  1. Hello September Filers,

    A bit of info needed if that's OK. I applied for the EAD/AOS/AP back on October 4th - had the letters, biometrics etc done already.

    We got an RFE late October and sent it back but it was November 20th before they got it onto their system - two weeks after it was sent back.

    Anyway, just wondering if any of you guys had a similar experience - RFE-wise - and when we could expect to see our EAD at this rate. The spreadsheet you guys have here seems to show no-one had an RFE - go figure.

    Yes, we also got on RFE, and it usually takes them 1-2 weeks to update the system, but our case was also tranferred to CSC and Ricardo already got his EAD and AP docs so don't fret too much :) if it's been over 90 days then you should call them or do an info pass appt (i think it's 90 days, I'm not too sure) but it seems like you're "within the timeframe" for ppl who have had RFE's

  2. Ok, at the FL DMV things are a little upside down. Ricardo got here in June and by the time he had all the requirements to get a FL DL (the drugs/alcohol class, the written test, eye test and driving test) they only gave him a temporary license (a piece of paper) and then we had to wait to get a license with his face on it which expired the day his K1 expired . Even though by then he had his SSN, they only go by his immigration status. He just got his EAD last week, and we went today again to the DMV, and again they gave him a temporary license that expires in a month while he gets his "real" license that is only valid for 1 yr (b/c his EAD is only valid for one year) he had to pay 10.00 and had to do the eye test again. SO basically he's been driving with an expired licese all this time but thank God he never got pulled over. And then when he gets his green card we have to go thru the same process. The name that they put on the license is the name that appears on the immigration docs, whether it be the K1, EAD, passport, etc., so for now your wife might have to get a DL with her maiden name. Once you get your EAD then you can go ahead and use the name that appears on that , with a copy of your marriage certificate in order for our wife to have her married name on her license.

    Also note, even though my hubby had his license from his country (Panama) he had to take everything again as if he had never driven in the states. For Canada I don't know if they do a waiver but be prepared just in case.

    I'll soon change that!!!! Yay.....today I finally received my EAD in the mail. And just before Christmas as well!!! What a wonderful present!! On Tuesday I'll go get my SSN!

    I'm so glad we've already done our Christmas Shopping this year!!

    tomorrow hubby and I are going to the DMV to update his license and then on to SS to see if we can get his card...........can you believe that he never received his card the first time? he has a number but no card, and when we went to get another one, you know what they said "oh yea, SS cards get lost in the mail everyday don't worry about it" ......oh well at least the majority of us has gotten their docs!! it is truly a Merrier Christmas b/c of that :star:

    the reason why im tryin to get an entry level job is cos i know people wont hire me cos i dnt have exp here in the US..

    and it sucks that even at a secretarial job they'll be askin me for that f*ckin history..

    how am i gonna have that if nobody wants to give me a chance.. meye.gif

    My husband has the same mind set as you. he says that he wants to start working at wal-mart or similar so that way he starts a work history here in the US. Speaking of work.............My hubby got both his EAD and AP in the mail TODAY (Dec 15)!! it hasn't been even a week since his approval and he already got it!! God gave us our Christmas present early !! :) and what's wierd is that the AP status on the USCIS webpage says that his AP is still pending LoL, well anyways just wanted to share some good news with all of you.

    i told my hubby i would work in target just so i can have a work history and then work my way up..

    and i also told him.. just to get use to my new environment.. but he doesnt want me to work there.. :(

    he said a secretarial, receptionist/front desk or customer job will do..

    Thank you so much for the update. In my opinion the only good thing about a secretarial job is that most probably u'll only work 9-5 (no odd hours) and probably no weekends (at most on saturdays) with holidays off. But on the other hand if you work retail you can take advantage of the employee discount at the store, LoL. At first I felt the same way as your husband: Ricardo told me he wanted a job al Wal-Mart. But then he explained to me the same things that you just said about getting used to working here and about starting a job history in the US and working on up.

    Either way both jobs have pluses. it just depends on what you want your work environment to be. I personally work for walgreens as a pharmacy intern and I definitely take advantage of my employee discount. Even though I have to work odd hours and cover other people's shifts, the pay and benefits are worth it. I had a receptionist type job a few years ago, and even though my hours were steady, I couldn't put in overtime when I was short on cash, but at walgreens (or any other retailer) I can do that, and if I work a holiday I get extra pay. Anyways sorry for babbling so much, but that's what this forum is for. Thanks again for the update!

    Hey envy_me, I really appreciate all the hard work you put into making this awesome chart. It's one of the best ones i've seen on this site! I just want to let you know that Ricardo's EAD was approved on 12/10. Sorry I wasn't that specific before. It's so weird,the day my hubby got approved I was ranting, and then in a manner of seconds when I checked the USCIS website it was approved!! LoL. But what's strange is that his travel doc still hasn't been approved yet, but it was touched on the 9th so we're crossing our fingers. We re really hapy when i told Ricardo that he got his EAD he couldn't believe it! anyways thanks for the update, and once again thanks for our hard work

    BTW, congrats on getting your AP in the mail :thumbs:

    Let me tell you God was listening to my prayers extra hard today!! and it is so ironic because i had checked earlier today and nothing, I wrote the post and after that I checked USCIS.........are you kidding me??   8. thanks for the link, I'm in the same boat as you :wacko: it sucks waiting so long, Ricardo's travel document just got updated yesterday Dec. 9. That's the first update since they recieved it back on sept 25.....on Dec 16 I am calling them. I don't care if I'm in finals, why are they taking so long??? you can tell I'm just fed up with this....... :bonk:

    on a lighter note, congrats to everyone who is approved. :thumbs: ....can you rub some of that luck on the ones who are still waiting? please? pretty please? :huh:

  9. Yup we know the feeling too. Ricardo wanted to go home for the holidays. But he already broke the bad news to his mom and dad....they're ok about it but he's kind of sad. Now, we're going to tennessee for christmas which is exciting for the both of us, b/c I finally get a white christmas (we live in FL) and this is his first time seeing snow. But then we have nothing planned for new years which is kind of a bummer. here in the states ppl don't go all out celebrating new year's like they do in Panama (or any other latin american country) so I think New year's will be kind of tough but at least we're togther :)

    All i know is next year we are def going to panama in december, that's the last year I'll have a christmas break.....

    I'm just sick of waiting, and it's kind of depressing seeing ppl who applied after us getting approved, and we're still waiting. Don't get me wrong, I'm totally excited that ppl are getting their approvals, but I'm not an expert at the waiting game LoL

Well our RFE said that the co-sponsor had to be a US citizen or resident (in other words they needed proof of her citizenship) so I sent them everything: copy of her passport, copy of her Birth certificate and a copy of her divorce papers (her passport still has her married name on it) ....i also resent them her tax papers and the full application again signed and dated. As of yesterday (Fri. Oct 24) the documents were recieved at MO, so now we're just waiting for them to update our case and hopefully transfer it......I'm telling you, sometimes I think that USCIS issues out RFE's just to bother us to see how fast we respond....ridiculous, at least hubby's biometrics went super smooth, he got there 15 minutes early and they took care of him right away, got out in 5 min B)

  11. RFE arrived today. When I sent in the I-864, Affidavit of Support, I sent them copies of Larry's tax returns (1040) for the last 3 years. The RFE wants the supporting documents for the most recent tax year - W-2's, 1099's etc.

    So that's all I need to send back to them are copies of Larry's W-2 for 2007???? It will be in the mail tomorrow as I need to wait for Larry to come home to find it.

    I didn't know that this RFE also holds up the EAD. "The Service will process your I-765, Application for Employment Authorization (if submitted) within 90 days of the receipt of your missing initial evidence. This is pursuant to Title 8, Code of Federal Regulations, Section 103.2( B) (10)(ii)."

    If your husband can't find his W-2, you can request a copy of your tax transcript. I remember a long time ago when I started this whole process that an immigration Lawyer advised me that USCIS prefers the tax transcript. Of course they don't tell you this but it's true. For the K1 visa, I got my tax transcripts and the ones for my sponsor and they accepted it just fine. Now the key is to get them, you have to call: 1-800-829-1040, choose 1 and then 1 again (i think) anyways you'll hear an option to request a copy of your tax transctipt but don't be fooled, this is to send it to you by mail and they want to charge you, what you do is press "0" to speak with a rep and tell that that you would like your tax transcripts to be faxed. If you want them faxed, it's free, but there's a catch..........you have to wait at least 40-60 min for a person to help you,(while i was waiting they repeated the swan lake waltz a million times) so yea you need a lot of time and patience in addition to being next to a fax for them to do that. Now, hen they finally answer ou they're going to verify that you are the person who's name is on the transcript (in other words your husban has to call) but other than that you get your transcript right away and USCIS accepts it no problem. Also, I got mines faxed to the staples that i was at b/c i don't have a fax, so as long as you tell them that you are next to a fax they'll send it to you. Hope this helps ;)

According to tthem they sent us a notification via mail on October 10. So, we're just waiting for that. But the EA and the AP application "seem" to be ok......I'm still dying to find out why we gor an RFE....could it be because we have a joint sponsor?

    I, too, had a RFE, and we recently just mailed in the additional evidence. In less than 5 business days you should receive the actual letter detailing exactly what you will need to send in. Could be anything really, medical record, taxes, birth certificate... Sometimes they request things you've already sent (so I heard), so don't worry just yet. It happens more common than you think. Hang in there!

    Well I guess I don't have to worry much, I looked at the forms that we sent and realized that there is a line on the Co-Sponsor form that says that we have to include evidence of citizenship by sending in a BC, passport, or naturalization certificate...........and guess what I forgot to tell the co-sponsor..... :angry: oh well, I already contacted the co-sponsor and told her to please send me a copy of her passport.........even though I haven't recieved the RFE notice yet, I have a hunch that that's what it is, either that or they want us to resend info.........but if you say that it happens more often then I think that gives me peace of mind (I think) My husband says to be patient to see what exactly they want....I'm trying but I can't! LoL We didn't even get an RFE for the K-1, but then again, it's USCIS

  14. Yes, USCIS will update your status if they decide to transfer your case. You'll also receive a hardcopy in mail. This is to make sure you at least know where your case is, in case USCIS doesn't know it anymore ;) Tranfers to CSC will mostly (but not always) occur within the first week after the FP appointment. O, it took USCIS about a week to update my case on the transfer to CSC. My impression is that MSC is slow on online updates of their cases vs. CSC seems to update their cases immidiately. That's just my impression though.

    Thanks! I have a better idea how it works now.........so I guess we have to do our favorite thing.......wait......

  15. We finally mailed our AOS packet Sept 10th. It was received the 12th, and all 3 NOAs are dated September 16th. Alf's biometrics appointment is on Oct. 9th.

    I'm hoping we're all approved quickly, but I don't think the waiting will be as bad this time. He's here with me, so that makes everything easier! :thumbs:

I see that you were a July K1 filer........so you and me both know how "wonderful" it is to wait LoL.......anyways I just wanted to ask you: how do you know that your case has been transferred? do they tell you that online? do you recieve a notice in the mail? Well, good luck with everything and it seems that things are running smoothly for you guys in your AOS.....I wish you all the best! ;)

  18. Hey guys! I just found out today (sunday) that our check got cashed on Friday!! woohoo!! I know that for the K-1, when using a personal check they would put the WAC# on the check and from then on you could track your case online........is that the same for AOS?? I see a whole bunch of numbers on my check (with my bank I'm able to see the front and back of the check that was cashed), but I don't know which one is our case number?? Or are things different with the AOS?? any feedback is greatly appreciated!! it won't be long before we get out NOA's!

    I'm glad to be part of the September AOS filers!! We sent our packet on Sat. Sept 20, and yesterday Monday, we got confirmation that Chicago recieved it. SO now we're just waiting on the NOA's for: AOS/EAD/AP. Also I have a question would my case be transferred to the Miami Local office since I live near Ft. Lauderdale?? or how would I know which center it would be transferred to?? well I guess we'll be talking to each other alot in the following months.     about the SSN situation....technically your fiance/e was able to get it within 2 weeks of his arrival regardless if you guys were married or not.........that's what my fiance (now husband) did, we waitined about 2 and a half weeks he applied, and they didn't give hima any problems, and he got his social.......but we did have to wait a loooooooong time (it was only 6 weeks but I'm not a very patient person) so you can try and apply, the worst they can say is No, half of the employees are unaware that a K1 can get a social before their EAD. Hope this helps :)
