you bring your life with you especially on a K1 visa where you wont be traveling back for about 6 months. Sounds like you will be fine... But those teddy bears may be suspicious.... LOL, just kidding.
LOL! Yeah I think I will only have about a truck bed full, and maybe fill the backseat lol! Thank you for the information! I tried googling it, but it's all just general information it makes it confusing.

I'm trying to figure out what/ how many items I can bring with me when I move to the states. For some context, I am k1 Canadian, moving to the states (Michigan). My Fiancé's parents and him are planning to come pick me up when I get my passport/visa back. My issue is that my mom refuses to let me keep anything at her place so I would have nowhere to store items. I really only have clothes, a couple of shoes, bathroom care, makeup/perfume, a couple nicknacks, camera gear, two computers (desktop/laptop), large printer, two-ish boxes of books, a couple of purses.. and a few teddy bears lol.. I have a desk and a side table that I would like to bring, but I'm worried I won't be able to.
From what I read, you have to make an inventory of household items (desk, side table) and price them... But I don't understand if you have to list and price every single piece of clothing and personal items (make up, perfume, etc..)
Any information would be helpful!

Had my interview today for k1! I only gave the lady my Privacy Act and there were no issues at all! At this point, I wouldn't worry about getting any other criminal record check and just get the Privacy Act. Mine had no picture, no fingerprints (says they were taken and destroyed), no seal.

Good point...sorry I didn't read more carefully!
So, still confused (but now in a different way) because I wasn't aware that there was a regular police check with fingerprints..? I thought that any check with fingerprints has to be mailed out to Ottawa (or sent electronically if it is through the Commissionaires/Morpho) to be processed through the RCMP? (i.e., the only finger print checks that are in question for our purposes are the Visa/border crossing request category, or the privacy act request category one)
All this talk makes me wonder a little bit whether they even know what they're supposed to be getting, at the consulate/NVC, and if they're all in agreement on what they're accepting or not.
No, you are correct! I got my fingerprints done at my local police station then mailed them to Gambit ID and they sent the request to the RCMP. I then chose to have the RCMP send the check back to Gambit ID then to me (sorry if this confusing lol!). That was for the "visa/border crossing..etc"... I just happened to the in Toronto then went to the Commissionaires and got the Privacy Act check done then it was sent directly to me from the RCMP.
It seems like all different police checks are being accepted, so it's frustrating. I have my interview Wednesday I will only give them the Privacy Act one first and see what they say.

I just stumbled across this forum, I am a k1 visa applicant.
what exactly did you guys ask for when you went to get this done? I read this whole forum and am still a bit confused.
Am I asking for both certified (for visa/immigration purposes) and non certified criminal background checks under the privacy act with the RCMP?
I don’t mind paying the extra I assume as a k1 it might be easier cause we just bring everything with us id rather be overly prepared.
Yes I would still get both the certified criminal record check with fingerprints that states for immigrations purposes and the Privacy Act criminal record check. I got my certified criminal record check through Gambit ID and then I went to the Commissionaires in Toronto to get my Privacy Act check done. (Although you could probably get both through the Commissionaires) The certified check took a couple of weeks to get and the Privacy Act took 9 days to get.

Hoping someone can shed some light on this.
We've had interview schedule for Oct 17th for a while now and had already obtained the name based police check. After getting word that we would need finger print version my fiancee went back on the 12th and we still haven't received it even though the office that does them says they mailed it. She went back again yesterday and had another done and now we're sitting hoping that one of them shows up before we have to fly to Montreal for the interview.
The consulate said, "The applicant may still attend her interview appointment even if she is missing documents. The Consular Officer processing the case would provide her with the appropriate instructions regarding missing documents if necessary." When I emailed asking about the change since we weren't aware of it. We still plan on attending the interview for the scheduled date because the next available for a reschedule is another 3 week wait.
If she is denied at the window, will they just require that she submit the correct version and then passport back to her with the visa issued?
We've done all of this without a lawyer and haven't made any mistakes to this point so showing up to the interview without the correct document feels like a failure.
Any advice would be helpful.
Thanks
From what I understand they probably won't deny her, but rather her visa will pend until all the proper documents are received (they will keep her passport I believe). I asked the consulate pretty much the same thing and they said you can have the proper documents couriered to them after the interview date if needed. Also my interview is the same day, and we haven't gone through lawyers either. Best of luck!!
