When the LPR lies, and CBP cannot find any exit records, or entry records from CBSA or the Federales about an exit less than 181 days ago, it can start going through the phone. Lie is then caught. Lying to a fed is a felony. I-407 time if CBP is feeling generous.

All CBP has to do is hire officers with IQs of 110 to catch most lying LPRs.

Thanks for your help Mike, got interview notice today. You and @OldUser really helped a lot.I truly appreciate it

    No doubt.

But it would be interesting to see how what % of Nigerian i130 spousal cases follow that mold.

You’d be surprised to see how many of us are genuinely married in good faith.Try to learn more about the diversity and from what particular region of Nigeria the fraud cases are emanating from before throwing the hammer at an entire nation.I rest my case sir/maam

I’m cynical about Nigerian GC cases now.

Just about every Hackinglaw episode has a Nigerian get an F1 or B1/2 visa while married.  Arrive in US divorced.  Then marry USC.  Divorce.

    Lather, rinse, repeat.

You are entitled to your opinion.Nigeria is the most populous African nation. It’s considered high fraud because of some bad elements. There are more honest Nigerians out there.56% of black doctors in USA are Nigerians. You can’t pick out an entire country and assume everyone is dishonest.

I'd file WoM. As @Mike E said there's a great chance IO may be hoping you'll give up once all the extensions etc run out.

I wouldn't be surprized if N-400 interview results in "Decision cannot be made" due to pending I-751.

From what it seems, it's worth getting I-751 resolved to unblock N-400.

Is congressional enquiry a good idea before WOM?

I have a friend same situation (weird they are from Nigeria also and had to switch to divorce waiver). She filed one month after my husband which was June 2018. She just had her N-400/I-751 interview 2 weeks ago. Yes filed in 2018.
There's was filing  I-751, getting divorced. moving from one state to another, transferring case. But finally after many e-request finally. Still not approved still waiting for I-751 to get approved. It's like it's stuck like yours. Hang in there. Hope you don't have to file WOM.

Wow! I hope so too.Thank you

@Slim213, no more travels for now.

Writ of mandamus with good law firm.

Lawyer that filed 1751 collected $3500 and doesn’t even bother filing for an enquiry.Applied for citizenship in April. Was thinking I should wait a little before going for the WOM.I was planning to travel out in two weeks time, thanks to the contributions here I’m reconsidering it now .

    LOL huh?

Those with pending I-751s whose cases get denied while abroad can be locked up on return to the U.S.  Depends on the CBP station. It definitely puts the Conditional back into CPR.

Makes sense now … The LOL wasn’t meant to be in a disrespectful way,I apologize.Thought if you did the right thing and followed the proper channels you are good to go

  8. 1 minute ago, Mike E said:

I-751 is not a priority. Divorce waiver cases even less so.

You have enough going on that someone at USCIS might be hoping you just give

up, or maybe they are waiting to see if you leave the U.S. on a trip, deny you then, and then hope CBP locks you up.

I have traveled overseas over 5 times and never had issues returning with the 48 month extension letter.I haven’t done anything wrong, have maintained legal status, followed all the right channels, never done anything illegal.I don’t see how I’m gonna get locked up just like that LOL

Switching to divorce waiver likely increased processing time and difficulty of this case. Also, any chance your ex wrote something bad to USCIS about you?

Highly possible. She was schizophrenic, tried to get me back for almost a year.Apologizing incessantly but it wasn’t healthy as it became abusive. Her dad and siblings wrote me Notarized affidavits stating the abuse (which was included in the divorce waiver application).Have video evidence of the abuse plus audio of her stating if she can’t have me no one else would lol

    - Were you in status when you applied for AOS?

    - Did you have prior marriages in Nigeria? If yes, were you divorced properly?

    - if you were married in Nigeria, did you divorce soon after getting visa in passport, before coming to the US?

    - Were you single in Nigeria, but in visa application said you were married?

    - Are you married now living with your US citizen spouse, or are you divorced?

    - Did you ever seek the asylum in the US?

All of the factors above can affect the speed at which I-751 is processed.

If none applies, maybe it's bad luck and you should consider Writ of Mandamus.

I was on F-1 and switched when I got married. 2 Never stated married because I was single 3 Never seeker asylum 4 I am currently divorced and switched to waiver as shown in the application 5 I am currently divorced .Thanks for you input

Oh wow good luck for your interview! So you were denied your AOS? If you were, did you appeal or motion to re open etc? Did the Senator enquire for yourselves?

    Thanks in advance!

No,I wasn’t denied but got an E-mail saying we missed the interview. The interview was rescheduled after the senator intervened and USCIS found out the mail was returned as undeliverable. Thanks and goodluck to you too

  12. I understand your issue and went through the same.I moved to a new address in August, changed address two weeks prior to my move and got a confirmation letter.Made several service request why my case is delayed not knowing the interview letter was sent to the old address yet uscis kept sending me responses to the new address saying they will respond in 60days.Waited but didn’t get a response so I decided to contact my senator. That was when it was found out we missed our interview in aug.Our new interview is rescheduled for tomorrow the 26th.P.S the recent interview notice was still sent to the old address but was forwarded by usps this time around.Goodluck

Bros, se na when you die you get the GC? Follow advice, either you file for VAWA or ask your senator/congressman to help look into why your case is taking long. We know you care for this woman and love her, and by the way, her mental condition is already on record somewhere, so trying to prevent abusive record won't cut it. Think about the kids and your own safeties.

@sweetadams,thanks bro..I no wan Die o! Recently contacted our congressman. They promised to respond as soon as the immigration get back to them. Thanks Bro

Sounds like you have a long road to travel if you want this marriage to work out, and it doesn't sound like it will get any better. Abuse is not something that should be tolerated, ever. She has absolutely no excuse for abusing someone and you shouldn't put up with it.

@javadown2,Thank you.I’m safely out of the house at the moment.I am just confused on what route to take at the moment that’s why I appreciate all the kind responses I got here. She’s been apologizing since yesterday but I won’t fall for it.I’m taking the good advice I received here on V.J

Sorry for your situation but this is an immigration forum not a marriage forum.

If you are asking what effect leaving her will have on your pending AOS this is the right place to ask but I think it is inappropriate to be discussing your marital problems here with a batch of strangers.

If you divorce her before your case is decided then you have no basis for a green card. Basically you have a few choices;  you either stay with her and hope she takes her meds again or you divorce her and try to get a green card with VAWA , i am not sure how the USCIS views abuse by someone mental issues.

From what you describe this is a dangerous situation that you need to get out of ASAP.  A green card or love is not worth your life .

    what is your objective here?

To get a divorce or to preserve your immigration status?

Mcdull,Divorce is my last resort sir.At the same time living here without a status itself is hell.I’m posting here for the best advice because some people went through the same situation. She’s been apologizing since yesterday but i’m Scared to go back
