When they enter the U.S. on their tourist visa, will they tell the truth to the CBP officer and say they plan to file I-485?

    Yes of course

It is fraud to enter with the intent to adjust status.   You need to petition them-  there is no work-around for the queue.

Oh ok thank you! I definitely will petition them through the consular processing then

  2. I think I found the answer. I’ll post it here for those who may need it from the USCIS website:

When completing Form I-130, please make sure that you (as the petitioner) select only 1 option when indicating that the beneficiary intends to apply for adjustment of status inside the United States or will pursue visa processing abroad. If the Form I-130 is still pending with us and you want to change your selection (to either consular processing abroad or adjust status in the United States), you may contact the USCIS Contact Center and request a change. If you want to change your selection after we have already approved the form, you may need to file Form I-824, Application for Action on an Approved Application or Petition.”

  3. Hey everyone. I have a quick but very urgent question.

I am a USC. I’m looking to petition my parents (who would not be presently in the US).

I know that since they are not in the US I can file the I-130 (consular process). But let’s say that after I have filed it, they enter with their tourist visa which they already have. Once they have entered, would I be able to then file the I-485 to adjust their status OR would they have to go back to the country they were in when I filed the I-130 and wait for the process to be finished there? (and basically never file the 485)?

In other words, are petitioning from abroad and the AOS process mutually exclusive? Like once you choose one way you can’t do the other? Or can a person change their mind throughout the I-130 Consular Process route and Adjust Status with the I-485?

Simply put, do you have to pick which route to go with (either I-130 or I-130 + I-485) from the very beginning?

I would really love some insight on this question. Please let me know if I should rephrase it or if I didn’t explain myself clearly.

  4. Hey guys. I have a quick question.

I've been preparing for my interview, and I noticed on youtube videos and a couple of forums that people mention a "vocabulary list." So far I've just been studying the civics questions (my test will be the 2008 one) and I haven't seen anything about vocabulary questions on the USCIS resources/study materials website.

Now I'm getting a bit nervous and starting to overthink. Is there a vocabulary list I'm supposed to study from or something? I thought it was only the civics questions, a reading test, and a writing test.

Help! 😮 My interview is in two days haha.

Wow congrats!! I hope my interview goes as good as yours did. So you said no same day ceremonies, did they tell you how soon the ceremony will be, like a month or more? Also that was funny about the officer asking you that, what did you say? Again, congratulations!!!!

    That was superrrrr Fast.

I'm in LA too. Can you mind sharing your residence date since?

You said you filled early..Is it 90 days prior to your residence anniversary date?

Thanks so much and Good luck to you. You are almost done bro!

Thank you! I was approved for the 10 year green card on 8/21. I was on the conditional card before that.

Yes, I filed within 90 days before the 3 year anniversary of my conditional green card which would be sometime this upcoming November. (can’t remember the exact day right now) , Thank you again! :)

I’d be fairly sure the bio notice is automated by now - the system probably searches for a uscis bio done within the last x years and reuses if so. I can almost certainly guarantee that no-one was actively reviewing your case on a Friday night. FYI, my n400, and those of my spouse and over 18 child,  were all being “actively reviewed” for over a year between bio and interview notice. I think what is actually means is, your application has been placed in line and we’ll get to looking at it when it gets to the front of the line. Hopefully your FO has a shorter wait time than ours.

Ohhhh that makes so much sense, since my Biometrics for my removal of conditions was done in January this year, so very recent. Thank you, I never even thought about it. Thank you!

Hi Vickrd, I remember you from October filer. I guess it's a good thing, unless they have an automated system that send everyone an notice whenever they received each application, I'm eligible to filed for citizenship next month marriage based...do you mind sharing what documents you submitted with your application please?

Junior818!! So glad to hear you’ll be filing soon as well! The process was relatively simple. For the evidence of marriage, I submitted tax transcripts, lease agreements, lease insurance, old and new drivers licenses showing the two addresses we’ve lived at, and bank statements checkings and savings. All for the past 3 years. I believe this should be enough but I will be bringing more evidence to the interview so that if they want to see more then they’ll be able to.

Also, be careful with the online application. Make sure you check that all your documents are uploaded right before you apply, instead of uploading them and then logging out and then logging in and thinking that they’re still there, because sometimes they won’t all be saved. It’s kind of wonky.

If you realize you have forgotten to submit a document after you’ve applied, they have a button in “my cases” called “unsolicited evidence” where I believe you can upload it. But try to do that as soon as possible because there’s a chance they won’t see it in time if you submit it later on. I unfortunately forgot to submit my latest lease agreement and I will be submitting it that way tomorrow once I get it from my landlord. I think it should be fine because it’s only been a weekend—I applied two days ago… I don’t think they’ll be checking my application anytime soon. That’s why I was worried when I saw “we are actively reviewing” because it was like a saturday morning on a holiday weekend (yesterday) and I was like NO! I still have to submit my forgotten lease agreement! But I think it’s probably like you’re saying where it’s just an automatic kind of thing, so I think it should be fine to submit it today or tomorrow.

Thanks for your reply Junior818! Hope this info helped :)

  9. Hello guys, I couldn't find the September 2021 thread... if anyone can direct me to it that would be amazing.

    I have a quick question,

I filed online last night, marriage based. A couple of hours after I filed, I got a notice online saying that my biometrics were reused, and that my case is being actively reviewed by uscis. I filed late at night so I woke up today Saturday very confused as to how could they do this so fast... especially on a friday night.

Is this a good thing, and should I be excited? Or is it just an automated message...?

    Thank you

Edit: I posted this as a topic on the n400 forum but got no answer so far...hope that's okay that I post here as well

  10. Hello guys, my question is kind of simple.

I'm filed online yesterday marriage based. A couple of hours after I filed, I got a notice online saying that my biometrics were reused, and that my case is being actively reviewed by uscis. Keep in mind yesterday was friday night when I filed, so I woke up today Saturday very confused as to how could they do this so fast... especially on a friday night?

Is this a good thing and should I be excited? Or is it just an automated message...?

  12. Hi everyone! I’m also a WAC case. I filed on Oct 28th, haven’t gotten biometrics letter at all yet. BUT today I just got an email notification about my case being transferred to another office. I will get letter in the mail soon so I hope everything’s ok. It’s just weird to me that my Biometrics haven’t been processed and my case was still transferred.

  13. Hey guys!

I just got an email saying my case was just transferred to another jurisdiction! I hope this is good news?

It doesn’t say to which center it was transferred to though, I’m assuming I’ll be getting that info in the letter...?

Also something weird, I still haven’t gotten my biometrics notification at all, so I’m not sure what will happen next haha.
