  2. Hello,

     

    My spouse who is a USC petitioned my son to come here. We got the approval April 2020. I didn't really bother much on processing it yet coz plans changed due to the pandemic. It will expire next month, the 16th if I won't start processing for the immig fees. So I paid it last week. My only concern is, my son's passport is expired already. My mom back home wasn't able to renew it due to the lockdown in our city and senior citizens and kids weren't allowed to go out. They lifted it this month already so my mom was able to get an appt to passport renewal. 

     

    My son's passport won't be release before April 16. So that means I wont be able to upload his new passport info in the CEAC portal. 

     

    Are they gonna reject or deny the application if I won't be able to provide it by April 16 or the i-130 approval is extended since I already paid the fees. 

     

    I'm just on a panic mode right now coz i don't want to go back to zero on processing again. :(

     

    Any advice will be appreciated.

    i always keep receipts till person acknowledges a package

    and for immigration,  i kept all receipts till he became a Citizen

    The thing is i sent it thru my work. So mailman just picked it actually. I don't know why I did that. I always go to USPS office to drop it so i get the receipt but this time i didn't. :(

    You did the right thing by using a check.  So you can follow the money.  
     

    If neither the check is cashed nor NOA1 is received by February 7, then send a new I-751 with a cover letter indicating that you believe the first application was lost in the mail.  With a new check.  


    Between now and February 7 do the follow to prepare:

     

    * set up an account on USPS dot com and enable informed delivery, and set up the ability to ship packages with priority mail. 
     

    * get priority mail flat rate boxes or envelopes from the post office that will fit your new package. 
     

    * write the cover letter 

     

    * get the money together for your second I-751 in case both checks are cashed.  You don’t want a bounced check to mess up your application 

     

    Then on February 7, create the ship meant and drop it off

     

    Track it.

    Your visa does not expire on Feb 21st.  Your Green Card expires.  Your status as a legal resident does not expire.  Only the evidence of your status expires....not the status, itself.

    Thank you for replying and making it clear about my status too once green card expires. I was a bit worried too coz it might affect my work if my green card is expired already. But thanks for making it clear. :)

    I need some advice. I sent my ROC last Nov. 30,2020 since my visa will expire on Feb 21. I mailed it thru USPS but without tracking. Its been 6 weeks now and they still didn't take from my account the check i sent. I'm worried now if they didn't receive it or just delayed. 

     

    Should I mail a new application? 

    Anyone has the same case as me please?

    Until i get my EAD, thats the only time i'll stop worrying i guess. I dont have SSN until now too coz i applied it along with my EAD. So i hope it will come together. I just dont understand in my AP status coz it says 'Appeal is dismissed'. Might be rejected. But its okay. EAD is more important though.

    I applied my AOS + EAD with SSN + AP November 6 last year. After my biometrics on Dec 6, i didnt hear any update from them anymore. So after 90 days around Feb, i did service request online for my EAD. After a week, i sent again another service request. Then they replied after a month and sent me a mail that my service request was processed already. Then around April they sent me an RFE. Then i replied after a week then thats it. Now my case is ready. But i'm still puzzled with my EAD status coz it says 'New card is being produced'. It didnt say approve. They will mail it to me though so i'll just wait and see then.

    My AOS was changed last May 2 to 'Case is ready and to be scheduled for interview. Then yesterday, in my EAD, it says 'New card is being produced' and they will just mail it to me. It didnt say anything that its approved. And my AP, it says 'Appeal is dismissed'. I dont get it if my EAD is really approved. I'll just wait for the mail to come then and see. 😟

    Nobody can really tell my dear. Its in their hands. Mine was almost 180 days before I get a positive reply from them. I got an RFE last month too and i replied to them and they received it Apr. 24 then after a week, my AOS status was changed to case is ready and for interview schedule then after a week again, my EAD status changed to 'new card is being produced and they'll just mail it. So im just waiting for it now. 

    Just do service request. Thats what I did after 90 days. I did two service request. They only replied after the second one.

    We cant really tell when they will schedule us. But its kinda unfair coz the January 2018 applicants online got their GC in 3 months time or less. I dont know how they can skip the pending ones and just approve the new ones just like that.

    Good to know we both just waiting for interview schedule now. 😊 but just wait for another week. They might change your EAD status to 'new card being produced'. Coz my AOS stat online was changed to 'case is ready...' on May 2 and just yesterday, my EAD stat was changed to 'new card being produced' and i just have to wait for them to mail it. I feel better that my EAD will arrive soon. At least i can work already while waiting for the interview schedule. Hope you'll get yours too.

    Nothing worked. Got no money to hire a lawyer. And I have serious doubts about mine is on the way. Infopass officer told me to wait 10 more days yesterday. 

     

    That's crazy then. And even if you hire a lawyer too, i think it'll be useless still coz its in the USCIS hands. We'll just hope they do something about it soon. Even at least for the EAD only for now. Its not easy to be jobless this long. They don't want us to work illegally here, so they should approve our EAD petition in the said frame time.

    I have no idea what went wrong with my case. They got my RFE at April 10 and got nothing's going on since then. I feel like expedite request won't work too. 

     

    Did you call them? I think it really depends on the office. LA office is fast. Im in Baltimore and most of the last years apps got theirs recently only too. Do a service request online. That's what i did. But it will take a month before they reply still. Its crazy. But maybe yours is on the way soon too coz youve waited this long already. Best of luck.

    They received my RFE reply last Apr 24 and they changed my AOS status to 'Case is ready and to be scheduled for interview' last May 2. Then I checked my status again yesterday, in my EAD it says 'New card is produced' and they will just mail it to me. Then my AP it says 'Appeal is dismissed'. So i don't really know if that's the work permit already. 

     

    Its kinda unfair for us waiting this long and the once who applied from January this year got their GC already in 3 months or less. I dont understand why USCIS do that. They should prioritize the one who waited this long already.

    I would mention though that I asked for expedited processing and was approved, because I had a job offer and honestly I started working already...  I can't realistically been expected to live in San Francisco and not work, I would be homeless and my wife's salary was low.

     

    In any case, EAD usually takes around 90-120 days without expedited processing.

    I just checked my status online again today, in my EAD it says New card is being produced and they will mail it to me but my AP it says appeal is dismissed. I dont get it. But im just happy my EAD is coming already though. I just need a job soon. I might wait for a year or so like you before being scheduled for interview then.

    Im on the same boat as you. But atleast you got a reply in less than 90 days. Ive waited for 180 days now for my EAD but after i sent back my RFE, they changed my status to case is ready and to be scheduled for interview this may 2 only. Now im a bit apprehensive coz ive read a lot of threads that theyve waited for a year or more to be scheduled only but atleast they got their EAD while waiting. But me? I dont have it yet. Its too much waitinf already and being unemployed. Its crazy.

    Hi, 

    Did your husband get his EAD already?  Mine is almost 180 days already. I did SR after 90 days and they replied after a month then sent me an RFE and replied to it. May 2, they changed my status to case is ready and to be scheduled for interview. I was hoping they will approve my EAD coz i really need to find a job already. Now i have to wait for a schedule again.
