    Ooops, my bad! 🤗 So as far as I have seen from our fellows AOS June fillers, was one interview squeduled to (if I'm not mistaken) August 15 (crazy fast right)...one lucky couple!!! Some have the case ready for an interview but no other updates...as far as I'm concerned, my EAD and AP get been pushed further away every time I check here at VJ.

    In the state of Florida, the marriage certificate only have the maiden name but even though all my documents have my maiden name, I filled the petition with my husband's last name as this is the name that I'll use and my maiden name in all of spaces provided for it, this way I'll have my Green Card with my married name (which is the one I want to use for ever 😊) and this is going to make easier for me to register my marriage and change my name in my home country. Beside, why would you filled with maiden name to have it changed afterword? It could take more time than expected.

    When filling my forms for AOS I could not remember the dates of my formal employment or the exact day that I moved in or out of places, most of the forms have a place for you to put "additional information" so I put a date that would be approximate and in the additional information part I stated that those where accurate regarding month and year, but that I wasn't sure of the exact day that they started/ended. So far no RFE or RFIE, many that filled even after me have got those.

    06/26/2017 Biometrics appointment in Riverside, CA. Interestingly, i read that a lot people wrote that their biometrics appointment places were empty , 5- 10 mins for in and out. but mine was about one hour. in lobby area there were about 100 people...No security check, maybe because of too many people. So for the people who will have their biometrics appointment, please be arrived earlier, coz walk in and out for 5minutes is not for all the places.

    07/05/2017 RFIE response received by USCIS NBC.

I really think that your enrollment in college and the fact that you are traveling with your boyfriend is enough evidence, I only listed the other things to exemplify the kind of things that they expect you to have, I mean sound crazy that someone will leave college half way to be here illegally and I believe that the consul will feel the same way, I just think that you have to bring anything that you have, the idea about the transcripts that @Coco8 gave us also very good.

    What do you mean you "didn't received anything"? Not even the acceptance letter? Do you have your case number? Did he do his biometrics yet?

    Just a little history about my replacement of Greencard. 

     

    When I came to the country, USCIS sent my GC to my spouse's previous address despite updating the address online about 2 months prior to the mailing date of GC. I tried to apply twice with a fee waiver suggested by the USCIS officers on the phone as it was their mistake. However, they terminated my application because of the fee waiver. So in August of 2016, I reapplied with a fee. Yet, I haven't received my GC but I was able to travel twice with a stamp on my home country passport with no issues at all.

     

    With all that time taken back and fourth applying for replacement of GC, I should be eligible for my N-400 by late October.

     

    Questions:

    1. Can I apply for N-400 without a physical GC?

    2. Keeping the current situation in mind and sudden changes in immigration rules, do you think it is still safe to travel with a stamp?

    3. Also, Can I travel to Pakistan for my sister's wedding in December while my N-400 is pending?

     

    What are my options?

    Advance parole may be a good idea (if possible in your case), but I don't know how it work with a Green Card.

    As I said before, there are no documents or conditions that would guarantee that the Tourist Visa applicant won't use the visa to immigrate and stay here illegally, but the chances of it happening are much bigger if the person have absolutely nothing to lose in their home country. But you're right, it all depends on the situation, I have a friend that is a business owner, with a great financial situation and has her Tourist Visa denied, in the other end you have someone like me, that only had a good job and got approved very easily....but nothing take from my mind the thought that the letter that my fiancé sent me stating that he would be responsible for me and that he would make sure that I would not over stay my visa or be a burden for the American government or its citizens had a weight in her decision.

    Each case is different and I hope she can get her visa as easy as I did!

So you should write down " yes" and there is a space below on that same page of the application where you can describe what happened and when and the cost of ticket and that it was paid. I would include a copy of payment , a copy of your driving record too and when you go to your interview take the same items. And yes I know that you aren't supposed to send in any documentation if ticket was less than $500 but I think it will just lend to a smoother interview etc.

    I don't think there are any documents could "prove" that the person will go back, but a job, real estate property, money in the bank, enrollment in school for example could give the Consul the sense that this person will come back to all of it as opposed to someone that try to get a Tourist Visa with no money, no job, no possessions or any other things that could possibly make this person come back.

    It's funny because when I was applying for my Tourist Visa, the American Consulate in Rio de Janeiro actually suggested that anyone applying for a Tourist Visa should bring supporting documents that would prove my ties to Brazil (even though the only things that she looked at was my prove of work and an invitation letter from my now Husband).

    I agree that sometimes they don't look at them, but I really recommend bringing everything that you have, it's better than been asked for something and not having it.

I saw someone here reviewing her interview for naturalization that said that at the moment of the interview the Interviewer asked her this question and she said to the officer that even though she answered "no" in her form, she actually got a ticket and paid a $200.00 fine for not completely stopping at a stop sign, she said that the interviewer then changed her answer to "yes" and said it wasn't a problem. In her post she said that people should say "yes" if they have had a ticket as it is a "traffic citation".

I know for sure that you can get a DL with the EAD in any State (how can you work if you can't drive?), what I do know is that I got a DL here in Florida with my NOA1, I just went to DMV with my NOAs, my marriage certificate (I wanted to use my married name), passport and EXPIRED I-94. It took some time, as the woman didn't know exactly how to proceed and had to ask for help but my DL is valid for 1 year from the date that I applied and I don't even have a SSN as I entered United States in a tourist visa.

  16. I think the time that they say you should wait to reapply for a denied tourist visa is 6 months. Another thing, when I got my tourist visa in 2012 I brought with me an invitation letter of my husband (at the time my friend), and this was the only document that the consul looked at beside my work registration.

    From the moment that she have an application pending with USCIS it's like her time here "stoped"...the amount of time that she have been here stop, regardless of the type of visa or extension. She can stay without any problem, even after her extension expire, I recommend that she goes to DMV and get a drivers license wile she still have a regular status on her passport, this way she doesn't have to keep going around with her passport, they usually give it with a one year expiration from date of application, she just need to bring her passport, last I-94, and the letters from USCIS. If she already have a drivers license that will expire with her I-94 just go there with the documents that I told you before to get one valid for a year.

    wow, that's frustrating, but I noticed that this is something that's going on on everybody as far as I have seen here...every time that I look at my EAD and AP prediction on my timeline it is further away...there are actually a thread about it and someone thinks that it could be due to the summer vacations, I'm sorry to hear but I think that some people are just luck and their case end up been processed before...anyway, I'm sorry that you're waiting so long already without any updates, have faith and patience, hang in there and if you want to talk we are here to hear.

You'd think there would be someone competent enough just like there has been in the past to go "wow all the other service centers are close to 2-3 months ahead of Nebraska, let's transfer files to level the playing field out". I can only imagine the people Trump hired to oversee USCIS.

    I can't help but wonder about your consideration on the government and it's effect on USCIS processing time...assuming that you're right, they must have not been working much since last year, because if the cases that are been processed now are cases that where sent in January/February (6 months ago) what did they processed in January and February? You really think that the processing time took a great change because of the government that started exactly when the cases been processed where received?

     

    PS. Your Lawyer "who is a retired federal judge with over 60 years of experience" is "seriously considering retiring"...you lost me here!!!

    How old is he?

    What a man still working so close to or already in his 90's! (Considering that he is not retired just yet).

    Hi dear, I didn't include the I-797's I kept the package that they sent me back exactly like they sent me (just took the checks and pictures away) because I plan on bringing it with me to the interview (just in case, who knows)...so the only difference between my first and second package was the green letter that they sent with the package, this one I put on top of my cover letter, it would be the first thing that the person opening the package would see.

    Here is my timeline so far...

    05/28/2017 - Package Sent

    05/30/2017 - Package delivered 

    06/09/2017 - Package returned (outdated I-130)

    06/12/2017 - New package sent

    06/14/2017 - Package delivered

    06/20/2017 - Check cashed

    06/21/2017 - e-mails and texts received

    06/24/2017 - Notice of action (Acceptance letter) received in the mail.

    06/30/2017 - Biometrics appointment received in mail. (Appointment to 07/10/2017)

    07/03/2017 - Successful walk in and Biometrics done!

    Dear, I really understand why people get nervous about the interview...in the end of the day it's someone that you never saw in your life that's going to decide to believe if your marriage is valid or not, I mean, we get nervous for a job interview, why wouldn't you get nervous with a person just like you deciding if the love of your life is really the love of your life or not?

    I know that most of the people applying for a AOS through marriage do not have as much time in to the relationship as I do (it's almost 7 years since we meet online and 5 and a half years since we saw each other in person for the first time, almost 3 years living together)...but I'm nervous about the interview. Probably shouldn't, but I am!

    I am the principal immigrant and there is no derivative applicants, do I leave this blank? 

     

    Also I had my petition sent back to me because theres a theres a brand new i-485 (even though the one I filed on doesn't expire until october, but I'm just gonna send in again with the updated one) 

    They sent back my checks and everything and I spoke to them on the phone and they said I was not charged. Is there anything else I need to know about these type of rejection notices? They just said to send it right back the way it is with the new form.

    Leave derivative applicant in blank this is used for kids that are going through the process with a parent that would be the principal applicant.

    I had my package sent back to me because of an outdated form of I-130, I also called and I felt like they didn't know what they were talking about, anyway, I sent everything new, except for the checks and the pictures (I sent the same one that I sent before), all the forms and supporting documents where new.

    It was actually good, because I could find some dumb errors that could have caused me a lot of problems (mistype errors and unfilled parts) took me one day to put everything together again, since I originally made 2 packages, one to send and one to keep, exactly the same (I just put copies of the pictures and checks on the package made to be kept). So I knew exactly the order of the documents in the package, all that I did differently was to place the green letter on top of the package.

    Right now I'm anxiously waiting for my interview letter and hope that nothing is going wrong, it's been 5 weeks since my package delivery and I already did my biometrics last July 3rd.

    Should be coming any day now!!!

    Did you get your NOA1 on the mail?

    Just make sure you have the correct address because there is no update on the USCIS website when they mail the biometrics appointment so the only thing you'll get is the actual appointment letter, no e-mail, no text and no update on the website, you can also call USCIS to make sure that they didn't mail you anything.
