    There is no mention either you or mom filed I-130 for him…so is there any intention of actually moving to the US?? 

    Not sure what OP is, but yes her husband is my father.  We could not apply for him because he is still employed and has not retired yet.  He will be joining once his employment is terminated.

    She needs to file I-131   

    I don’t know  what happens to her petitions when DoS concludes she has abandoned LPR status but by law only an immigration judge can take her LPR status. 
     

    She needs to establish domicile or convince DoS she will have domicile  before the beneficiaries can be DQed and she needs to either accompany the beneficiaries to the USA on their immigration visas or precede them.  
     

    I am seeing a lot of moving parts and risk.    I suggest that once NVC takes over the cases, that she move back to the USA.

    I think I will have her apply for an I-131 and then we will see.

     

    She plans on moving in once all her children get their LPR.  At this time, she cannot live in the states alone for medical and cultural purposes.  I don't live in the states either to support her (Foreign Service).

     

    As to her child under 21, we were hoping he could make it first and then she can live with him until the other ones get their turn.  He was born in July of 2003!  Right now, according to the processing times of his I-130 which is currently sitting at California service center, his wait time is 2 years.

     

     

     

  4. Hello friends,

     

    My mom applied for her 3 children under her IR5 status.  She is currently in the States and the three petitions are pending now.  1 of the three children is under 21, but will age out next year.  I am assuming he is protected under "child protection Act" if petition is not approved before, correct?

     

    Also, my mom cannot stay in the US as she needs to be back with her kids and her husband who is currently still working.  What is the best option for her to avoid her residency abandobnment?  I was thinking about submitting an application for re-entry permit (I-131).  Thoughts on this?

     

    In the event that her residency was abandoned, will the petitions be dropped, or could the children still continue their immigration process?

    Is this something requested for the interview, or during the NVC process as an upload?  According to the link you shared, they are listed as pre-interview.  I'd like to time everything, so I am hoping to get a sense of when this is needed based on your experience.

    you can gather your IRS transcripts now for 2019 and file taxes ASAP so 2020 are done as you will need them

    the 2 criminal reports "fiche anthropomtrique" and "; Court record (casier judiciare) " with the English translations but one of them expires in 90 days so do not get them untill  asked for

    Though, I have a question; Do we really need two criminal records?  Based on their requirement, it seems like the court record is only required if convicted of a crime.  Otherwise, only the police record is required (which expires in 90 days).

    2nd is paying DS-260 fees, When you complete the DS-260 form after paying fees, it will take you to civil documents like birth , marriage certificates, passport size pic, NVC website specifically asked it is either you or your parents documents to be uploaded. Thanks

    Sounds good.  Well, now their current case creation timeframe is Jan 31st which is not bad at all!  I am guessing it only takes a few days before we receive a NVC case number!

     

    Did you get a chance to work on the required civil documents?  I am not sure what they mean by that!

    So, your case was approved Dec 15 and got a NVC profile on December 20?  According to their website processing times, they are a few months behind!

  11. Just a quick update here that the case was approved today (From Texas Service Center).

     

    My online status changed to "Case Is Being Actively Reviewed By USCIS", but in the documents tab, there is the approval notice.  Very strange!!!

     

    Now the wait begins for the NVC and the US consulate.

     

    Please share your timing as you go through this so we can get a sense of how this goes from the DoS perspective.

    No appointment, nothing!  The officer asked if I have an appointment, I said no and that I just had my ceremony.  He was ok with making the order then.

     

    Same building, same floor, except different office.  This is the office where they do interviews and stuff.  The ceremony is held in a different room.

     

    As soon as you finish the oath and have your naturalization in hand, head to their main reception office and tell the front desk person that you would like X certified copies (they are free).  If they asked about an appointment, just say "I just finished my oath and got my citizenship".  They should be ok with that (they were for me!)

     

    You will wait some time as they make copies (About 15-20 mins), certify them in the system, press them, and then stamp them.  You are good to go then!

     

    Fun fact if this helps anyone regarding social security.  I used my passport card to update my social security.  Sent it in the mail and was returned to me few days later.  They updated my record to a citizen.  Worst case scenario, card gets lost, I only have to spend about $25 to get it replaced versus the whole naturalization or the passport book which will cost a @*#& load of money.

    NVC Case Creation: May 14th, 2021

    IV/AOS Fees Paid: May 15th, 2021 (Currently in process)

    Congrats!!  That's Awesome.

    I hope that's the case.  It seems like your status was changed immediately after you applied and it took about 3 months before it got approved.  I hope it is not the case with me because I waited 3 months already.

    It is bizarre because my online status showed that it is Nebraska, but the notice came from Potomac.  Exactly like @zcorner19's case.  You can never know where your case is according to these changes!

    I just hope this whole process goes as fast as everyone hopes for.

    Thank you and keep us posted on any updates especially when you get to the National Visa Center.  We can learn a lot for each other's experiences.
